Common use of Stand-by Time Clause in Contracts

Stand-by Time. Stand-by time is the period of time when the Employer requires an employee to be readily available to contact by telephone or other method of communication. An employee who is notified by the Employer that he/she is on "stand-by" during his/her scheduled off duty hours shall be paid at the respective overtime compensation rate specified in Section 18.3 or 18.4 for all time spent on such status. As soon as the Employer determines that stand-by time will be required, the Employer will notify the employee of the date and time the employee shall be required to be on stand-by.

Stand-by Time. Stand-by time By Time is the a period of time when the Employer requires that is not a regular working period during which an employee is required to keep himself or herself: (i) Immediately available to receive a call to return to work and, (ii) Immediately available to return to the workplace. Where an employee is required to be readily available to contact by telephone or other method of communication. An employee who is notified by the Employer that he/she is on "stand-by" during his/her scheduled off duty hours , he or she shall be paid at the respective overtime compensation rate specified in Section 18.3 or 18.4 receive $2.50 per hour for all time spent on such status. As soon as the Employer determines hours that stand-by time will be required, the Employer will notify the employee of the date and time the employee shall be he or she is required to be on stand-by.
