Services Provided by Landlord. Landlord shall provide the following facilities and services to Tenant: A. Electricity for normal lighting purposes and the operation of ordinary office equipment, subject to Section 7.03, below; B. Normal and usual cleaning and char services after Building Hours each day except on Saturdays, Sundays and legal holidays recognized by the United States Government; C. Rest room facilities and necessary lavatory supplies, including hot and cold running water at the points of supply, as provided for the general use of all tenants in the Building, and routine maintenance, painting, and electric lighting service for all Common Areas of the Building in such manner as Landlord deems reasonable; D. During Building Hours, central heating and air conditioning during the seasons of the year when these services are normally and usually furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premises. Landlord shall provide the aforesaid services at other times, at Tenant’s expense, provided Tenant gives Landlord notice by 1:00 p.m. on weekdays for after-hour service on the next weekday, by 1:00 p.m. the day before a holiday for service on a holiday, and by 1:00 p.m. on Friday for after-hour service on Saturday or service on Sunday. Such after-hour, holiday or special weekend service shall be charged to Tenant at rates to be calculated by Landlord, which rates shall be given to Tenant on request. While the current rate for such after hours HVAC is Fifty-Five Dollars ($55.00) per floor/per hour, Landlord reserves the right to reasonably adjust, from time to time, the rate at which such services shall be provided. Tenant shall pay for such service, as Additional Rent, within thirty (30) days of receipt of an invoice with respect thereto; E. Automatically operated elevator service, if applicable; F. All electric bulbs and fluorescent tubes for building standard light fixtures in the Leased Premises and Common Areas; G. Two (2) keys to the Leased Premises at no cost to Tenant, all additional keys at the cost of Tenant; and H. An electronically controlled perimeter access system to the Building’s entrance. Landlord shall provide Tenant with two (2) Building key cards at Landlord’s expense. Any additional or replacement cards shall be at Tenant’s expense. Individual security systems shall be installed by Tenant at Tenant’s cost.

Services Provided by Landlord. Landlord shall provide the following facilities and services in a manner reasonably consistent with the standard of other first-class suburban office buildings comparable to Tenantthe Building in the south Charlotte area:
A. Electricity (i) Heating, ventilation, and air conditioning (HVAC) for the Premises during Business Hours, as hereinafter defined (and at Tenant’s election and expense, during non-Business Hours requested by Tenant), to maintain temperatures for normal lighting purposes office use and the operation of ordinary office equipmentoccupancy; provided, however, subject to the provisions in Section 7.035.5(c) herein, belowLandlord shall operate the Building’s HVAC system in a manner that will maintain in the Premises the following conditions: (A) summer indoor temperature of approximately 74° F dry bulb (plus or minus 2° F); and (B) winter indoor temperature of approximately 72° F dry bulb (plus or minus 2° F);
B. Normal and usual cleaning and char services after (ii) Automatic passenger elevators providing service to the floors above the first floor in the Building Hours each day except on Saturdayswhich the Premises are located twenty-four (24) hours per day, Sundays and legal holidays recognized by seven (7) days per week. Additionally, one (1) of the United States Government;
C. Rest room facilities and necessary lavatory supplies, including hot and cold running water at Building elevators (the points of supply, as provided “Loading Dock Elevator”) serves the loading dock for the general use Building with a separate rear door, and during any portion of the Lease Term in which Tenant is leasing from Landlord all tenants of the rentable space in the Building, Tenant shall at all times have access to such Loading Dock Elevator through such separate rear door (subject to occasional interruptions due to repairs and routine maintenance, painting), and electric lighting service for all Common Areas during any portion of the Building Lease Term in such manner as which Tenant is leasing from Landlord deems reasonable;
D. During Building Hours, central heating and air conditioning during the seasons less than all of the year when these services are normally rentable space in the Building, Landlord agrees to provide Tenant with access to the Loading Dock Elevator through such separate rear door on a reasonable basis (subject to occasional interruptions due to repairs and usually furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premisesmaintenance). Landlord shall provide the aforesaid services at other times, at install protective padding in such elevator during Tenant’s expenseinitial move and installation of its furniture and equipment into the Premises;
(iii) Janitorial services to the Premises for normal office use Monday through Friday, exclusive of holidays described in Section 5.2 herein, in substantial accordance with the janitorial specifications shown in Exhibit H hereto. At Tenant’s request, Landlord may, but shall not be obligated to, provide additional janitorial services beyond those required to be provided by Landlord pursuant to the immediately preceding sentence, provided Tenant gives Landlord notice by 1:00 p.m. on weekdays for after-hour service on the next weekday, by 1:00 p.m. the day before a holiday for service on a holiday, and by 1:00 p.m. on Friday for after-hour service on Saturday or service on Sunday. Such after-hour, holiday or special weekend service shall be charged to Tenant at rates to be calculated by Landlord, which rates shall be given to Tenant on request. While the current rate for such after hours HVAC is Fifty-Five Dollars ($55.00) per floor/per hour, Landlord reserves the right to reasonably adjust, from time to time, the rate at which documented cost of such services shall be provided. paid by Tenant shall pay for such service, to Landlord as Additional Rent, Rent within thirty (30) days of receipt of an invoice with respect theretofor such costs from Landlord;
E. Automatically operated elevator service(iv) Water sufficient for drinking, if applicable;
F. All electric bulbs lavatory, toilet, and fluorescent tubes for building standard light ordinary cleaning purposes to be drawn from approved fixtures in the Leased Building (see Section 8 of Exhibit C-1 hereto regarding the inclusion of hot water tanks as a part of the Tenant Improvements);
(v) Electricity to the Premises during Business Hours in reasonable amounts necessary for normal office use, lighting, and HVAC, and providing for the Premises to have an electrical capacity of up to 6.0 xxxxx per square foot of Rentable Area of the Premises, exclusive of lighting. Additionally, the Building is equipped with an emergency backup generator to operate emergency lights and one elevator in the event of an interruption of electric utility service. Notwithstanding the electrical capacity of up to 6.0 xxxxx per square foot of Rentable Area of the Premises referenced above in this Section 5.1(a)(v), the threshold of “above standard” electrical consumption in the Premises that could trigger Additional Rent obligations of Tenant under Section 5.1(b) herein may be substantially lower than 6.0 xxxxx per space foot of Rentable Area of the Premises, and reference is made to the terms and provisions in Section 5.1(b) herein to determine if such Additional Rent payment obligation has been triggered;
(vi) Replacement of Building Standard lighting tubes, lamp ballasts, and bulbs for 2’ x 2’ or 2’ x 4’ fluorescent fixtures only. Landlord shall also be responsible for maintaining, repairing and replacing any lamps, whether fluorescent or incandescent, for any special or non-Building Standard lighting fixtures, provided the costs incurred by Landlord in performing such work shall be reimbursed by Tenant to Landlord as Additional Rent within thirty (30) days after Landlord’s delivery to Tenant of an invoice for such costs;
(vii) Window washing in the Premises, inside and outside, at reasonable intervals;
(viii) Extermination and pest control when necessary;
(ix) Building security services, including a card access system for the exterior doors of the Building (provided the costs incurred by Landlord in providing the initial access cards and any replacements to Tenant for distribution to Tenant’s employees and agents shall be reimbursed by Tenant to Landlord within thirty (30) days after Landlord’s delivery to Tenant of an invoice for such costs), roving security within the Business Park on a periodic basis as determined by Bissell Companies (in its capacity as property manager for the Building and for other buildings in the Business Park) and closed circuit surveillance cameras that record entries and exits via main Building access doors and activities in lobby foyers (provided, however, Landlord has informed Tenant that such surveillance cameras are not regularly monitored on a real-time basis). Notwithstanding the foregoing, during all portions of the Lease Term when Tenant is leasing from Landlord all of the rentable space in the Building, Tenant shall have direct operational control over the surveillance cameras located in the interior of the Building, provided Tenant (A) runs such surveillance cameras and records footage therefrom twenty-four (24) hours a day, seven (7) days a week at Tenant’s sole cost and expense; (B) retains such footage for a period of at least thirty (30) days after such footage is recorded at Tenant’s sole cost and expense; (C) reasonably cooperates in making such tapes available to Landlord to view in connection with any break-in, breach of security or any other incident which affects, or could potentially affect, Landlord’s interest in the Building and/or any property contained therein, or which exposes, or could potentially expose, Landlord to liability, increased costs (e.g., increase in insurance premiums) or other similar risks; (D) maintains such equipment and appurtenances in good condition at Tenant’s sole cost and expense; and (E) agrees to indemnify and hold harmless Landlord from and against any loss, cost or damage arising in connection with the use of such equipment during the period in which such equipment is in Tenant’s direct control pursuant to the terms hereof. Additionally, other than the surveillance cameras (including associated cabling) installed in the Building as of the Date of Execution, Landlord shall have no obligation to provide Tenant with additional surveillance equipment (e.g., monitors) unless otherwise expressly set forth in this Section 5.1(a)(ix); and, upon the expiration or earlier termination of this Lease or, at such time during the Lease Term when Tenant is no longer leasing from Landlord all of the rentable space in the Building, Tenant shall relinquish control of such equipment and appurtenances owned by Landlord, and such equipment and appurtenances shall be in generally the same condition as when Tenant assumed direct operational control of such items, normal wear and tear excepted.
(x) Maintenance (including repair and replacement, where applicable) of the Exterior Common Areas (including, without limitation, the Parking Areas) and the Building-Specific Common Areas;
G. Two , including the Building’s security, life/safety (2) keys including sprinkler), HVAC, mechanical, electrical and plumbing systems (excluding, however, any security, life/safety (including sprinkler), HVAC, mechanical, electrical and plumbing improvements installed in the Premises as part of the initial Tenant Improvements or any subsequent Improvements), the costs of which Landlord shall be permitted to the Leased Premises at no cost pass through to Tenant, all additional keys at the cost of Tenant; and
H. An electronically controlled perimeter access system as Additional Rent, to the Building’s entrance. Landlord shall provide Tenant with two (2) Building key cards at Landlord’s expense. Any additional or replacement cards shall be at Tenant’s expense. Individual security systems shall be installed full extent allowed under the terms and provisions of Section 4.2 herein, subject to the terms and provisions of Section 6.5 relating to warranties held by Tenant at Tenant’s costrelative to the Tenant Improvements.

