Service Delivery Delay. Should GTT fail to activate any Service by the stated Firm Order Complete (FOC) Date, GTT shall credit the Client in accordance with the table below. Alternately, if GTT fails to activate Service within 60 (sixty) days after the stated FOC Date, Client may terminate the Service order without penalty or further liability. Service Delivery Delay. 5.5.1 Should GTT fail to activate any Service installation by the stated FOC Date, GTT shall credit the Client in accordance with the table below, where: a. “Days FOC Date Exceeded” are in business days and are valid for Service installation for Client solutions under twenty-five (25) locations. Service installations with twenty-five (25) or more locations will be managed on an individual case basis. b. The amount of the NRR charge(s) for the purposes of this Section 5.5.1 is the sum of the NRR charges for all the Services for the affected Client Site, excluding those that may have been incrementally delivered before or on the FOC Date as per Section 5.3 above. c. The amount of the MRR charge(s) for the purposes of this Section 5.5.1 is the sum of the MRR charges for all the Services for the affected Client Site, excluding those that may have been incrementally delivered before or on the FOC Date as per Section 5.3 above. 1-15 50% - 16-30 100% - 30+ 100% 25% 5.5.2 Alternately to Section 5.5.1 above, if GTT fails to activate any Service within sixty (60) days after the stated FOC Date, Client may terminate the affected Service without penalty or further liability.
