Common use of Source and Nationality Requirements Clause in Contracts

Source and Nationality Requirements. Source and nationality requirements do not apply to procurements using donated, non-appropriated funds accepted under USAID’s gift authority (see 22 CFR 228.02(b)). Such funds are automatically designated with USAID Principal Geographic Code 935. If the absence of procurement restrictions on donated funds gives rise to any issues (for example, if such funds were intended to be commingled with funds having a different USAID Principal Geographic Code), the Operating Unit must consult with GC or the cognizant RLO.