Services Provided by Landlord. Subject to the provisions of Article 2 hereof, Landlord shall will provide the following services, in a manner consistent with those provided in other first-class office facilities in the so-called "East-West Corridor" in DuPage County, Illinois, on all days excepting Saturdays, Sundays and those holidays set forth on Exhibit E attached hereto and made a part hereof ("Holidays"), and as otherwise stated (the cost of which services, except as otherwise provided herein, will be included among the Operating Expenses):
(a) Nightly janitorial services to Tenant:
A. Electricity for normal lighting purposes Monday through Friday in and about the Premises and the operation common areas of ordinary office equipmentthe Building, all as generally described on Exhibit F attached hereto and made a part hereof.
(b) All electric lighting bulbs and tubes and all ballasts and starters within the Premises will be replaced by Landlord at the reasonable expense of Tenant and will be paid by Tenant upon receipt of invoice from Landlord as Rent.
(c) Heat, ventilating and air conditioning from 7:00 a.m. to 7:00 p.m., Monday through Friday (other than Holidays), and from 8:00 a.m. to 1:00 p.m. on Saturdays (other than Holidays), subject to Section 7.03matters beyond Landlord's reasonable control. During other hours, below;Landlord will provide such additional amounts of heating, ventilating and air conditioning upon a reasonable advance notice from Tenant to Landlord, which advance notice will not be later than 3:00 p.m. on the day on which such additional service is requested (or 3:00 p.m. on the business day before a Saturday, Sunday or Holiday). Tenant, upon presentation of a xxxx therefor, will pay Landlord for such service on an hourly basis at such prevailing rates as reasonably established by Landlord from time to time. If such extended service is not a continuation of that furnished during regular business hours as described above, Tenant will pay for a minimum of three (3) hours of such service.
B. Normal (d) Hot and usual cleaning cold water from the regular building outlets for lavatory and char services after Building Hours each day except drinking purposes.
(e) Passenger elevator service in common with other tenants to be provided by five (5) automatic elevators, one of which is a "swing" elevator for use also as a freight elevator. Landlord will have the right to restrict the use of elevators for freight purposes to the "swing" freight elevator and to hours to be determined by Landlord. Landlord will have the right to limit the number of elevators to be in operation on Saturdays, Sundays and legal holidays recognized by Holidays.
(f) Maintenance in good order, condition and repair of the United States Government;
C. Rest room facilities Parking Garage and necessary lavatory supplies, including hot and cold running water at the points of supply, as provided for the general use of all tenants in the BuildingParking Area (if any), and routine maintenanceall driveways leading thereto and keeping the same free from any unreasonable accumulation of snow. Landlord will keep and maintain the landscaped area, paintingthe Parking Garage and the Parking Area (if any) in a neat, orderly and electric lighting service for all Common Areas reasonably well-lit condition. The Executive Parking Area of the Building in such manner as Landlord deems reasonable;
D. During Building Hours, central heating and air conditioning during the seasons of the year when these services are normally and usually furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Premises and Parking Garage will include a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premisescontrolled access system. Landlord shall provide the aforesaid services at other times, at Tenant’s expense, provided Tenant gives Landlord notice by 1:00 p.m. on weekdays for after-hour service on the next weekday, by 1:00 p.m. the day before a holiday for service on a holiday, and by 1:00 p.m. on Friday for after-hour service on Saturday or service on Sunday. Such after-hour, holiday or special weekend service shall be charged to Tenant at rates to be calculated by Landlord, which rates shall be given to Tenant on request. While the current rate for such after hours HVAC is Fifty-Five Dollars ($55.00) per floor/per hour, Landlord reserves the right to reasonably adjustdesignate areas of the Parking Garage and the Parking Area (if any) where Tenant, and its agents, employees, licensees and invitees, will park, and may exclude Tenant, and its agents, employees, licensees and invitees, from parking in other areas as designated by Landlord; provided, however, that Landlord will not be liable to Tenant for the failure of any tenant, or its employees, agents, licensees and invitees, to abide by Landlord's designations or restrictions. Tenant, and its employees, agents, licensees and invitees, will not be permitted to use more spaces in the Parking Garage or the Parking Area (if any) than those attributable to the Premises pursuant to the Parking Capacity, and the use of all parking spaces in the Parking Garage and the Parking Area (if any) will be subject to such reasonable rules and regulations as Landlord may from time to timetime institute. Further, the rate at which such services shall be provided. Tenant shall pay for such service, as Additional Rent, within thirty (30) days of receipt of an invoice with respect thereto;
E. Automatically operated elevator service, if applicable;
F. All electric bulbs and fluorescent tubes for building standard light fixtures Landlord may reserve parking spaces in the Leased Premises and Common Areas;
G. Two (2) keys Parking Area in a location from time to time designated by Landlord, for the exclusive use of visitors to the Leased Premises at no cost to TenantBuilding and other tenants in the Building (and their respective employees, licensees and invitees). Landlord will also maintain in good, clean order, condition and repair, and will perform and make all reasonably necessary maintenance, repairs and replacements to, all additional keys at of the cost structural components of Tenant; andthe Building, and the common areas and common building systems of the Building.
H. An electronically controlled perimeter (g) Subject to the Building Rules and Regulations to which reference is made in Section 16.19 hereof and other reasonable security restrictions, and except for matters beyond Landlord's reasonable control, access system to the Building’s entrance, the Parking Garage, the Parking Area (if any) and the Premises on a 24 hours per day, 7 days per week and 365 days per year basis.
(h) The Deli for the use of, among others, Tenant's employees and invitees.
(i) The Fitness Center for the use of, among others, Tenant's employees. There will be no on-site director or other staff for the Fitness Center, and the use thereof will be on a first come, first serve basis, depending on the availability of equipment and other facilities therein. There will be no separate charge for the use of the Fitness Center.
(j) Security on a 24 hours per day, 7 days per week and 365 days per year basis; provided, however, that Landlord shall provide Tenant with two will not be liable for any lack of security in respect to the Office Complex whatsoever.

