Common use of Temporary Non-Tenurable Vacancies Clause in Contracts

Temporary Non-Tenurable Vacancies. Any non-tenurable vacancy occurring after the opening day of a school year may be filled on a temporary basis provided the district is unable to employ a suitable permanent replacement as determined by the Board of Education or the Superintendent of Schools. The term “vacancy” shall include both permanent vacancies (such as those created by resignation or death of a non-tenurable staff) and temporary vacancies (such as those created by an extended illness, leave of absence or other limited duration). If after continued, reasonable efforts, the Board is unable to fill the vacancy during the semester in which it occurs, the Board may retain the temporary employee for the semester immediately thereafter.
