Specific Lease Clauses. This Section addresses some common specific questions that often arise in preparing and negotiating leases. In addressing specific lease issues, attorneys need not only concern themselves with not just the specific lease term but also how they relate to the lease as a whole and with provisions of other leases. The use of overly landlord friendly leases is discussed above; however, there is a legitimate concern on the part of landlords to ensure consistency in leases to, among other reasons, to aid in administration of the lease and not needing to apply different provisions to each tenant. But despite landlord’s best efforts, most individual lease terms will be negotiated to some extent and negotiated in different ways by different tenants. The best real estate lawyers can use their knowledge of specific terms to make the negotiation process more efficient without giving up important rights of its clients.