Services Provided by Landlord. Landlord shall, in addition to any services provided elsewhere in this Lease at its expense but subject to the same being included in Operating Expenses furnish or cause to be furnished to Tenant the following services, utilities, supplies and facilities:
(A) Access to the Leased Property twenty-four (24) hours a day, seven (7) days a week;
(B) Passenger elevator service twenty-four (24) hours a day, seven (7) days a week;
(C) Heat, ventilation and air conditioning ("HVAC") of common areas, except on legal holidays, Monday through Friday between the hours of 7:00 A.M. to 6:00 P.M. (herein "Business Days") and on Saturdays from 7:00 A.M. to 12:00 P.M. and, at Tenant's additional cost (which shall be billed at Landlord’s actual cost with no additional markup) at such other times as may be requested so that at all times during the foregoing hours, the Leased Property shall be comfortable to Tenant’s employees. The air conditioning system referred to in this Article shall be capable of providing 78 degrees F dry bulb and 50 degree% relative humidity with an outside condition of 88 degrees F dry bulb and 74 degrees F wet bulb.
(D) Cleaning maintenance and janitorial services to the Leased Property and the common areas of the Building and grounds as set forth on Exhibit F attached hereto. Tenant shall have the right to contract to clean the Leased Property itself. If Tenant shall so elect, Operating Expenses shall exclude the cost of cleaning other tenant spaces.
(E) Hot and cold running potable water and water for the fire protection system to the Building for general office purposes.
(F) Provision, installation and replacement of light bulbs, tubes and ballasts in the common area of the Building.
(G) Vermin extermination and repair and replacement of any item in the Building damaged by vermin.
(H) Landlord shall provide electricity to the following facilities Leased Property for lights, outlets and services to Tenant:
A. Electricity for normal lighting purposes and run the operation of ordinary office equipment, subject to Section 7.03, below;
B. Normal and usual cleaning and char services after Building Hours each day except on Saturdays, Sundays and legal holidays recognized by HVAC that serves the United States Government;
C. Rest room facilities and necessary lavatory supplies, including hot and cold running water at the points of supply, as provided for the general use of all tenants Leased Property in the Building, and routine maintenance, painting, and electric lighting service for all Common Areas of the Building in such manner as Landlord deems reasonable;
D. During Building Hours, central heating and air conditioning during the seasons of the year when these services are normally and usually furnished based upon standard electrical energy requirements of not more an amount no less than an average of five (5) 8 xxxxx per square foot of the Leased Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premises. C. Rest room facilities and necessary lavatory supplies, including hot and cold running water at the points of supply, as provided for the general use of all tenants in the Building, and routine maintenance, painting, and electric lighting service for all Common Areas of the Building in such manner as Landlord deems reasonable;
D. Maintenance of electric bulbs and other lighting elements for Building standard light fixtures in the Common Areas and Parking Garage;
E. Provision of a lobby attendant on Business Days from 6:00 AM through 6:00 PM local time;
F. During Building Hours, central heating and air conditioning during to the seasons Operating Standard. Capacity of Building HVAC system will be sized in accordance with cooling and heating load calculation procedures established by ASHRAE and local climatic conditions, and the HVAC system will comply with state and local building codes. Systems for the introduction of outside air for ventilation shall be designed, maintained and operated to meet or exceed the requirements of ASHRAE Standard 62.1-2007, unless local requirements are more demanding. At a minimum, the system shall provide 1 ton of cooling for every 340 USF and 1.0 CFM per 1 RSF of air circulation capacity, based on a 55°F supply air temperature;
G. Tenant acknowledges, agrees and covenants that all Tenant lighting within the Premises is required to comply with the prescriptive requirements defined in Table 140.6-C of the year when these services are normally 2019 California Energy Code (Title 24 Part 6). Subject to the availability of electricity from Pacific Gas & Electric (or other applicable electrical utilities provider), Landlord shall provide electricity for normal office purposes at all times, including task and usually furnished based upon standard electrical energy requirements of task ambient lighting systems, normal office equipment, including, but not more than an average of five (5) xxxxx per square foot of the Leased Premises limited to, copy machines, computers, terminals, communications and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premisesaudiovisual equipment, vending machines, and kitchen equipment. Landlord shall provide the aforesaid services at other times, at Tenant’s expense, provided Tenant gives Landlord notice by 1:00 p.m. on weekdays for after-hour service on the next weekday, by 1:00 p.m. the day before a holiday for service on a holiday, and by 1:00 p.m. on Friday for after-hour service on Saturday or service on Sunday. Such after-hour, holiday or special weekend service shall be charged furnish to Tenant at rates wattage and electricity up to be calculated by Landlord, which rates shall be given an amount necessary to Tenant on request. While the current rate for such after hours HVAC is Fifty-Five Dollars ($55.00) operate its business and all equipment of not less than 6.5 xxxxx per floor/per hour, Landlord reserves the right to reasonably adjust, from time to time, the rate at which such services shall be provided. Tenant shall pay for such service, as Additional Rent, within thirty (30) days of receipt of an invoice with respect thereto;
E. Automatically operated elevator service, if applicable;
F. All electric bulbs and fluorescent tubes for building standard light fixtures in the Leased Premises and Common Areas;
G. Two (2) keys to the Leased Premises at no cost to Tenant, all additional keys at the cost of Tenantusable square foot; and
H. Services Provided by Landlord. 30.1. So long as Tenant is not in default of its obligations hereunder beyond the expiration of any applicable grace period, Landlord shall provide the following provide: (a) necessary elevator facilities on business days from 8 a.m. to 6 p.m. and services to Tenant:
A. Electricity for normal lighting purposes and the operation of ordinary office equipment, have one elevator subject to Section 7.03call at all other times; (b) heat, below;
B. Normal air-conditioning or ventilation to the Demised Premises between the hours of 8 a.m. to 6 p.m., Monday through Friday and usual cleaning and char services after Building Hours each day except 8 a.m. to 1 p.m. on Saturdays, Sundays other than the Legal Holidays (which are listed on Exhibit D attached hereto and legal holidays recognized made a part hereof and which may hereafter be amended by the United States Government;
C. Rest room facilities and necessary Landlord in its reasonable discretion); (c) water for ordinary lavatory suppliespurposes, including hot and cold running but if Tenant uses or consumes water at the points for any other purposes or in unusual quantities (of supply, as provided for the general use of all tenants in the Building, and routine maintenance, painting, and electric lighting service for all Common Areas of the Building in such manner as Landlord deems reasonable;
D. During Building Hours, central heating and air conditioning during the seasons of the year when these services are normally and usually furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premises. which fact Landlord shall provide be the aforesaid services at other timessole but reasonable judge), Landlord may install a water meter at Tenant’s expense, which Tenant shall thereafter maintain at Tenant’s expense in good working order and repair, to register such water consumption and Tenant shall pay for water consumed as shown on said meter as additional rent as and when bills are rendered; (e) cleaning services for the Demised Premises (as set forth on Exhibit F attached hereto and made a part hereof) on business days at Landlord’s expense provided that the same are kept in order by Tenant; and (f) electric service pursuant to the terms and conditions of Article XV. All contractors and service personnel utilized by Landlord and its representatives shall be properly licensed, bonded, insured and have background checks, if applicable or required by state law.
30.2. At all other times not otherwise provided for in Section 30.1 above, Landlord hereby agrees that it shall, upon not less than twenty-four hours’ prior written request from Tenant gives Landlord notice by 1:00 p.m. on weekdays for which may be via electronic mail with confirmation of receipt, provide after-hours air-conditioning, ventilation or heating, as the case may be. Any additional charges will be included in their normal billing cycle for utilities for which Tenant shall pay to Landlord as additional rent hereunder, a sum equal to $100.00 per hour service for providing heat, and $100.00 per hour for providing air-conditioning (irrespective of whether any other tenants in the Building are furnished with heat or air-conditioning at the same time), such amounts being intended to cover Landlord’s cost for the power or fuel required to provide the same. In the event that during the term of this Lease, or any renewal hereof, the Landlord’s cost for providing after-hours air-conditioning, heating or ventilation shall increase by virtue of utility rate increases or unit fuel cost increases, the above-specified hourly charges shall be adjusted from time to time to reflect said increases. In addition to the foregoing, should there be any charges incurred by Landlord for additional attendant engineers or similar additional requirements as may be imposed from time to time by the State Labor Department, local authorities, union requirements, or the like related to such after-hours use by Txxxxx, Tenant hereby agrees to reimburse Landlord for its out-of-pocket expenses incurred in connection therewith. Tenant shall be responsible for the installation, maintenance and operation of any supplemental air-conditioning, ventilation or heating systems which may be required by Tenant on the next weekdayDemised Premises and for which Txxxxx has received the prior written consent of Landlord, by 1:00 p.m. the day before a holiday for service on a holiday, and by 1:00 p.m. on Friday for after-hour service on Saturday or service on Sunday. Such after-hour, holiday or special weekend service shall be charged to Tenant at rates such consent not to be calculated by Landlordunreasonably withheld, which rates shall be given to Tenant on requestconditioned or delayed.
30.3. While the current rate for such after hours HVAC is Fifty-Five Dollars ($55.00) per floor/per hour, Landlord reserves the right to stop services of the heating, elevators, plumbing, air-conditioning, power systems or cleaning or other services, if any, when necessary by reason of accident or for repairs, alterations, replacements or improvements necessary or desirable in the judgment of Landlord for as long as may be reasonably adjust, from time to time, required by reason thereof. If the rate at which such services shall be provided. Tenant shall pay for such service, as Additional Rent, within thirty (30) days of receipt of an invoice with respect thereto;
E. Automatically Building supplies manually operated elevator service, if applicable;
F. All electric bulbs and fluorescent tubes for building standard light fixtures in the Leased Premises and Common Areas;
G. Two (2) keys to the Leased Premises Landlord at no cost to Tenant, all additional keys at the cost of Tenant; and
H. An electronically any time may substitute automatic-controlled perimeter access system to the Building’s entranceelevator service. Landlord shall provide at any time may substitute automatic control elevator service and upon ten (10) days’ written notice to Tenant proceed with two (2) Building key cards at Landlord’s expense. Services Provided by Landlord. Provided Tenant is not in monetary default hereunder as set forth in Section 15.1(a) hereof, Landlord shall provide agrees to furnish Tenant the following facilities and services to Tenantservices:

