Teachers Who Take Approved Leave Without Pay. Where a Teacher takes leave without pay with the approval of the School for a period which [in total] exceeds 20 pupil days in any year, or where a Teacher takes parental leave pursuant to clause 19.2 or clause 19.3, the Teacher shall be paid salary calculated in accordance with this clause as follows: If the leave without pay commences and concludes in the same school year: (i) subject to clause 17.6 (a)(ii) below, the payment shall be calculated and made at the conclusion of Term IV of that school year; and (ii) if the leave without pay commences on the day following the last teaching day of a term and concludes on the day preceding the first teaching day of a term in the same year a payment shall be calculated and made: (A) at the commencement of the leave in respect of that year; and‌ (B) at the end of Term IV in accordance with clause 17.6(c).‌ If the leave without pay is to conclude in a school year following the school year in which the leave commenced: (i) at the commencement of the leave, a payment shall be calculated and made in respect of the school year in which the leave commences; and‌ (ii) at the end of Term IV in the school year in which the leave concludes, a payment shall be calculated and made in respect of that school year. The payment to be made to a Teacher at the conclusion of Term IV of a school year: (i) pursuant to clause 17.6(a)(ii)(B); (ii) or in circumstances where, with the agreement of the School, a Teacher who has been paid pursuant to clause 17.6(b) (i) returns from leave during the school year in which the leave commenced and not withstanding that as a result did not in total exceed 20 pupil days, shall be determined by: (A) applying the formula in clause 17.3 as if no payment had been made to the Teacher pursuant to clause 17.6(a)(ii)(A) or clause 17.6(b)(i); and (B) deducting from that amount the amount paid to the Teacher pursuant to clause 17.6(a)(ii)(A) or clause 17.6(b)(i). Notwithstanding the provisions of clause 17.3(a) a Teacher shall not, pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher would otherwise be entitled under the provisions of the Act, in respect of a year of employment.

Where a Teacher teacher takes leave without pay with the approval of the School school for a period which [in total] exceeds 20 pupil days (days in term time) in any year, (or where the equivalent pro rata number of days for a Teacher takes parental leave pursuant to clause 19.2 or clause 19.3, part time teacher) the Teacher teacher shall be paid salary calculated in accordance with this clause as follows: : (a) If the leave without pay commences and concludes in the same school year: (i) subject to clause 17.6 (a)(ii22.6(a)(ii) below, the payment shall be calculated and made at the conclusion of Term IV of that school year; and (ii) if the leave without pay commences on the day following the last teaching day of a term and concludes on the day preceding the first teaching day of a term in the same year a payment shall be calculated and made: (A) at the commencement of the leave in respect of that year; and‌and (B) at the end of Term IV in accordance with clause 17.6(c).‌ 22.6(c). (b) If the leave without pay is to conclude in a school year following the school year in which the leave commenced: (i) at the commencement of the leave, a payment shall be calculated and made in respect of the school year in which the leave commences; and‌and (ii) at the end of Term IV in the school year in which the leave concludes, a payment shall be calculated and made in respect of that school year. . (c) The payment to be made to a Teacher teacher at the conclusion of Term IV of a school year: (i) pursuant to clause 17.6(a)(ii)(B22.6(a)(ii)(B); (ii) or in circumstances where, with the agreement of the Schoolschool, a Teacher teacher who has been paid pursuant to clause 17.6(b) (i22.6(b)(i) returns from leave during the school year in which the leave commenced and not withstanding that as a result did not in total exceed 20 pupil daysdays (or the equivalent pro rata amount for a part time teacher), shall be determined by: (A) applying the formula in clause 17.3 22.3 as if no payment had been made to the Teacher teacher pursuant to clause 17.6(a)(ii)(A22.6(a)(ii)(A) or clause 17.6(b)(i22.6(b)(i); and (B) deducting from that amount the amount paid to the Teacher teacher pursuant to clause 17.6(a)(ii)(A22.6(a)(ii)(A) or clause 17.6(b)(i22.6(b)(i). . (d) Notwithstanding the provisions of clause 17.3(a) 22.2(a), a Teacher teacher shall not, not pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher teacher would otherwise be entitled under the provisions of the Act, in respect of a year of employment.

