Shortage of Supplies. Due to uncertainties in the supply/demand situation (which may include a decision by Chevron that the costs of some crude oil and products which might be available are unreasonable), Chevron may not have sufficient supplies of one or more of the Products to meet the full requirements of Marketer, of Chevron’s other customers, contract or otherwise, including Chevron’s affiliates, and of Chevron for its own use. Whenever that situation exists and Chevron’s performance under this agreement is not otherwise excused, Chevron may allocate deliveries of available Products on any basis which in Chevron’s sole judgment is fair and reasonable, allowing for such priorities as Chevron deems appropriate. No such reduction need be made up.

Shortage of Supplies. Due to uncertainties in the supply/demand situation (which may include a decision by ChevronTexaco that the costs of some crude oil and petroleum products which might be available are unreasonable), ChevronTexaco may not have sufficient supplies of one or more of the petroleum products covered by this agreement to meet the full requirements of Jobber, of ChevronTexaco’s other customers, contract or otherwise, including ChevronTexaco’s affiliates, and of ChevronTexaco for its own use. Whenever that situation exists and ChevronTexaco’s performance hereunder is not otherwise excused, ChevronTexaco may allocate deliveries of available products on any basis which in ChevronTexaco’s sole judgment is fair and reasonable, allowing for such priorities as ChevronTexaco deems appropriate. No such reduction need be made up.

Shortage of Supplies. 9.1. In the event that Bulk Drug is (or is anticipated to be by a Party) in short supply, Lundbeck or Myriad shall notify the other Party in writing of such circumstances, as soon as possible, including the underlying reasons for such shortage and the date such shortage is expected to end.
Shortage of Supplies. If at the port or location where delivery is to be made, supplies of Marine Fuel available to Seller or Supplying Company are curtailed, deliveries of Marine Fuels may at Seller's discretion be allocated among customers in such manner as Seller deems appropriate and Seller shall not be required to increase supplies from some other source or supply or to purchase Marine Fuels to replace the supplies so curtailed. Anything herein contained to the contrary notwithstanding, deliveries at all ports are subject to stocks being available. If it is necessary to deliver a premium grade of Marine Fuel in lieu of the product ordered, Buyer shall pay the then current price for the grade actually supplied.

  • Supplies 1. Supplies are defined as consumable items necessary to carry out the services under this Contract including medical supplies, drugs, janitorial supplies, office supplies, patient educational supplies, software, and any items of tangible personal property other than those defined as equipment above.

  • Packing 9.1 The supplier shall provide such packing of the goods as is required to prevent their damage or deterioration during transit to their final destination, as indicated in the contract. The packing shall be sufficient to withstand, without limitation, rough handling during transit and exposure to extreme temperatures, salt and precipitation during transit, and open storage. Packing, case size and weights shall take into consideration, where appropriate, the remoteness of the goods’ final destination and the absence of heavy handling facilities at all points in transit.

  • Transportation Transportation expenses include, but are not limited to, airplane, train, bus, taxi fares, rental cars, parking, mileage reimbursement, and tolls that are reasonably and necessarily incurred as a result of conducting State business. Each State agency shall determine the necessity for travel, and the mode of travel to be reimbursed.

  • Materials and Equipment ‌ Material means property that may be consumed or expended during performance, component parts of a higher assembly, or items that lose their individual identity through incorporation into an end item. Equipment means a tangible item that is functionally complete for its intended purpose, durable, nonexpendable, and needed for performance. Materials and Equipment shall be priced in accordance with the terms of the task order award, contract type, and applicable FAR and agency-specific regulatory supplements. Unless otherwise directed by task order terms and conditions, the Contractor may apply indirect costs to materials and equipment consistent with the Contractor’s usual accounting practices.

  • Recalls Contractor shall immediately notify OGS of any recalls pertaining to any items awarded to the Contractor. AMERICANS WITH DISABILITIES ACT (ADA) The Federal ADA Act, signed into law July 26, 1990, bars employment discrimination and requires all levels of Government to provide necessary and reasonable accommodations to qualified workers with disabilities. Contractors are required to identify and offer any software or hardware products they manufacture or adapt which may be used or adapted for use by visually, hearing, or any other physically impaired individuals. Although it is not mandatory for Contractors to have this equipment in order to receive an award, it is necessary to identify any such equipment they have which falls into the above category. DIESEL EMISSION REDUCTION ACT Pursuant to §19-0323 of the N.Y. Environmental Conservation Law (“the Law”) it is a requirement that heavy duty diesel vehicles in excess of 8,500 pounds use the best available retrofit technology (“BART”) and ultra low sulfur diesel fuel (“ULSD”). The requirement of the Law applies to all vehicles owned, operated by or on behalf of, or leased by State agencies and State or regional public authorities. It also requires that such vehicles owned, operated by or on behalf of, or leased by State agencies and State or regional public authorities with more than half of its governing body appointed by the Governor utilize BART. The Law may be applicable to vehicles used by Contractors “on behalf of” State agencies and public authorities and require certain reports from Contractors. All heavy duty diesel vehicles must have BART by the deadline provided in the Law. The Law also provides a list of exempted vehicles. Regulations set forth in 6 NYCRR Parts 248 and 249 provide further guidance. The Bidder hereby certifies and warrants that all heavy duty vehicles, as defined in the Law, to be used under this contract, will comply with the specifications and provisions of the Law, and 6 NYCRR Parts 248 and 249. POOR PERFORMANCE An Authorized User should notify OGS Customer Services promptly if the Contractor fails to meet the requirements of this Contract.   • Fuel 28.1 The Vehicle must be returned with the amount of fuel equal to that at the time of the commencement of the rental. If the Vehicle is returned with less fuel, the difference will be charged to You at a rate of $5.00 including GST per litre (which includes a service component).

  • Freight All quotes to Members shall provide a line item for cost for freight or shipping regardless if there is a charge or not. If no charge for freight or shipping, indicate by stating “No Charge”, “$0”, “included in price” or other similar indication. Otherwise, all shipping, freight or delivery changes shall be passed through to the TIPS Member at cost with no markup and said charges shall be agreed by the TIPS Member unless alternative shipping terms are agreed by TIPS as a result of the proposal award. Warranty Conditions All new supplies equipment and services shall include manufacturer's minimum standard warranty unless otherwise agreed to in writing. Vendor shall be legally permitted to sell all products offered for sale to TIPS Members if the offering is included in the Request for Proposal (“RFP”) category. All goods proposed and sold shall be new unless clearly stated in writing. Customer Support The Vendor shall provide timely and accurate customer support for orders to TIPS Members as agreed by the Parties. Vendors shall respond to such requests within a commercially reasonable time after receipt of the request. If support and/or training is a line item sold or packaged with a sale, support shall be as agreed with the TIPS Member.