D. During Building Hours, central heating and air conditioning during the seasons of the year when these services are normally and usually furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premises. Landlord shall provide the aforesaid services at other times, at Tenant’s expense, provided Tenant gives Landlord notice by 1:00 p.m. on weekdays for after-hour service on the next weekday, by 1:00 p.m. the day before a holiday for service on a holiday, and by 1:00 p.m. on Friday for after-hour service on Saturday or service on Sunday. Such after-hour, holiday or special weekend service shall be charged to Tenant at rates to be calculated by Landlord, which rates shall be given to Tenant on request. While the current rate for such after hours HVAC is Fifty-Five Dollars ($55.00) per floor/per hour, Landlord reserves the right to reasonably adjustmay, from time to time, be considered standard by Landlord. Such service other than during customary business hours, on Sundays and Holidays will be furnished only upon at least 24 hours advance notice, and Tenant shall bear the rate at entire cost thereof, which such cost shall not exceed Landlord's actual expenses and reasonable overhead expenses incurred in connection with providing such service.
(c) Elevator service in common with other tenants of the Building for access to and from the Leased Premises, provided that Landlord may reasonably limit the number of elevators to be in operation after customary business hours and on Sundays and Holidays.
(d) Janitorial services considered standard by Landlord. Landlord agrees that the janitorial company providing such janitorial services shall be provided. bonded and Landlord shall submit evidence thereof to Tenant shall pay upon Tenant's request.
(e) Electric current during customary business hours at a voltage and level as specifically set forth in the plans and specifications for Tenant's leasehold improvements that are approved by Landlord in writing pursuant to Section 12.2 hereof ("Approved Plans").
(f) Replacement of bulbs in Building Standard and other light fixtures, provided that Landlord's standard charge for such service, as Additional Rent, within thirty (30) days of receipt of an invoice with respect thereto;
E. Automatically operated elevator service, if applicable;
F. All electric bulbs and fluorescent tubes for building standard light fixtures replaced in the Leased Premises and Common Areas;
G. Two (2) keys to the Leased Premises at no cost to Tenant, all additional keys at the cost of Tenant; and
H. An electronically controlled perimeter access system to the Building’s entrance. Landlord shall provide Tenant with two (2) Building key cards at Landlord’s expense. Any additional or replacement cards shall be at Tenant’s expense. Individual security systems shall be installed paid by Tenant at Tenant’s costto Landlord on demand.