(d) Notwithstanding the provisions of clause 17.3(a) 10.1(a), a Teacher shall not, not pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher would otherwise be entitled under the provisions of the Act, in respect of a year of employment.

Teachers Who Take Approved Leave Without Pay. Where a Teacher teacher takes leave without pay with the approval of the School for a period which [in total] exceeds 20 pupil days when attendance is required in any year, (or where the equivalent pro rata number of days for a Teacher takes parental leave pursuant to clause 19.2 or clause 19.3, part time teacher) the Teacher teacher shall be paid salary calculated in accordance with this clause as follows: : (a) If the leave without pay commences and concludes in the same school year: (i) subject to clause 17.6 (a)(ii22.6(a)(ii) below, the payment shall be calculated and made at the conclusion of Term IV of that school year; and (ii) if the leave without pay commences on the day following the last teaching day of a term and concludes on the day preceding the first teaching day of a term in the same year a payment shall be calculated and made: (A) at the commencement of the leave in respect of that year; and‌and (B) at the end of Term IV in accordance with clause 17.6(c).‌ 22.6(c). (b) If the leave without pay is to conclude in a school year following the school year in which the leave commenced: (i) at the commencement of the leave, a payment shall be calculated and made in respect of the school year in which the leave commences; and‌and (ii) at the end of Term IV in the school year in which the leave concludes, a payment shall be calculated and made in respect of that school year. . (c) The payment to be made to a Teacher teacher at the conclusion of Term IV of a school year: (i) pursuant to clause 17.6(a)(ii)(B22.6(a)(i)(B); (ii) or in circumstances where, with the agreement of the School, a Teacher teacher who has been paid pursuant to clause 17.6(b) (i22.6(b)(i) returns from leave during the school year in which the leave commenced and not withstanding ng that as a result did not in total exceed 20 pupil daysdays when attendance is required (or the equivalent pro rata amount for a part time teacher), shall be determined by: (A) applying the formula in clause 17.3 22.3 as if no payment had been made to the Teacher teacher pursuant to clause 17.6(a)(ii)(A22.6(a)(ii)(A) or clause 17.6(b)(i22.6(b)(i); and (B) deducting from that amount the amount paid to the Teacher teacher pursuant to clause 17.6(a)(ii)(A22.6(a)(ii)(A) or clause 17.6(b)(i22.6(b)(i). . (d) In respect of any payment to be made to a teacher at the conclusion of Term IV of a school year pursuant to this subclause 22.6, a teacher may request the School to pay the amount so calculated, at the teacher's normal weekly rate of pay (or, in respect of the final payment, any balance outstanding) in instalments over the school summer vacation period, as part of the School's normal pay run, until the full amount has been paid. (e) Notwithstanding the provisions of clause 17.3(a) 22.1(a), a Teacher teacher shall not, not pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher teacher would otherwise be entitled under the provisions of the Act, in respect of a year of employment.

Teachers Who Take Approved Leave Without Pay. (a) Where a Teacher takes leave without pay with the approval of the School for a period which [in total] exceeds 20 pupil days in any year, or where a Teacher takes parental leave pursuant to clause 19.2 or clause 19.3, the Teacher shall be paid salary calculated in accordance with this clause as follows: : (b) If the leave without pay commences and concludes in the same school year: (i) subject to clause 17.6 (a)(ii13.7(b)(ii) below, the payment shall be calculated and made at the conclusion of Term IV Four of that school year; and (ii) if the leave without pay commences on the day following the last teaching day of a term and concludes on the day preceding the first teaching day of a term in the same year a payment shall be calculated and made: (A) at the commencement of the leave in respect of that year; and‌and (B) at the end of Term IV Four in accordance with clause 17.6(c).‌ 13.7(d). (c) If the leave without pay is to conclude in a school year following the school year in which the leave commenced: (i) at the commencement of the leave, a payment shall be calculated and made in respect of the school year in which the leave commences; and‌and (ii) at the end of Term IV Four in the school year in which the leave concludes, a payment shall be calculated and made in respect of that school year. . (d) The payment to be made to a Teacher teacher at the conclusion of Term IV Four of a school year: (i) pursuant to clause 17.6(a)(ii)(B13.7(b)(ii)(B); (ii) or in circumstances where, with the agreement of the School, a Teacher who has been paid pursuant to clause 17.6(b) (i13.7(c)(i) returns from leave during the school year in which the leave commenced and not withstanding that as a result did not in total exceed 20 pupil days, shall be determined by: (A) applying the formula in clause 17.3 13.3 or 13.4 as appropriate as if no payment had been made to the Teacher teacher pursuant to clause 17.6(a)(ii)(A13.7(b)(ii)(A) or clause 17.6(b)(i13.7(c)(i); and (B) deducting from that amount the amount paid to the Teacher teacher pursuant to clause 17.6(a)(ii)(A13.7(b)(ii)(A) or clause 17.6(b)(i13.7(c)(i). . (e) Notwithstanding the provisions of clause 17.3(a) 13.1(a)(i), a Teacher shall not, not pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher teacher would otherwise be entitled under the provisions of the Act, Act in respect of a year of employment.

