Stage Three. 22.2.3(a) Either party may refer the matter to a private mediator or to the Commission for the purposes of conciliation, mediation or other type of alternative dispute resolution. If the dispute is over the application of the Agreement, or in relation to the NES, the matter may be referred to the Commission for arbitration.
