Common use of Submittal Clause in Contracts

Submittal. i. The Contractor shall submit to the Director of Works for his/her review the CQP within one month from Contract signature and not later than the date of handover of the Site. No payments will be made to the Contractor before submitting the CQP. The Contractor shall be responsible for all consequences, including delay and costs resulting from his/her failure to submit the CQP as per these Guidelines. The Agency shall not incur any losses or additional costs because of this delay. The Contractor shall not be entitled to an extension of time, or to payment of the costs, resulting from his/her failure to submit the CQP or a revised CQP, as per these Guidelines, ii. Unless the Director of Works, within 7 calendar days of receiving the first CQP or within 7 calendar days of receiving a revised CQP, gives notice to the Contractor stating the extent to which the CQP does not comply with the Contract, the Contractor shall proceed in accordance with the Progress Schedule and the CQP, subject to his/her other obligations under the Contract.
