Special Assessment Liens Imposed by Public Body. The Property may be subject to unpaid special 258 assessment lien(s) imposed by a public body. (A public body includes a Community Development District.) Such 259 liens, if any, shall be paid as set forth in Paragraph 9(e).

Such liens, if any, which are due and payable as of Closing, shall paid by Seller at the Closing; otherwise, any unpaid assessments or assessment liens not yet due and payable shall be prorated as of the date of Closing.
Special Assessment Liens Imposed by Public Body. The Property may be subject to unpaid special assessment liens imposed by a public body. A public body includes a Community Development District, Special Assessment District or Municipal Service Taxing Unit. Buyer will assume at Closing any outstanding capital assessment balances and special assessments due for the period of time from and after the Closing Date. Notwithstanding the foregoing, nothing contained in this Agreement shall in any way affect or diminish any tenant’s obligations under any applicable Lease to pay any capital assessment balances or special assessment liens levied against the Property. A COMMUNITY DEVELOPMENT DISTRICT MAY IMPOSE AND LEVY TAXES OR ASSESSMENTS, OR BOTH TAXES AND ASSESSMENTS, ON THE PROPERTY. THESE TAXES AND ASSESSMENTS PAY THE CONSTRUCTION, OPERATION, AND MAINTENANCE COSTS OF CERTAIN PUBLIC FACILITIES AND SERVICES OF THE DISTRICT AND ARE SET ANNUALLY BY THE GOVERNING BOARD OF THE DISTRICT. THESE TAXES AND ASSESSMENTS ARE IN ADDITION TO COUNTY AND OTHER LOCAL GOVERNMENTAL TAXES AND ASSESSMENTS AND ALL OTHER TAXES AND ASSESSMENTS PROVIDED FOR BY LAW.