Teachers Who Take Approved Leave Without Pay. (d) Notwithstanding the provisions of clause 17.3(a) 10.1(a), a Teacher shall not, not pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher would otherwise be entitled under the provisions of the ActFair Work Xxx 0000, in respect of a year of employment.

Teachers Who Take Approved Leave Without Pay. Where a Teacher takes leave without pay with the approval of the School for a period which [in total] total exceeds 20 pupil days in any year, or where a Teacher takes parental leave pursuant to clause 19.2 or clause 19.3, the Teacher shall be paid salary calculated in accordance with this clause as follows: : (a) If the leave without pay commences and concludes in the same school year: (i) subject to clause 17.6 (a)(ii17.6(a)(ii) below, the payment shall be calculated and made at the conclusion of Term IV of that school year; and (ii) if the leave without pay commences on the day following the last teaching day of a term and concludes on the day preceding the first teaching day of a term in the same year a payment shall be calculated and made: (A) at the commencement of the leave in respect of that year; and‌and (B) at the end of Term IV in accordance with clause 17.6(c).‌ 17.6(c). (b) If the leave without pay is to conclude in a school year following the school year in which the leave commenced: (i) at the commencement of the leave, a payment shall be calculated and made in respect of the school year in which the leave commences; and‌and (ii) at the end of Term IV in the school year in which the leave concludes, a payment shall be calculated and made in respect of that school year. . (c) The payment to be made to a Teacher at the conclusion of Term IV of a school year: (i) pursuant to clause 17.6(a)(ii)(B); (ii) or in circumstances where, with the agreement of the School, a Teacher who has been paid pursuant to clause 17.6(b) (i) returns from leave during the school year in which the leave commenced and not withstanding that as a result did not in total exceed 20 pupil days, shall be determined by: (A) applying the formula in clause 17.3 17.63 (b) as if no payment had been made to the Teacher pursuant to clause 17.6(a)(ii)(A) or clause 17.6(b)(i); and (B) deducting from that amount the amount paid to the Teacher pursuant to clause 17.6(a)(ii)(Ato (d) or clause 17.6(b)(i). Notwithstanding the provisions of clause 17.3(a) a A Teacher shall not, pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher would otherwise be entitled under the provisions of the ActAnnual Xxxxxxxx Xxx 0000 (XXX), in respect of a year of employment.

Teachers Who Take Approved Leave Without Pay. Where a Teacher takes leave without pay with the approval of the School school for a period which [in total] exceeds 20 pupil days in any year, or where a Teacher takes parental leave pursuant to clause 19.2 12.2(b) or clause 19.3, 12.2(c) the Teacher shall be paid salary calculated in accordance with this clause as follows: : (a) If the leave without pay commences and concludes in the same school year: (i) subject to clause 17.6 (a)(ii10.6(a)(ii) below, the payment shall be calculated and made at the conclusion of Term IV of that school year; and (ii) if the leave without pay commences on the day following the last teaching day of a term and concludes on the day preceding the first teaching day of a term in the same year a payment shall be calculated and made: (A) at the commencement of the leave in respect of that year; and‌and (B) at the end of Term IV in accordance with clause 17.6(c).‌ 10.6(c). (b) If the leave without pay is to conclude in a school year following the school year in which the leave commenced: (i) at the commencement of the leave, a payment shall be calculated and made in respect of the school year in which the leave commences; and‌and (ii) at the end of Term IV in the school year in which the leave concludes, a payment shall be calculated and made in respect of that school year. . (d) Notwithstanding the provisions of clause 17.3(a) 10.1, a Teacher shall not, not pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher would otherwise be entitled under the provisions of the Act, in respect of a year of employment.