Services Provided by Landlord. 5.1. Subject to the terms of this Lease, Landlord shall provide the following facilities and services agrees to furnish to Tenant:
A. Electricity 5.1.1. Rest room facilities and necessary lavatory supplies, including hot and cold running water at the points of supply, as provided for the general use of all tenants comparable class buildings in the BuildingWestchase submarket, and routine maintenanceLandlord will commence air conditioning and heating services in a timely manner to achieve the standard temperatures during the required times; provided, paintinghowever, Tenant herein agrees to monitor its Saturday morning usage and electric lighting service for to the extend Tenant finds that Tenant is not occupying the Leased Premises most Saturday mornings, Tenant shall notify Landlord and both shall work together to arrange all Common Areas or a portion of the Leased Premises with air conditioning and heating services during normal business hours of the Building on Saturdays 10 be provided upon written request of Tenant made in accordance with the rules and regulations for the Building. Landlord will provide service on Saturday afternoons, Sundays, and Holidays (defined below), only upon written request of Tenant (at least 24 hours in advance), who shall bear the cost thereof (as reasonably determined by Landlord which is currently billed at $25.00 per hour per floor). Holidays recognized are New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, and Christmas Day. In the event that any Holiday shall be observed on a day other than the actual day on which such manner as Landlord deems reasonable;Holiday occurs, then the day which such Holiday is observed shall constitute the Holiday under this Lease.
D. During Building Hours, central heating and air conditioning during 5.1.2. Water at those points of general supply provided on the seasons of floor on which the year when these services Leased Premises are normally and usually furnished based upon standard electrical energy requirements of not more than an average of located.
5.1.3. Janitor service on a five (5) xxxxx day week basis at a level of quality comparable to comparable class office buildings in the Westchase submarket (excluding the Storage Space) in accordance with Exhibit “J” attached hereto and made a part hereof; provided however, if Landlord notifies Tenant at the time of Landlord’s approval of the Final Plans that Tenant’s floor covering or other improvements in the Leased Premises requires a level of cleaning in excess of that provided in comparable class office buildings in the Westchase submarket, Tenant shall pay any additional cleaning costs attributable thereto as Additional Rent hereunder.
5.1.4. Building standard fluorescent bulb and ballast replacement in all areas and all incandescent bulb replacement in public areas, restrooms, parking areas and stairwells, including replacement of burned out, broken, or otherwise non-functioning bulbs.
5.1.5. Electrical facilities to furnish sufficient power for personal computers and other machines of similar low electrical consumption, including electricity required for duplicating equipment; but not including special lighting in excess of Building standard, or any other item of electrical equipment, the electrical power requirement of which singly consumes more than 0.25 kilowatts per square foot hour at rated capacity or requires a voltage other than 120 volts single phase; and provided further that if any installation of said electrical equipment requires additional air conditioning capacity above that provided by the Building’s standard system, then the additional air conditioning installation and operating costs shall be the sole obligation of Tenant. Tenant shall pay to Landlord, as Additional Rent and billed monthly such charges as may be separately metered (the cost of any such meter and its installation to be borne by Tenant) or as Landlord’s engineer may compute fur any electrical service in excess of that stated above.
5.1.6. Tenant shall pay Additional Rent provided for in this Subarticle 5.1 not later than ten (10) days after presentation of a descriptive invoice therefor by Landlord, and Tenant’s failure to timely pay such amount shall subject Tenant to default provisions and late payment charges under this Lease.
5.2. Failure by Landlord to furnish these defined services, or any cessation or interruption thereof, shall not render Landlord liable in any respect for damages to either persons or property, unless caused by the negligence or willful misconduct of Landlord; its agents, employees or contractors. Should any of the equipment or machinery break down, or for any cause cease to function properly, Landlord shall use reasonable diligence to restore such service.
5.2.1. Notwithstanding the provisions of Article 5.2 and excluding the Storage Space, in the event Landlord fails to provide any of the services described herein (through no fault of Tenant, Tenant’s agents, representatives, successors, assigns, shareholders, employees, contractors, directors or officers), and such failure (i) is the result of conditions within Landlord’s control, (ii) renders the Leased Premises untenantable (i.e., Tenant cannot reasonably conduct its business therein), and (iii) continues for more than five (5) consecutive business days after written notice from Tenant, then the Tenant’s sole and exclusive remedy shall be to have all rent abated proportionately as to that portion of the Leased Premises rendered untenantable for permitted use under the Lease until such services are restored or the Leased Premises are otherwise rendered tenantable again. Notwithstanding any provisions to the contrary elsewhere in the Lease, if such services are not restored to the entire Leased Premises after twenty (20) consecutive days, for any reason whatsoever excepting those items covered by Article 12 of this Lease, Tenant shall have the right to terminate this Lease as Tenant’s sole and exclusive remedy upon written notice to Landlord at any time after the twenty (20) day period but prior to the restoration of service (but not thereafter). The term “untenantable” as used herein shall mean that, as a human occupancy result of not the continuous (for the periods set out hereinabove) failure or interruption of such utility services; Tenant is unable to use the Leased Premises for the purpose for which it was intended.
5.3. Should Tenant desire any additional services beyond those described in Subarticle 5.1 above, or desire rendition of such services outside the normal limes such services are provided by Landlord, then Landlord may (at Landlord’s option), upon reasonable advance notice from Tenant to Landlord, furnish such services and Tenant agrees to pay Landlord such charges as may be agreed upon between Landlord and Tenant, but in no event at a charge more than Landlord’s actual cost, plus five percent (5%) thereof as overhead for the additional services; provided, it being agreed that the cost to Landlord of such additional services shall be excluded from the “Basic Cost” as that lerm is defined in Article 8 of this Lease.
5.4. Landlord shall furnish Tenant, at Landlord’s cost, up to one person hundred eighty (180) 24-hour access cards and up to one hundred eighty (180) keys (whichever is applicable) for each 150 square feet of rentable area of corridor door entering the Leased Premises. Access cards shall be coded as to allow elevator access as directed by Tenant to the Leased Premises. Additional keys will be furnished at a charge of $5.00 each and additional 24-hour access cards shall be furnished at a cost of $15.00 each. Request for additional keys or access cards shall be on a written order signed by Tenant or Tenant’s duly authorized representative. All keys/cards shall remain the property of Landlord. Replacement of lost, stolen, or broken access cards will be at a cost of $15.00 per card. Except for Excluded Areas as provided in the Final Plans, no additional locks shall be allowed on any door of the Leased Premises without the express written permission of Landlord first received, and Tenant shall not make or permit to be made any duplicated keys. Upon termination of this Lease, Tenant shall deliver to Landlord all keys/cards to the Leased Premises and shall give to Landlord a full explanation of any combinations for all locks for safes, and vault doors, if any, in the Leased Premises. Failure to return cards will result in a debit from the security deposit to cover the lost items.
5.5. Landlord, at Landlord’s cost, shall provide and install the aforesaid services at other timesinitial door signage for the entry door to the Leased Premises; all such letters and numerals shall be in Building’s standard graphics, provided, however, at Tenant’s expensecost, provided Tenant gives Landlord notice by 1:00 p.m. on weekdays may design and install upgraded signage in the Leased Premises with Landlord’s prior reasonable approval. Landlord, at Landlord’s cost, shall also provide and install the initial listing for after-hour service Tenant’s business on the next weekday, by 1:00 p.m. Building directory board.
5.6. All installations now or hereafter placed on the day before a holiday for service on a holiday, and by 1:00 p.m. on Friday for after-hour service on Saturday or service on Sunday. Such after-hour, holiday or special weekend service Leased Premises in excess of the Buildout Allowance (as defined in Exhibit “C”) shall be charged to for Tenant’s account and at Tenant’s cost (and Tenant at rates to be calculated by Landlordshall pay all ad valorem taxes and increases in insurance thereon), which rates costs shall be given payable by Tenant to Landlord as Additional Rent hereunder promptly on being invoiced therefor; provided, however, Tenant on request. While the current rate for such after hours HVAC is Fifty-Five Dollars ($55.00) per floor/per hour, Landlord reserves shall have the right to reasonably adjust, from time to time, review the rate at which such services shall be provided. Tenant shall pay supporting data for such service, as Additional Rent, invoices. Failure by Tenant to pay such invoice in full within thirty (30) days of after receipt of a statement therefor shall constitute an invoice with respect thereto;
E. Automatically operated elevator service, if applicable;
F. All electric bulbs and fluorescent tubes for building standard light fixtures in the Leased Premises and Common Areas;
G. Two (2) keys to the Leased Premises at no cost to Tenant, all additional keys at the cost Event of Tenant; and
H. An electronically controlled perimeter access system to the Building’s entrance. Landlord shall provide Tenant with two (2) Building key cards at Landlord’s expense. Any additional or replacement cards shall be at Tenant’s expense. Electricity supplied to the Leased Premises shall be not less than six (6) xxxxx per usable square foot of ordinary office equipment, subject to Section 7.03, belowthe Leased Premises (exclusive of the HVAC Service);
B. Normal Janitorial service and usual cleaning trash removal services in the Leased Premises and char services the Common Areas after Building Hours each day except on Saturdays, Sundays and legal holidays recognized by Holidays, in accordance with the United States Governmentcleaning specifications attached hereto as Exhibit G;
C. Rest Common Area rest room facilities and necessary lavatory supplies, including hot and cold running water at the points of supplysupply in such rest room facilities, cold water for ordinary premises, cleaning, toilet, lavatory and drinking purposes, as provided for the general use of all tenants in the BuildingBuilding at the point of supply, and routine maintenance, painting, and electric lighting service for all Common Areas of the Building in such manner as Landlord deems reasonable;. After Landlord’s initial installation of hot water heaters to supply hot water to the Premises as part of the Tenant Work, Tenant shall be responsible for heating and distributing any hot water within the Leased Premises, and any repairs, maintenance and replacement of the hot water heaters serving the Premises. If Tenant requires water for any additional purposes, Tenant shall pay for the cost of bringing water to, and redistributing water within, the Leased Premises, and Landlord may install a meter to measure the water. Tenant shall pay the cost of such installation, and for all maintenance, repairs and replacements thereto, and for the reasonable charges of Landlord for the water consumed.
D. During Building HoursCentral heating, central heating ventilation and air conditioning (“HVAC Service”) during the seasons of the year when these services are normally and usually furnished based upon standard electrical energy requirements of not more than an average of five six (56) xxxxx per square foot of the Leased Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased PremisesPremises (other than in special use areas) for all purposes, in accordance with the specifications set forth on Exhibit H attached hereto. Landlord The HVAC Service shall include the provision of chilled and/or condenser water to the extent necessary to provide the aforesaid services at other times, at Tenant’s expense, provided Tenant gives Landlord notice by 1:00 p.m. on weekdays HVAC Service. E. Automatically operated passenger elevator service. Landlord shall have the right to remove elevators from service as the same shall be required for moving freight, if applicable;or for servicing or maintaining the elevators and/or the Building; provided, however, that, except in the event of a Force Majeure or due to emergencies, at least three (3) passenger elevators will remain in service during Business Hours and at least one (1) passenger elevator will remain in service at all other times.
F. All electric bulbs and fluorescent tubes for building standard light fixtures in the Leased Premises and Common Areas;
G. Two (2) keys to the Leased Premises at no cost to Tenant, all additional keys at the cost of Tenant; and
H. An electronically controlled perimeter access system to the Building’s entrance, and other security services as Landlord shall determine from time to time. Landlord’s current security specifications are attached hereto as Exhibit E. Landlord shall provide Tenant with two (2) Building key cards at Landlordfor each of Tenant’s expenseemployees working in the Leased Premises from time to time. Any additional or replacement cards shall be at Tenant’s expense; and
H. Loading dock services and vertical transportation for freight to the Leased Premises.
I. So long as Tenant shall comply with Landlord’s reasonable security program for the Building, Landlord shall provide Tenant with, and Tenant shall have, access to the Leased Premises twenty-four (24) hours per day, seven (7) days per week, during the Term of this Lease, except in an emergency.
J. Tenant may elect, at its sole cost and expense, to install supplementary or auxiliary HVAC equipment to serve the Leased Premises, subject to Landlord's prior consent in each instance. Individual security systems The work to install any supplementary or auxiliary HVAC equipment shall be installed by considered to be a Tenant at Alteration for all purposes under this Lease and Tenant shall comply with all terms and conditions of this Lease in connection therewith. Services Provided by Landlord. The janitorial services furnished to the Premises will include cleaning, trash removal, necessary dusting and vacuuming, maintaining towels, tissue and other restroom supplies and such other work as is customarily performed in connection with nightly janitorial services in other Class A office facilities in the vicinity of the Building, as generally described on Exhibit F attached hereto and services made a part hereof.
(b) All electric lighting bulbs and tubes and all ballasts and starters within the Premises will be replaced by Landlord at the reasonable expense of Tenant and will be paid by Tenant upon receipt of invoice from Landlord as Rent.
(c) Heat, ventilating and air conditioning from 8:00 a.m. to Tenant:
A. Electricity for normal lighting purposes 6:00 p.m., Monday through Friday (other than Holidays), and the operation of ordinary office equipmentfrom 8:00 a.m. to 1:00 p.m. on Saturdays (other than Holidays), as generally described in Exhibit G attached hereto and made a part hereof, subject to Section 7.03matters beyond Landlord’s reasonable control. During other hours and days, below;Landlord will provide such additional amounts of heating, ventilating and air conditioning upon a reasonable advance notice from Tenant to Landlord, which advance notice will not be later than 12:00 noon on the day on which such additional service is requested (or 12:00 noon on the business day before a Saturday, Sunday or Holiday). Tenant, upon presentation of a xxxx therefor, will pay Landlord for such service on an hourly basis at a rate of $85.00 per hour, which charges may be increased if energy costs increase (provided that such increases shall not exceed the actual cost incurred by Landlord therefor). If such extended service is not a continuation of that furnished during regular business hours as described above, Tenant will pay for a minimum of three (3) hours of such service.
B. Normal (d) Hot and usual cleaning cold water from the regular building outlets for lavatory and char services after Building Hours each day except drinking purposes.
(e) Passenger elevator service in common with other tenants to be provided by three (3) automatic elevators, one of which is a “swing” elevator for use also as a freight elevator. Landlord will have the right to restrict the use of elevators for freight purposes to the “swing” freight elevator and to hours to be reasonably determined by Landlord. Landlord will have the right to reasonably limit the number of elevators to be in operation on Saturdays, Sundays and legal holidays recognized Holidays. Subject to any actual delay that is caused or contributed to by act or omission of Tenant, or those acting for or under Tenant, or by a labor dispute, casualty, act of God or the United States Government;public enemy, governmental embargo restriction, shortage of fuel, labor, or building materials, action or non-action of public utilities, or of local, state or federal governments affecting the work, or other causes beyond Landlord’s reasonable control (an “Excused Delay”), at least one (1) such passenger elevator will be available at all times during the Term.
C. Rest room facilities (f) Maintenance in good order, condition and repair of the Parking Area and all driveways leading thereto and keeping the same free from any unreasonable accumulation of snow. Landlord will keep and maintain the landscaped exterior areas in the vicinity of the Building and the Parking Area in a neat and orderly condition (and in the case of the Parking Area, in a reasonably well-lit condition). Landlord will also maintain in good, clean order, condition and repair, and will perform and make all reasonably necessary lavatory suppliesmaintenance, repairs and replacements to, (i) the roof, (ii) all of the structural components (including hot the foundation and cold exterior walls), (iii) the elevators, (iv) all other common areas and building systems (including plumbing, electrical and HVAC systems), equipment and conduits of the Building (including within and running water at through the points of supplyPremises), as provided except any such building system, equipment or conduit that is installed in the Premises by Tenant, and (v) the Common Area, the Parking Area and all driveways, sidewalks and landscaping within the Office Complex.
(g) Subject to the Rules and Regulations and other reasonable security restrictions, and except for the general use of all tenants in matters beyond Landlord’s reasonable control, access to the Building, the Parking Area and routine maintenance, painting, and electric lighting service for all Common Areas of the Building in such manner as Landlord deems reasonable;
D. During Building Hours, central heating and air conditioning during the seasons of the year when these services are normally and usually furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premises. Landlord shall provide the aforesaid services at other times, at Tenant’s expense, provided Tenant gives Landlord notice by 1:00 p.m. on weekdays for after-hour service on the next weekday, by 1:00 p.m. the day before a holiday for service on a holiday24 hours per day, 7 days per week and by 1:00 p.m. on Friday for after-hour service on Saturday or service on Sunday. Such after-hour, holiday or special weekend service shall be charged to 365 days per year basis.
(h) Tenant at rates to be calculated by Landlord, which rates shall be given to Tenant on request. While the current rate for such after hours HVAC is Fifty-Five Dollars ($55.00) per floor/per hour, Landlord reserves will have the right to reasonably adjustaccess any previously-installed Base Building communications systems, subject to Landlord’s prior reasonable written approval from time to time, the rate at which such services shall be provided. Tenant shall pay for such serviceand also subject to Tenant’s payment of any prevailing charges therefor, as Additional Rentreasonably established by Landlord from time to time. In addition, within thirty (30) days subject to this Section 5.1(h), Tenant will have the right to install, maintain and operate on the roof of receipt the Building, and will have the obligation to remove at the end of an invoice with respect thereto;
E. Automatically operated elevator servicethe Term, if applicable;
F. All electric bulbs all at Tenant’s sole cost, expense and fluorescent tubes risk, a satellite or microwave “dish” for building standard light fixtures transmission and reception purposes and other equipment/infrastructure supporting Tenant’s operation in the Leased Premises (collectively, “Tenant’s Roof Equipment”), all of which Tenant’s Roof Equipment will conform with specifications that Tenant will deliver to Landlord prior to any such installation, maintenance and Common Areas;
G. Two operation, and which will be subject to Landlord’s prior reasonable written approval. The installation and maintenance of any such Tenant’s Roof Equipment will comply with any and all applicable laws. Further, (2i) keys the location thereof will be as Landlord may designate; (ii) any structural support therefor that Landlord may reasonably determine is required in addition to the Leased Premises at no cost to Tenantstructural support contemplated in connection with the construction of the Base Building, all additional keys will be at the sole cost and expense of Tenant; and(iii) the installation, maintenance and operation of any such Tenant’s Roof Equipment will not, among other things, xxxxxx the roof or roof membrane or otherwise cause any damage to the roof or structural support of the Building, or interfere with the operation of the Building’s systems; (iv) Tenant will be solely responsible for obtaining and maintaining reasonable property and liability insurance in connection with any such Tenant’s Roof Equipment; and (v) Tenant will be solely responsible for all costs and expenses relating to the removal of any such Tenant’s Roof Equipment at the expiration of the Term (including, without limitation, any and all patching or restoration work required in order to return the roof or structural support of the Building to substantially the condition thereof prior to the installation of any such Tenant’s Roof Equipment). Landlord will provide Tenant with access to and through the Building’s telecommunications room(s) and shaft, riser and conduit space leading to such telecommunications room(s) to the Premises and from the Premises to the roof of the Building, in each case, which is reasonably sufficient in connection with Tenant’s operation of Tenant’s Roof Equipment.
H. An electronically controlled perimeter (i) Tenant shall have the right to install, maintain and operate a security system in the Premises (“Tenant’s Security System”), which security system may incorporate key card access. Landlord shall reasonably cooperate with Tenant to ensure that the keyless entry components of Tenant’s Security System are compatible with the keyless entry system for the Building. Tenant’s Security System shall at all times be maintained, repaired and replaced as needed by Tenant, at Tenant’s sole cost and expense. Landlord’s prior reasonable consent shall be required to the installation of Tenant’s Security System to the extent that any portion thereof adversely affects the structural, mechanical, electrical, plumbing, fire/life safety or heating, ventilating and air conditioning systems of the Building. Landlord shall have no liability for any failure or other breach of Tenant’s Security System. Tenant’s Security System shall (i) not interfere with Landlord’s ability to access system the Premises as and when necessary in order for Landlord to fulfill Landlord’s obligations under this Lease (it being agreed that Tenant shall supply Landlord with security cards or other means of accessing the Premises) and (ii) at all times comply with any and all applicable laws. If requested by Landlord, Tenant will remove Tenant’s Security System from the Building upon the expiration or sooner termination of this Lease, and Tenant, at Tenant’s sole cost and expense, will repair any damage to the Building resulting from such removal.
(j) A proximity card access system; provided, however, that Landlord will not be liable for any lack of security in respect to the Office Complex whatsoever.
(k) Fiber optics to the Building’s entrance. Landlord shall provide Tenant with two (2) Building key cards at Landlord’s expense. Any additional or replacement cards shall be at “NET POP” on the first Floor and available for Tenant’s distribution (at its sole cost and expense. Individual security systems shall be installed by Tenant at Tenant’s cost) to the Premises.
(l) Window washing for the exterior windows of the Building.
(m) Pest control for the Building.

