SUBCONTRACTOR SUBSTITUTION. Post-award substitution of any major subcontractor should not be effected unless the proposed substitution is submitted to the KO and official approval is obtained. The post-award substitution or insertion of a second-tier subcontractor will be treated in the same manner as the substitution of a major subcontractor and will require specific approval by the KO.

SUBCONTRACTOR SUBSTITUTION. 1. Evidence of fraud or discrimination in the substitution of Subcontractors will result in sanctions including assessment of penalty fines, termination of Contract, or debarment. This section does not replace applicable California Public Contract Code.
SUBCONTRACTOR SUBSTITUTION. The substitution of any Subcontractor listed in the Design/Build Entity’s proposal shall be justified in writing not less than ten (10) days after the date of the Notice to Proceed to Commence Design Phase, and shall be subject to the approval of the Principal Representative. For reasons such as the Subcontractor’s refusal to perform as agreed, subsequent unavailability or later discovered proposal errors, or other similar reasons, such substitution may be approved. The Design/Build Entity shall bear any additional cost incurred by such substitutions.

SUBCONTRACTOR SUBSTITUTION. Requests must be made in writing to the Purchasing & Contracting Department, Attention Contracts Division, 0000 Xxxxx Xxxxxx, Xxxxx 000, Xxx Xxxxx, XX 00000. The request must include a thorough explanation of the reason(s) for the substitution, including dollar amounts and a letter from each substituted firm stating that it (the substituted firm) releases all interest in working on the project, written confirmation from the new firm stating that it agrees to work on the project along with the dollar value of the work to be performed. Written approval of the substitution request must be received by the Design-Builder, from the City of San Diego or its authorized officer, prior to any unlisted subcontractor (over one-half of 1% of the total bid amount for construction) performing work on a project. Substitution of subcontractors without authorization shall subject the Design-Builder to those penalties set forth in Public Contract Code Section 4110.
SUBCONTRACTOR SUBSTITUTION. Pursuant to California Labor Code 1771.1 (d), failure to be registered with DIR by a Subcontractor, of any tier, shall be grounds under California Contract Code §4107, with the District’s consent, to substitute a Subcontractor who is registered in place of the unregistered Subcontractor.

As stated in 15 U.S.C. 637(d)(8), any Contractor or Subcontractor failing to comply in good faith with the requirements of the subcontracting plan is in material breach of its contract. Further, 15 U.S.C. 637(d)(4)(F) directs that a Contractor’s failure to make a good faith effort to comply with the requirements of the subcontracting plan shall result in the imposition of liquidated damages. The OASIS Program Office requires use of the electronic Subcontracting Reporting System (eSRS) modules as the secure, confidential, information management tool to evaluate subcontracting goal performance for OASIS. The Subcontracting Plan covers the OASIS program as whole, however, the Contractor shall submit Individual Subcontract Reports (ISR) for Individual Subcontracting Plans, if applicable, and Summary Subcontract Reports (SSR) per each individual Pool the Contractor has a contract award using the web-based eSRS at xxxx://xxx.xxxx.xxx. Affiliates of the Prime Contractor or Subcontractor are not included in these reports. Subcontract award data reported by Prime Contractors and Subcontractors shall be limited to awards made to their immediate next-tier Subcontractors. Contractors are required to adhere to their Subcontracting Plan, incorporated into the basic contract by reference. When a Contractor does not meet any one or more of their Subcontracting Goals for a given reporting period, the Contractor shall explain, in writing, the rationale for not meeting the goals in the comments section of the ISR/SSR.

  • Subcontracting 6.1 The Grantee is responsible for the performance of its obligations under this Agreement, including in relation to any tasks undertaken by subcontractors.
