Special Use Permit Access- Previously Granted. The Parties understand and acknowledge that on June 27, 2017 the Board of County Commissioners issued County Resolution No. 2017-026, approving a Special Use Permit (“SUP”) for Xxxx Xxxxxxx and Xxxxx Xxxxxx to operate a Bed & Breakfast on a property referred to as the “Hoosier Girl Mining Claim” currently doing business as the Mt. Xxxxxx Backcountry Lodge (hereinafter “Mt. Xxxxxx Backcounty Lodge”). A prior owner and operator of the Revenue-Virginius Silver Mine, Ouray Silver Mines, Inc. (OSMI), played a key role in the approval process of the original Mt. Xxxxxx Backcounty Lodge SUP, as party to an MOU that detailed the relationship between XXXX, the Mt. Hayden Backcounty Lodge, and the access/maintenance of certain applicable county roads. Specifically, Condition #16 of Resolution No. 2017-026 required the Mt. Xxxxxx Backcounty Lodge to enter into a Memorandum of Understanding or MOU with OSMI, regarding winter access, which was subsequently approved by the County Planning Director. When XXXX was no longer the owner of the mine, and during the pendency of receivership proceedings, a road maintenance agreement between OSMI and the County lapsed, which had previously allowed for winter wheeled vehicular access for the Mt. Xxxxxx Backcounty Lodge. Therefore, the Mt. Xxxxxx Backcountry Lodge’s prior grant of winter wheeled vehicular access under its prior Road Use Agreement with OSMI (which depended on the underlying road maintenance agreement between OSMI and the county) has also now contractually lapsed. For this reason, the Parties to this Agreement acknowledge and agree:

  • Specific Provisions for Access Rights to Software For the avoidance of doubt, the general provisions for Access Rights provided for in this Section 9 are applicable also to Software. Parties’ Access Rights to Software do not include any right to receive source code or object code ported to a certain hardware platform or any right to receive respective Software documentation in any particular form or detail, but only as available from the Party granting the Access Rights.

  • Additional Permitted Uses In addition to those purposes set forth in the Agreement, Business Associate may use PHI for the following additional purposes:

  • Zone File Access Agreement Registry Operator will enter into an agreement with any Internet user, which will allow such user to access an Internet host server or servers designated by Registry Operator and download zone file data. The agreement will be standardized, facilitated and administered by a Centralized Zone Data Access Provider, which may be ICANN or an ICANN designee (the “CZDA Provider”). Registry Operator (optionally through the CZDA Provider) will provide access to zone file data per Section 2.1.3 of this Specification and do so using the file format described in Section 2.1.4 of this Specification. Notwithstanding the foregoing, (a) the CZDA Provider may reject the request for access of any user that does not satisfy the credentialing requirements in Section 2.1.2 below; (b) Registry Operator may reject the request for access of any user that does not provide correct or legitimate credentials under Section 2.1.2 below or where Registry Operator reasonably believes will violate the terms of Section 2.1.5. below; and, (c) Registry Operator may revoke access of any user if Registry Operator has evidence to support that the user has violated the terms of Section 2.1.5 below.

  • Additional Access Rights For the avoidance of doubt any grant of Access Rights not covered by the Grant Agreement or this Consortium Agreement shall be at the absolute discretion of the owning Party and subject to such terms and conditions as may be agreed between the owning and receiving Parties.

  • Exceptional Access to Thick Registration Data In case of a registrar failure, deaccreditation, court order, etc. that prompts the temporary or definitive transfer of its domain names to another registrar, at the request of ICANN, Registry Operator will provide ICANN with up-­‐to-­‐date data for the domain names of the losing registrar. The data will be provided in the format specified in Specification 2 for Data Escrow. The file will only contain data related to the domain names of the losing registrar. Registry Operator will provide the data as soon as commercially practicable, but in no event later than five (5) calendar days following ICANN’s request. Unless otherwise agreed by Registry Operator and ICANN, the file will be made available for download by ICANN in the same manner as the data specified in Section 3.1 of this Specification.

  • RIGHT OF ALLOTTEE TO USE COMMON AREAS AND FACILITIES SUBJECT TO PAYMENT OF TOTAL MAINTENANCE CHARGES The Allottee hereby agrees to purchase the [Apartment/Plot] on the specific understanding that is/her right to the use of Common Areas shall be subject to timely payment of total maintenance charges, as determined and thereafter billed by the maintenance agency appointed or the association of allottees (or the maintenance agency appointed by it) and performance by the Allottee of all his/her obligations in respect of the terms and conditions specified by the maintenance agency or the association of allottees from time to time.

  • Modifications and Updates to the Wire Center List and Subsequent Transition Periods 2.1.4.12.1 In the event BellSouth identifies additional wire centers that meet the criteria set forth in Section 2.1.4.5, but that were not included in the Initial Wire Center List, BellSouth shall include such additional wire centers in a carrier notification letter (CNL). Each such list of additional wire centers shall be considered a “Subsequent Wire Center List”.
