SPUD WINCH PERFORMANCE. Each spud winch system shall be capable of developing a full drum single line sufficient to raise the spud at a minimum line speed of 60 ft./min. The Contractor shall determine the required line pull based on the weight of the spud and the efficiencies of the lifting system as designed during Phase II. The line pull shall increase to twice the required force determined by the Contractor, at or near zero line speed, to assist in removing the spuds buried in the bottom soil. This near zero speed condition typically results in a motor torque value that would exceed the rating of a motor that is only sized based on the weight of the spud to be moved at 60 ft./min. As such, the motor shall be sized and selected considering both operating conditions. Each winch shall have a minimum drum capacity determined by the Contractor. The Contractor shall size the drum capacity to allow the spud to travel the full range through the barge. There shall be 5 wraps of wire rope left on the drum with the spud in the full down position. The wire rope shall be of sufficient size and strength for the application. The ratio of barrel drum diameter to wire rope diameter shall not be less than fourteen. The design shall ensure easy spud line replacement. The spud winches shall have infinitely variable speed power up and power down, and a near free fall lowering capability. The winches shall be equipped with brakes rated at twice the spud dry weight of holding force. The brakes shall automatically set when: • there is any failure in the electric system powering the winch and • the control lever is in the center position. Unless moved by the operator, the winch control handle shall always be in the center position. In the near freefall mode, the winch shall be designed to automatically arrest the rotation of the drum in less than ¼ rotation of the drum once the spud hits the bottom, thereby preventing un-spooling of the wire. The spud winches shall also be provided with a weekend/unattended mode, consisting of a manually-operated jaw clutch capable of completely disconnecting the drum from the drive train, to permit wire to payout as river level rises. The system shall be kept under tension in order to prevent excessive slack wire should the river level fall.

  • Work Performance Xxxxxx agrees that all Services performed hereunder shall be performed on a best effort basis by employees, students, faculty, graduate assistants and staff having an appropriate experience and skill level and in compliance with the statement of work.

  • Continuing Performance (a) The obligations under this Agreement continue until satisfied in full and do not merge with any action performed or document executed by any Party for the purposes of performance of this Agreement. (b) Any representation in this Agreement survives the execution of any document for the purposes of, and continues after, performance of this Agreement. (c) Any indemnity given by any Party under this Agreement: (i) constitutes a liability of that Party separate and independent from any other liability of that Party under this Agreement or any other agreement; and (ii) survives and continues after performance of this Agreement.

  • Good Faith Performance Each Party shall act in good faith in its performance under this Agreement and, in each case in which a Party’s consent or agreement is required or requested hereunder, such Party shall not unreasonably withhold or delay such consent or agreement.

  • Product Performance Contractor hereby warrants and represents that the Products acquired by the Authorized User under the terms and conditions of this Contract conform to the specifications, performance standards and documentation in the Authorized User Agreement., and the documentation fully describes the proper procedure for using the Products. Contractor further warrants and represents that if the Products acquired by the Authorized User pursuant to an Authorized User Agreement under this Contract include software application development, software application customization, software programming, software integration or similar items (“Software Deliverables”) then such Software Deliverables shall be free from defects in material and workmanship and conform with all requirements of the Contract and Authorized User Agreement for the warranty period of one (1) year from the date of acceptance of the completed project (“Project warranty period”). Contractor also warrants that the Products, in the form provided to the Authorized User, do not infringe any copyright, trademark, trade secret or other right of any third party.

  • Contract Performance C19.1 The Contractor shall ensure that: C19.1.1 the Goods conform in all respects with the Specification and, where applicable, with any sample or performance demonstration approved by the Authority; C19.1.2 the Goods operate in accordance with the relevant technical specifications and correspond with the requirements of the Specification and any particulars specified in the Contract; C19.1.3 the Goods conform in all respects with all applicable Laws; and C19.1.4 the Goods are free from defects in design, materials and workmanship and are fit and sufficient for all the purposes for which such Goods are ordinarily used and for any particular purpose made known to the Contractor by the Authority.

  • Consideration for Performance The consideration to be paid to the Contractor under this Agreement will be compensation for all the Contractor’s expenses incurred in the performance of this Agreement, unless otherwise expressly provided.

  • Unsatisfactory Performance All work performed by the Contractor is expected to be done in the most expeditious and professional manner as specified in Section 5 of this document, while also complying with the workmanlike standard clause contained at Section 5.4.1.

  • School Performance The School shall achieve an accountability designation of Good Standing or Honor on each of the three sections of the Performance Framework. In the event the School is a party to a third party management contract which includes a deficit protection clause, the School shall be exempt from some or all measures within the financial portion of the Performance Framework. In accordance with Charter School Law, the Authorizer shall renew any charter in which the public charter school met all of the terms of its performance certificate at the time of renewal.

  • KEY PERFORMANCE INDICATORS 10.1 The Supplier shall at all times during the Framework Period comply with the Key Performance Indicators and achieve the KPI Targets set out in Part B of Framework Schedule 2 (Goods and/or Services and Key Performance Indicators).

  • Security for Performance In the event that Exhibit A Section 4 indicates the need for Consultant to provide additional security for performance of its duties under this Agreement, Consultant shall provide such additional security prior to commencement of its Required Services in the form and on the terms prescribed on Exhibit A, or as otherwise prescribed by the City Attorney.