Teachers Who Take Approved Leave Without Pay. Where a Teacher takes leave without pay with the approval of the School his or her Employer for a period which [(in total] ) exceeds 20 pupil days in any year, he or where a Teacher takes parental leave pursuant to clause 19.2 or clause 19.3, the Teacher she shall be paid salary calculated in accordance with this clause as follows: : (a) If the leave without pay commences and concludes in the same school Pre- School year: (i) i. subject to clause 17.6 subparagraph (a)(iiii) belowof this paragraph, the payment shall be calculated and made at the conclusion of Term IV 4 of that school Pre-School year; and (ii) . if the leave without pay commences on the day following the last teaching day of a term and concludes on the day preceding the first teaching day of a term in the same year year, a payment shall be calculated and made:made:- (A) at the commencement of the leave in respect of that year; and‌, and (B) at the end of Term IV 4 in accordance with clause 17.6(c).‌ paragraph (c) of this subclause. (b) If the leave without pay is to conclude in a school Pre-School year following the school Pre-School year in which the leave commenced: (i) i. at the commencement of the leave, leave a payment shall be calculated and made in respect of the school Pre-School year in which the leave commences; and‌, and (ii) . at the end of Term IV 4 in the school Pre-School year in which the leave concludes, concludes a payment shall be calculated and made in respect of that school Pre-School year. . (c) The payment to be made to a Teacher teacher at the conclusion of Term IV 4 of a school Pre-School year: (i) i. pursuant to clause 17.6(a)(ii)(B); section (B) of subparagraph (ii) of paragraph (a) of this subclause; ii. or in circumstances where, with the agreement of the Schoolemployer, a Teacher teacher who has been paid pursuant to clause 17.6(b) subparagraph (i) returns from leave during the school year in which the leave commenced and not withstanding that as a result did not in total exceed 20 pupil days, shall be determined by: (A) applying the formula in clause 17.3 as if no payment had been made to the Teacher pursuant to clause 17.6(a)(ii)(A) or clause 17.6(b)(i); and (B) deducting from that amount the amount paid to the Teacher pursuant to clause 17.6(a)(ii)(A) or clause 17.6(b)(i). Notwithstanding the provisions of clause 17.3(a) a Teacher shall not, pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher would otherwise be entitled under the provisions of the Act, in respect of a year of employment.paragraph

(b) If the leave without pay is to conclude in a school year following the school year in which the leave commenced: (i) at the commencement of the leave, a payment shall be calculated and made in respect of the school year in which the leave commences; and‌and (ii) at the end of Term IV Four in the school year in which the leave concludes, a payment shall be calculated and made in respect of that school year. . (c) The payment to be made to a Teacher teacher at the conclusion of Term IV Four of a school year: (i) pursuant to clause 17.6(a)(ii)(B11.7 (a) (ii) (B); (ii) or in circumstances where, with the agreement of the Schoolemployer, a Teacher teacher who has been paid pursuant to clause 17.6(b) 11.7 (b) (i) returns from leave during the school year in which the leave commenced and not withstanding that as a result did not in total exceed 20 pupil days, shall be determined by: (A) applying the formula in clause 17.3 11.3 or 11.4 as appropriate as if no payment had been made to the Teacher teacher pursuant to clause 17.6(a)(ii)(A11.7 (a) (ii) (A) or clause 17.6(b)(i); and (B) deducting from that amount the amount paid to the Teacher pursuant to clause 17.6(a)(ii)(A) or clause 17.6(b)(i). Notwithstanding the provisions of clause 17.3(a) a Teacher shall not, pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher would otherwise be entitled under the provisions of the Act, in respect of a year of employment.11.7