Services Provided by Landlord. Provided that Tenant is not in default hereunder, Landlord agrees to furnish or cause to be furnished to the Premises, the utilities and services described below, subject to the Rules and Regulations for the Project and conditions and standards set forth below (subject to the last sentence of this Section 6.1):
(a) Landlord shall furnish to the Premises, subject to interruptions beyond Landlord's control, electric current as required by standard office lighting and receptacles up to 6.5 xxxxx per square foot, net of HVAC load. At all times, Tenant's use of electric current shall never exceed the capacity of the feeders to the premises or the risers or wiring installation. Tenant shall not install or use or permit the installation or use of any computer or electronic data processing equipment except personal computers, network servers, telecommunication equipment and other associated equipment necessary to conduct Tenant's business in the Premises without the prior written consent of Landlord which shall not be unreasonably withheld, conditioned or delayed.
(b) Landlord shall furnish water only for drinking, lavatory, wastewater and kitchen purposes.
(c) Landlord shall provide the following facilities and reasonable janitorial services to Tenant:
A. Electricity for normal lighting purposes and the operation of ordinary office equipment, subject Premises up to Section 7.03, below;
B. Normal and usual cleaning and char services after Building Hours each day six (6) days per week except on SaturdaysProject holidays, Sundays provided that Tenant shall maintain the offices in a manner consistent with Class A office space in North Central Austin. Said services shall be performed by persons approved by Landlord and legal holidays recognized Tenant and no one other than persons approved by Landlord and Tenant shall be permitted to enter the United States Government;
C. Rest room facilities and necessary lavatory supplies, including hot and cold running water at the points of supply, as provided Premises for the general use of all tenants in the Building, and routine maintenance, painting, and electric lighting service for all Common Areas of the Building in such manner as Landlord deems reasonable;
D. During Building Hours, central heating and air conditioning during the seasons of the year when these services are normally and usually furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premisespurposes. Landlord shall provide the aforesaid management of services at other timesincluding trash removal, at Tenant’s expensestriping, provided maintenance of drainage features, landscaping, roof, hvac systems, janitorial and fire sprinkler systems. Tenant gives and Landlord notice by 1:00 p.m. on weekdays shall mutually approve selection of vendors for after-hour service on services for which Tenant is responsible for payment as part of Direct Expenses,. All expenses associated with such utilities for the next weekday, by 1:00 p.m. the day before a holiday for service on a holiday, Project outlined in paragraphs (a) and by 1:00 p.m. on Friday for after-hour service on Saturday or service on Sunday. Such after-hour, holiday or special weekend service (b) above shall be the responsibility of Tenant and paid directly by Tenant to the utility providers. Any such services and utilities not paid by Tenant directly shall be included in as part of the Direct Expenses charged to Tenant at rates to be calculated by Landlord, which rates shall be given to Tenant on request. While the current rate for such after hours HVAC is Fifty-Five Dollars ($55.00) per floor/per hour, Landlord reserves the right to reasonably adjust, from time to time, the rate at which such services shall be provided. Tenant shall pay for such service, as Additional Rent, within thirty (30) days of receipt of an invoice with respect thereto;
E. Automatically operated elevator service, if applicable;
F. All electric bulbs and fluorescent tubes for building standard light fixtures in the Leased Premises and Common Areas;
G. Two (2) keys to the Leased Premises at no cost to Tenant, all additional keys at the cost of Tenant; and
H. An electronically controlled perimeter access system to the Building’s entrance. Landlord shall provide Tenant with two (2) Building key cards at Landlord’s expense. Any additional or replacement cards shall be at Tenant’s expense. Individual security systems shall be installed by Tenant at Tenant’s costhereunder.

