Status of the MOU. For legal purposes, nothing in this MOU shall be construed as creating a joint venture, an agency relationship or a legal partnership between the Parties. No provision of this MOU shall be construed so as to in any way interfere with the respective decision-making processes of the Parties with regard to their own respective work and operation. Each Party will bear its own costs incurred in the implementation of this MOU. This MOU does not represent a commitment of funds on the part of either Party.
Status of the MOU. 2.1 This MOU is a statement that the parties intend to negotiate with each other towards convergence. It is anticipated that the results of negotiations will be put into a legally binding document executed by all the parties and no provisions shall be binding until this is complete.
2.2 On this basis the terms set out below form the foundation for negotiation only, and represent a starting point for working together in good faith. It is recognised that during the intervening period until a single service commences across East Kent, it may become undesirable for one or more parties to continue towards convergence. The parties, however, aim to keep each other fully informed of their respective positions.
2.3 For the avoidance of doubt this MOU shall have a long stop date of 31 December 2015, after which it shall no longer apply. However, it may be varied, revoked or replaced by a further MOU with the agreement of the parties set out in 1.1 above.
2.4 This MOU is not intended to be legally binding. Corporate governance, the respective Constitutions and the procurement rules for each party over-ride the content of this MOU.
Status of the MOU. This MoU outlines current intentions of the Participants signing this MoU and forms a framework for the Programme. This MoU is not intended to create legally enforceable rights or obligations to its Participants. Any disputes related to the interpretation or application of the MoU will be resolved through negotiations between the Participants and will not be brought to the national or international court or any other third party. This MoU comes into force when signed by all Participants.

Any activities conducted under this MOU are subject to their inclusion in the Parties’ respective programme of work and budget and shall be carried out in accordance with their respective rules and practices.
Status of the MOU. It is recognised and accepted by the parties that this Memorandum does not create any rights, liabilities or obligations which would have binding effect in law, but the parties are expected to implement the Memorandum in good faith.
Status of the MOU. 6.1 This MoU is a statement of intent, and should not be interpreted as a binding agreement. It does not create legal obligations between the parties.
Status of the MOU. 2.1 The partners acknowledge that it is not their intention for this MoU to have a binding legal effect. Rather it is a statement of their shared intention to work together in the spirit of partnership and cooperation for the benefits of the residents of Cardiff and the Vale of Glamorgan.
2.2 This MoU is designed to complement and support other key working relationships which operate at a strategic partnership level within the area of Cardiff and the Vale of Glamorgan, including the Regional Partnership Board and the Public Services Boards.
2.3 This MoU will help to optimise the CVC’s role in providing third sector support and development at local level, nurturing local group development, hosting Volunteer Centres, and engaging with statutory sector partners to improve local community health and wellbeing outcomes.
Status of the MOU. This MOU is not intended to create any legally binding obligations and does not constitute an international treaty. This MOU takes due cognizance of the separate bilateral agreements entered into between the Government and the Development Partners, and is adopted pursuant to and subject to any such bilateral agreements. If there is any inconsistency between the provisions of this MOU and any bilateral agreement, the provisions of the bilateral agreement will prevail. Any matter not expressly addressed by this MOU will be governed by the bilateral agreements.
Status of the MOU. The principles and arrangements provided for in this MoU do not exempt the DTI or NPD from their obligations under their respective national laws.