(a) Where a Teacher takes leave without pay with the approval of the School for a period which [in total] exceeds 20 pupil days in any year, or where a Teacher takes parental leave pursuant to clause 19.2 or clause 19.3, the Teacher shall be paid salary calculated in accordance with this clause as follows: : (b) If the leave without pay commences and concludes in the same school year: (i) subject to clause 17.6 (a)(ii13.7(c)(ii) below, the payment shall be calculated and made at the conclusion of Term IV Four of that school year; and (ii) if the leave without pay commences on the day following the last teaching day of a term and concludes on the day preceding the first teaching day of a term in the same year a payment shall be calculated and made: (A) at the commencement of the leave in respect of that year; and‌and (B) at the end of Term IV Four in accordance with clause 17.6(c).‌ 13.7(d). (c) If the leave without pay is to conclude in a school year following the school year in which the leave commenced: (i) at the commencement of the leave, a payment shall be calculated and made in respect of the school year in which the leave commences; and‌and (ii) at the end of Term IV Four in the school year in which the leave concludes, a payment shall be calculated and made in respect of that school year. . (d) The payment to be made to a Teacher teacher at the conclusion of Term IV Four of a school year: (i) pursuant to clause 17.6(a)(ii)(B13.7(b)(ii)(B); (ii) or in circumstances where, with the agreement of the School, a Teacher who has been paid pursuant to clause 17.6(b) (i13.7(c)(i) returns from leave during the school year in which the leave commenced and not withstanding that as a result did not in total exceed 20 pupil days, shall be determined by: (A) applying the formula in clause 17.3 13.3 or 13.4 as appropriate as if no payment had been made to the Teacher teacher pursuant to clause 17.6(a)(ii)(A13.7(b)(ii)(A) or clause 17.6(b)(i13.7(c)(i); and (B) deducting from that amount the amount paid to the Teacher teacher pursuant to clause 17.6(a)(ii)(A13.7(b)(ii)(A) or clause 17.6(b)(i13.7(c)(i). . (e) Notwithstanding the provisions of clause 17.3(a) 13.1(a)(i), a Teacher shall not, not pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher teacher would otherwise be entitled under the provisions of the Act, Act in respect of a year of employment.

Teachers Who Take Approved Leave Without Pay. Where a Teacher takes leave without pay with the approval of the School for a period which [in total] exceeds 20 pupil days in any year, or where a Teacher takes parental leave pursuant to clause 19.2 or clause 19.3, the Teacher shall be paid salary calculated in accordance with this clause as follows: If the leave without pay commences and concludes in the same school year: (i) subject to clause 17.6 (a)(ii) below, the payment shall be calculated and made at the conclusion of Term IV of that school year; and (ii) if the leave without pay commences on the day following the last teaching day of a term and concludes on the day preceding the first teaching day of a term in the same year a payment shall be calculated and made: (A) at the commencement of the leave in respect of that year; and‌and (B) at the end of Term IV in accordance with clause 17.6(c).‌ 17.6(c). If the leave without pay is to conclude in a school year following the school year in which the leave commenced: (i) at the commencement of the leave, a payment shall be calculated and made in respect of the school year in which the leave commences; and‌and (ii) at the end of Term IV in the school year in which the leave concludes, a payment shall be calculated and made in respect of that school year. The payment to be made to a Teacher at the conclusion of Term IV of a school year: (i) pursuant to clause 17.6(a)(ii)(B); (ii) or in circumstances where, with the agreement of the School, a Teacher who has been paid pursuant to clause 17.6(b) (i) returns from leave during the school year in which the leave commenced and not withstanding that as a result did not in total exceed 20 pupil days, shall be determined by: (A) applying the formula in clause 17.3 as if no payment had been made to the Teacher pursuant to clause 17.6(a)(ii)(A) or clause 17.6(b)(i); and (B) deducting from that amount the amount paid to the Teacher pursuant to clause 17.6(a)(ii)(A) or clause 17.6(b)(i). Notwithstanding the provisions of clause 17.3(a) a Teacher shall not, pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher would otherwise be entitled under the provisions of the Act, in respect of a year of employment.