Services Provided by Landlord. Landlord shall provide:
a) Heating, ventilation and air conditioning (hereinafter called "HVAC") to the Demised Premises during Building Hours, as appropriate for the season, and lighting and electric energy for the Common Office Facilities as in Landlord's sole judgment is necessary or desirable to insure proper operation of the Office Building. As used in this Lease the "Building Hours" shall be Monday through Friday, 8:00 a.m. to 7:00 p.m., and Saturday from 9:00 a.m. to 2:00 p.m., excluding Sunday and those holidays set forth as follows: New Year's Day, President's Day, memorial Day, July 4th, Labor Day, Thanksgiving Day, and Christmas Day. Landlord shall furnish HVAC for usual Office Building requirements as set forth above. At additional cost to Tenant, based upon a charge of Sixty and 00/100 ($60.00) Dollars per hour of any part thereof, as such charge may be adjusted by Landlord from time to time upon written notice thereof to Tenant, Landlord shall provide HVAC to the following facilities and services to Tenant:
A. Electricity for normal lighting purposes and the operation of ordinary office equipment, subject to Section 7.03, below;
B. Normal and usual cleaning and char services after Building Hours each day except on Saturdays, Sundays and legal holidays recognized by the United States Government;
C. During Building Hours, central heating and air conditioning during the seasons of the year when these services are normally and usually furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Demised Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premises. Landlord shall provide the aforesaid services at other times, at Tenant’s expenseprovided that, provided with respect to any such additional service, a) Tenant gives shall notify Landlord notice by 1:00 p.m. on weekdays and request the same twenty-four (24) hours in advance and b) if another tenant or tenants in the Office Building request such additional service for after-hour service the same period of time and same HVAC units which serve the Demised Premises also serve such tenant's premises, then the additional cost will be shared between Tenant and such tenant or tenant's based on the next weekdayfloor area of the Demised Premises compared to the floor area of the premises leased by such other tenant or tenant's. By way of example and not limitation, by 1:00 assume that Tenant requests HVAC service Saturday morning from 9:00 a.m. to 12:00 p.m. and another tenant in the Office Building who leased 14,735 square feet and whose HVAC is provided through the same HVAC unit which also supplies the Demised Premises and such other tenant also requests such HVAC service for the same day before a holiday and time, then the cost for such HVAC service on a holiday, and by 1:00 p.m. on Friday for after-hour service on Saturday or service on Sunday. Such after-hour, holiday or special weekend service shall be charged to Tenant at rates to be calculated by Landlord, which rates shall be given to Tenant on request. While the current rate for such after Saturday would be Forty and 30/100, calculated as follows: 3 hours HVAC is Fifty-Five Dollars (x $55.0060 = $180.00 x [4252 sq. ft./4252 sq. ft. + 14,735 sq. ft.] = $40.30
b) per floor/per hourRunning fresh hot and cold water for adequate Tenant purposes.
c) Cleaning services as set forth on Exhibit "B" annexed hereto and made a part hereof, Landlord reserves subject however to the right to reasonably adjustconditions therein stated. Except as provided for on Exhibit "B", from time to time, the rate at which such services shall be provided. Tenant shall pay for such servicethe costs of all other cleaning services required by Tenant.
d) Removal of ice and snow from the walks, as Additional Rentdrives, within thirty parking areas (30and access ways thereto), curbs and other exterior Common Office Facilities.

Services Provided by Landlord. (a) Landlord shall provide the following provide, (i) necessary passenger elevator facilities on business days from 8:00 a.m. to 6:00 p.m. and services on Saturdays from 8:00 a.m. to Tenant:
A. Electricity for normal lighting purposes 1:00 p.m. and the operation of ordinary office equipment, have one elevator subject to Section 7.03call at all other times and a freight elevator on business days from 8:00 a.m. to 6:00 p.m. on a non-exclusive first come first served basis; ( ii) heat to the Premises when and as required by law, below;
B. Normal on business days from 8:00 a.m. to 6:00 p.m. and usual cleaning (iii) hot and char cold water for ordinary lavatory and office pantry purposes, but if Tenant uses or consumes water for any other purposes or in unusual quantities (of which fact Landlord shall be the sole judge), Landlord may install a water meter at Tenant’s expense which Tenant shall thereafter maintain at Tenant’s expense in good working order and repair to register such water consumption and Tenant shall pay for water consumed as shown on said meter as additional rent as and when bills are rendered. Tenant acknowledges and agrees that, as of the date hereof, the minimum charge for additional services after Building Hours each day except (including, without limitation, freight elevator and air conditioning) is four (4) hours for non business hours and on Saturdays, Sundays and legal holidays recognized by and Landlord shall not provide heat on the United States Government;
C. Rest room facilities and necessary lavatory suppliesweekend. Provided Tenant shall keep the Premises in order, including hot and cold running water Landlord, at Landlord’s expense, shall cause the points Premises to be cleaned, exclusive of supply, as provided any portions of the Premises used for the general use storage, preparation, service or consumption of all tenants food or beverage or otherwise requiring cleaning services in the Building, and routine maintenance, painting, and electric lighting service for all Common Areas excess of the Building in such manner as Landlord deems reasonable;
D. During Building Hours, central heating and air conditioning during the seasons of the year when these services are normally and usually those generally furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premisesto professional office areas. Landlord shall provide the aforesaid services at other timesTenant, at Tenant’s expense, provided Tenant gives Landlord notice by 1:00 p.m. on weekdays shall cause all portions of the Premises used for after-hour the storage, preparation, service on the next weekday, by 1:00 p.m. the day before or consumption of food or beverages to be cleaned daily in a holiday for service on a holidaymanner reasonably satisfactory to Landlord, and to be exterminated against infestation by 1:00 p.m. on Friday for after-hour service on Saturday vermin, rodents or service on Sunday. Such after-hourroaches regularly and, holiday or special weekend service in addition, whenever there shall be charged evidence of any infestation. Tenant shall not permit any person to enter the Premises or the Building for the purpose of providing cleaning or extermination services, other than persons first approved by Landlord. Tenant hereby acknowledges that any cleaning contractor used for the Premises must be a union contractor. Any additional cleaning of the Premises done by Tenant shall be performed in a manner reasonably satisfactory to Landlord. Landlord and its cleaning contractor and their employees shall have access to the Premises at all times, other than Building Hours (i.e., 8:00 a.m. to 5:00 p.m.). Landlord and its cleaning contractor and their employees shall have the use of Tenant’s light, power and water in the Premises, without charge therefor, as may be reasonably required for the purpose of cleaning the Premises. Tenant shall pay to Landlord the cost of removal of any of Tenant’s refuse and rubbish from the Premises and the Building to the extent that the same exceeds the refuse and rubbish normally accumulated in the daily routine of ordinary business office occupancy. Bills for the same shall be rendered by Landlord to Tenant at rates to be calculated by Landlord, which rates such time as Landlord may elect and shall be given due and payable within five (5) days of rendition as additional rent.
(b) Landlord shall provide Tenant with up to fifteen (15) hours, on an after hour basis, of free exclusive use of the freight elevator during its initial move into the Premises. Tenant on request. While the current rate for shall be required to schedule such after hours HVAC is Fifty-Five Dollars freight elevator use with Landlord.
($55.00c) per floor/per hour, Landlord reserves the right to reasonably adjuststop, from time interrupt, curtail or suspend the services furnished by Landlord to timeTenant under this Lease when necessary by reason of accident, emergency, mechanical breakdown, or when required by any law, order or regulation of any federal, state, county or municipal authority, or for any other cause beyond the rate at which such services shall be provided. Tenant shall pay for such service, as Additional Rent, within thirty (30) days reasonable control of receipt of an invoice with respect thereto;
E. Automatically operated elevator service, if applicable;
F. All electric bulbs and fluorescent tubes for building standard light fixtures in the Leased Premises and Common Areas;
G. Two (2) keys to the Leased Premises at no cost to Tenant, all additional keys at the cost of Tenant; and
H. An electronically controlled perimeter access system to the Building’s entranceLandlord. Landlord shall provide Tenant with two (2) Building key cards at Landlorduse due diligence to complete all required repairs or other necessary work as quickly as reasonably possible so that Tenant’s expense. Any additional or replacement cards inconvenience resulting therefrom may be for as short a period of time as circumstances will permit, except that nothing shall be at Tenant’s expenseconstrued so as to require Landlord to employ overtime help. Individual security systems No diminution or abatement of rent or additional rent or other compensation or claim of constructive eviction shall or will be installed claimed by Tenant at Tenant’s costas a result thereof, nor shall this Lease or any of the obligations of Tenant be affected or reduced by reason of such stoppage, interruption, curtailment or suspension.

