SETTLEMENT MODEL. A properly calibrated numerical groundwater flow model that reasonably reflects the hydrogeology of an area can be an appropriate tool for calculating surface water depletions and groundwater level changes from past and proposed groundwater diversions. The State Engineer, in cooperation with the other Parties, has developed such a model for the Taos Valley. This Settlement Model, which is fully documented in Attachment 3, represents the Taos Valley Stream System and can be used to calculate the surface water depletion effects on the Rio Grande Segment, Taos Valley Tributaries, and the Buffalo Pasture that have been or will be caused by any Taos Valley groundwater diversions. It can also be used to simulate groundwater level declines associated with those groundwater diversions. The Settlement Model has been reviewed by all Parties and has been accepted by them for purposes of this Settlement Agreement.

SETTLEMENT MODEL. The Settlement Parties will cooperate in the development and finalization of a groundwater model or models for the area near and within the Rio Chama Stream System portion of the Pueblo Grant (“Settlement Model”). The Settlement Model will be capable of reasonably simulating the hydrologic effects of groundwater diversions on groundwater levels and surface water.
