STATUTORY ACKNOWLEDGEMENTS AND DEEDS OF RECOGNITION. A statutory acknowledgement recognises the particular cultural, spiritual, historical and traditional association between Whakatōhea and a particular site. It enhances the ability of Whakatōhea to participate in specified resource management processes. A deed of recognition obliges the Crown to consult with Whakatōhea on specified matters and to have regard to Whakatōhea views on their special associations with certain areas. The Whakatōhea Deed of Settlement provides a statutory acknowledgement and deeds of recognition from the Commissioner of Crown Lands and from the Minister of Conservation and the Director- General of Conservation over each of the following rivers and catchments within the Whakatōhea area of interest, to the extent that those areas are owned by the Crown: • Ōtara River and its tributaries • Waioweka River and its tributaries within the area of interest • Waiaua River and its tributaries within the area of interest • Opape Stream and its tributaries • Waiotahe River and its tributaries within the area of interest • Nukuhou River and its tributaries within the area of interest RAUMAIROA: NATURAL RESOURCES ARRANGEMENTS The settlement will provide for the following natural resource arrangements over the rivers and their catchments in the Whakatōhea area of interest: • the establishment of a non-regulatory Whakatōhea Kaitiaki Forum, which will operate as a permanent joint committee of the Bay of Plenty Regional Council; and • the ability to enter into one or more Joint Management Agreements with Ōpōtiki District Council or Bay of Plenty Regional Council. FISHERIES MANAGEMENT ADVISORY COMMITTEE The settlement provides for the Whakatōhea PSGE’s appointment as an advisory committee to the Minister for Oceans and Fisheries. The committee will provide input on fisheries management matters in relation to areas of special significance to Whakatōhea.

STATUTORY ACKNOWLEDGEMENTS AND DEEDS OF RECOGNITION. Definitions and interpretation In this clause 5.2 and in Schedules 5.3 to 5.10: Consent Authority has the meaning given to it in section 2 of the Resource Management Act 1991; Deed o f Recognition means a deed of recognition entered into by the Crown in respect of a Statutory Area, under clause 5.2.15 of this Deed; Effective Date means the date that is 6 months after the Settlement Date;
STATUTORY ACKNOWLEDGEMENTS AND DEEDS OF RECOGNITION. Statutory Acknowledgements recognise the special association Hineuru has with a particular site or area, and will be included in the settlement legislation. Statutory Acknowledgements are recognised under the Resource Management Xxx 0000 and the Heritage Xxx Xxxxxxx Xxxxxxx Xxxxxx Xxx 0000. The acknowledgements require that consent authorities provide Hineuru with summaries of all resource consent applications that may affect the areas named in the acknowledgements. Deeds of Recognition oblige the Crown to consult with Xxxxxxx and have regard to their views regarding the special association Hineuru has with a site. They also specify the nature of Xxxxxxx’s input into management of those areas by the Department of Conservation and Land Information New Zealand. The Crown offers a Statutory Acknowledgement over the following areas: • Heruiwi Block Conservation Area • Kaimanawa Forest Park • Kokomoka Forest • Mohaka River and its tributaries • Opoto Scenic Reserve • Rangitaiki Conservation Area • Rangitaiki River and its tributaries • Ripia River and its tributaries • Stoney Creek Conservation Area • Tarawera Conservation Area • Te Hoe River and its tributaries • Te Kohu Ecological Area • Turangakumu Scenic Reserve • Urutomo Conservation Area • Waipunga Forest • Waipunga River and its tributaries • Whirinaki Te Pua-ā-Tāne Conservation Park (Whirinaki Conservation Park). The Crown offers a Deed of Recognition over the following areas: • Kokomoka Forest • Opoto Scenic Reserve • Rangitaiki Conservation Area • Stoney Creek Conservation Area • Turangakumu Scenic Reserve • Urutomo Conservation Area • Waipunga Forest • Mohaka River and its tributaries • Rangitaiki River and its tributaries • Waipunga River and its tributaries • Mohaka River and its tributaries • Rangitaiki River and its tributaries. Statutory Acknowledgements and Deeds of Recognition are non- exclusive redress, meaning more than one iwi can have a Statutory Acknowledgement or Deed of Recognition over the same site. PLACE NAME CHANGES The Deed of Settlement will provide for three official geographic name changes: • Stoney Creek and Ohane Stream to Ōhane Stream • Hell’s Hole to Tauira Mateāwhā • Te Ahimanawa to Te Ahimanawa-a-Kohipipi. The Deed of Settlement will change the names of the following Crown- protected areas: • Glenfalls Recreation Reserve to Waitara / Glenfalls Recreation Reserve • Glenfalls Scenic Reserve to Waitara / Glenfalls Scenic Reserve • Cashes Xxxx Conservation Area to Tarapōnui-a-...