Services Provided by Landlord. Landlord shall provide Subject to the following facilities provisions of Section 8.3 below, Landlord, without charge, except as provided herein, and services in accordance with standards from time to Tenanttime prevailing for the Building, agrees to:

(c) furnish, during Normal Business Hours, such heated or cooled air to the Premises as may, in the Buildinggood faith judgment of Landlord, be reasonably required for the comfortable use and routine maintenanceoccupancy of the Premises, paintingprovided that the reasonable recommendations of Landlord’s engineer regarding occupancy and use of the Premises are complied with by Tenant and, with respect to cooled air, provided the same is used only for standard office use;
(d) list on existing lobby and electric Leased Premises floor directories in the Common Areas. Tenant’s name and suite number;
(e) furnish janitorial service, as contracted for by Landlord, five (5) days per week, exclusive of normal holidays; provided, however, if Tenant’s flooring, other improvements or furniture upholstery’ require special treatment, Tenant shall pay to Landlord the additional cleaning cost attributable thereto upon presentation of a statement therefor by Landlord;
(f) furnish standard building grade fluorescent bulb replacement in the Premises necessary to maintain the lighting service provided as a part of standard building improvements; provided, however. Tenant shall be responsible for all lighting bulb/tube replacement in special, non-standard fixtures and/or equipment:
(g) provide one annual exterior window washing; and
(h) keep Common Areas & exterior of the Building in such manner as Landlord deems reasonable;
D. During Building Hours, central heating and air conditioning during the seasons of the year when these services are normally and usually furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premises. Landlord shall provide the aforesaid services at other times, at Tenant’s expense, provided Tenant gives Landlord notice by 1:00 p.m. on weekdays for after-hour service on the next weekday, by 1:00 p.m. the day before a holiday for service on a holiday, and by 1:00 p.m. on Friday for after-hour service on Saturday or service on Sunday. Such after-hour, holiday or special weekend service shall be charged to Tenant at rates to be calculated by Landlord, which rates shall be given to Tenant on request. While the current rate for such after hours HVAC is Fifty-Five Dollars ($55.00) per floor/per hour, Landlord reserves the right to reasonably adjust, from time to time, the rate at which such services shall be provided. Tenant shall pay for such service, as Additional Rent, within thirty (30) days of receipt of an invoice with respect thereto;
E. Automatically operated elevator service, if applicable;
F. All electric bulbs and fluorescent tubes for building standard light fixtures in the Leased Premises and Common Areas;
G. Two (2) keys to the Leased Premises at no cost to Tenant, all additional keys at the cost of Tenant; and
H. An electronically controlled perimeter access system to the Building’s entrance. Landlord shall provide Tenant with two (2) Building key cards at Landlord’s expense. Any additional or replacement cards shall be at Tenant’s expense. Individual security systems shall be installed by Tenant at Tenant’s costneat & orderly condition.

Services Provided by Landlord. Subject to such temporary interruptions thereof as are consistent with what could normally be expected from a well-managed building, Landlord shall agrees to provide the following facilities and general services to Tenantin connection with this Lease:
A. Electricity for normal lighting purposes To maintain in the Building and the Premises reasonable temperature in accordance with good standards applicable to normal occupancy of premises for office purposes subject to governmental regulations during the hours set forth in Exhibit B; provided, however, Landlord shall have no responsibility for failure thereof if the electrical power consumed on the Premises exceeds reasonable amounts as determined by Landlord, if Tenant installs partitions or other installations in locations which interfere with the proper operation of ordinary office equipment, subject to Section 7.03, belowthe Building systems or if the window covering on exterior windows is not kept fully closed;

Normal To provide daily janitorial services to the Premises and usual cleaning and char services after Building Hours each day except on Common Areas (Saturdays, Sundays and legal holidays recognized by excepted) in accordance with the United States Government;standards of similar office buildings; and
C. Rest room facilities To provide elevator service to each floor upon which the Premises are located provided such service is installed in the Building and necessary lavatory supplies, including hot provided that Landlord may prescribe the hours during which and cold running water at the points procedures under which freight elevator service shall be available and may limit the number of supply, as elevators providing service outside normal business hours. Landlord may (but shall not be obligated to) upon the request of Tenant supply services to the Premises and the Building which are not provided for the general use of all tenants in the Building, and routine maintenance, painting, and electric lighting service for all Common Areas under this Lease ("Additional Services"). Tenant shall request such services prior to 1:00 p.m. of the Building in day upon which such manner as Landlord deems reasonable;
D. During Building Hours, central heating and air conditioning during the seasons of the year when these services are normally and usually furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Premises and required or if such services are required on a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premises. All charges for Additional Services shall be provideddue and payable at the same time as the installment of Base Rent with which they are billed, or if billed separately, shall be due and payable within ten (10) days after Tenant receives Landlord's xxxx therefor. Any such xxxxxxxx for Additional Services shall include an itemization of the Additional Services rendered and the charge for each such service. If Landlord shall not supply or furnish Additional Services, only persons with prior written approval by Landlord (which approval shall not be unreasonably withheld) shall be permitted to supply or furnish Additional Services subject to the reasonable rules fixed by Landlord. G. Two (2) keys quality or quantity thereof. Notwithstanding anything to the Leased Premises at no cost contrary contained herein, and in addition to Tenantany of Landlord's remedies contained herein, all additional keys at in the cost event that Tenant is in default of Tenant; and
H. An electronically controlled perimeter access system to any of its material obligations under the Building’s entrance. (ii) common entrances, lobbies, stairways and corridors giving access to the Building and the Premises, including hot such other areas from time to time which may be provided by Landlord for common use and cold running water at enjoyment within the points of supply, Building;
(iii) the washrooms as provided for the general use of all tenants in Landlord may assign from time to time which are standard to the Building, provided that Landlord and routine maintenanceTenant acknowledge that where an entire floor is leased to Tenant or some other Tenant, paintingTenant or such other tenant, as the case may be, may exclude others from the washrooms thereon.

Services Provided by Landlord. Landlord shall provide furnish the following facilities and services to Tenantservices:

During Building Hoursgood condition as the same are in at the commencement of said term, central heating damage by fire or casualty and air conditioning during the seasons of the year when these services are normally reasonable use and usually furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premiseswear excepted. Services Provided by Landlord. So long as Tenant is not in Default under this Lease, Landlord shall provide the following facilities and services to TenantTenant as part of Operating Costs (except as otherwise provided herein), consistent with the Operating Standard:
A. Electricity Access to the Building, Parking Garage and Lot 7 Parking Garage (subject to the rights of other users after Business Hours) twenty-four (24) hours per day, seven (7) days per week subject only to closures for normal casualty or public disturbance.
B. Repair and maintenance of the Common Areas, including, without limitation, cleaning, sweeping, trash removal, resurfacing and restriping of or in the Parking Garage and Lot 7 Parking Garage and other general upkeep of the Parking Garage and Lot 7 Parking Garage;
C. Delivery of condenser water to the HVAC systems serving the Leased Premises from the condenser water distribution system serving the Project (the “Condenser Water System”) as specified in Exhibit B-1; provided, the foregoing shall not be included in Operating Costs but, instead, shall be paid by Tenant as part of the Metered Charge (as defined below).
D. Provision of electric lighting purposes service to the Parking Garage and hot and cold water to the showers provided for the use of Tenant’s personnel in the Locker Room in the Parking Garage and maintenance of the plumbing and fixtures associated therewith;
E. Maintenance of electric bulbs and other lighting elements for Building standard light fixtures in the Parking Garage;
F. Provision of security services to the Parking Garage in a manner consistent with Landlord’s provision of security services to the Commercial Portion; and
G. Provision of a twenty-four (24) passenger-capacity shuttle service between the Building and the operation Diridon CalTrain Station which shall be available for the exclusive use of ordinary office equipmentTenant’s employees and invitees free of charge, subject to Section 7.03the reasonable rules and regulations imposed by Landlord and/or the shuttle service regarding proper identification. The shuttle service shall operate on Business Days four (4) times during the morning commute hours of 6:00 a.m. and 9:00 a.m. and four (4) times during the afternoon commute hours from 3:00 p.m. to 6:00 p.m., below;

During Building Hours, central heating and air conditioning during the seasons of the year when these services are normally and usually furnished based upon standard electrical energy requirements of not more than an average of five (5) xxxxx per square foot of the Leased Premises and a human occupancy of not more than one person for each 150 square feet of rentable area of the Leased Premises. Landlord shall provide the aforesaid services at other times, at Tenant’s expense, provided Tenant gives Landlord notice by 1:00 p.m. on weekdays for after-hour service on the next weekday, by 1:00 p.m. the day before a holiday for service on a holiday, and by 1:00 p.m. on Friday for after-hour service on Saturday or service on Sunday. While Notwithstanding the current rate for such after hours HVAC is Fifty-Five Dollars ($55.00) per floor/per hourforegoing, Landlord reserves shall have the right to reasonably adjustalter, from time to time, suspend and/or terminate the rate at which such services shall be provided. Tenant shall pay for such service, as Additional Rent, within shuttle service upon not less than thirty (30) days of receipt of an invoice with respect thereto;
E. Automatically operated elevator serviceprior Notice to Tenant due to low ridership, if applicable;
F. All electric bulbs and fluorescent tubes for building standard light fixtures in the Leased Premises and Common Areas;
G. Two (2) keys to the Leased Premises at no cost to Tenant, all additional keys at the cost of Tenant; and
H. An electronically controlled perimeter access system to the Building’s entrance. Landlord shall provide Tenant with two (2) Building key cards at as reasonably determined by Landlord’s expense.
