Term; Notice of Lease Dates. The Term of this Lease shall be for the period designated in Section 1.8 of the Summary commencing on the Commencement Date, and ending on the expiration of such period, unless the Term is sooner terminated or extended as provided in this Lease. Notwithstanding the foregoing, if the Commencement Date falls on any day other than the first day of a calendar month then the term of this Lease will be measured from the first day of the month following the month in which the Commencement Date occurs. Within ten (10) days after Landlord's written request, Tenant shall execute a written confirmation of the Commencement Date and expiration date of the Term in the form of the Notice of Lease Term Dates attached hereto as Exhibit "D".

The Notice of Lease Term Dates executed by Landlord shall be binding upon Tenant unless Tenant objects thereto in writing within such ten (10) day period.

For purposes of this Lease, the term “Lease Year” shall mean each consecutive twelve (12) month period during the Term: provided that, if the Commencement Date shall be other than the first day of a calendar month, then the first Lease Year shall commence on the Commencement Date and shall end on the last day of the month in which the first anniversary of the Commencement Date occurs; and further provided that, the last Lease Year shall end on the Expiration Date.

If Landlord does not deliver possession of the Premises to Tenant on or before the Delivery Date, Landlord shall not be subject to any liability for its failure to do so, and such failure shall not affect the validity of this Lease nor the obligations of Tenant hereunder; provided that the Anticipated Commencement Date shall be extended day-for-day by any delays in the Delivery Date. Within ten (10) days after Landlord's request, Tenant shall execute a written confirmation of the Commencement Date as set forth in the Notice of Lease Term Dates attached hereto as Exhibit "C". The Notice of Lease Term Dates shall be binding upon Tenant unless Tenant objects thereto within ten (10) days following Landlord's request.
