Termination for Funding. If funding for the Agreement or matter is withdrawn, reduced or limited in any way after the Agreement is signed or becomes effective, the Parties may summarily terminate the Agreement notwithstanding any other termination provision in the Agreement. Termination under his provision will be effective upon the date specified in the written notice of termination. No costs incurred after the effective date of the termination will be paid.
Termination for Funding. CDB's obligations hereunder shall cease immediately, without further payment being required, in any year for which the General Assembly of the state of Illinois or other legally applicable funding source fails to make an appropriation sufficient to pay such obligation. CDB shall give A/E notice of such termination for funding as soon as practicable after CDB becomes aware of the failure of funding.
Termination for Funding. Customer may terminate this Agreement, without penalty, in the event that previously allocated funds for the Services or similar products become unavailable, provided, however, that Customer provides thirty (30) days’ prior written notice.

In the event Metro does not or cannot obtain or continue the funding appropriation from the Metro Council for this Grant Contract, Metro may terminate this Grant Contract effective upon a date specified in a Termination Notice. Any termination of this Grant contract pursuant to this subsection shall not affect any obligations or liabilities of either Metro or the Recipient accruing prior to such termination. Metro shall not face any liability or penalty other than that accruing prior to termination as a result of such termination.

In the event KCS, in its sole discretion, does not or cannot obtain or continue the funding for this Contract from any source or sources at an aggregate level sufficient to allow for payment for the Work, KCS may exercise one of the following alternatives: (1) terminate this Contract effective upon a date specified in a Termination Notice; or (2) continue this Contract by reducing, through written notice to Contractor, the amount of this Contract and the scope of work, consistent with the nature, amount, and circumstances of the loss of funding. Any termination or reduction of this Contract pursuant to this subsection shall not affect any obligations or liabilities of either Party accruing prior to such termination or reduction. KCS shall not face any liability or penalty as a result of such termination or reduction of this Contract.

In the event MNPS, in its sole discretion, does not or cannot obtain or continue the funding for this Contract from any source or sources at an aggregate level sufficient to allow for payment for the Work, MNPS may exercise one of the following alternatives: (1) terminate this Contract effective upon a date specified in a Termination Notice; or (2) continue this Contract by reducing, through written notice to Contractor, the amount of this Contract and the scope of work, consistent with the nature, amount, and circumstances of the loss of funding. Any termination or reduction of this Contract pursuant to this subsection shall not affect any obligations or liabilities of either Party accruing prior to such termination or reduction. MNPS shall not face any liability or penalty as a result of such termination or reduction of this Contract.
Termination for Funding. WSW may terminate this Contract, in whole or in part, at any time by written notice from WSW to Subrecipient, if WSW funds are suspended, reduced, or terminated, or if Federal or State grant terms and regulations change significantly. Payment for the work performed before the effective date of such termination will be based upon the actual work performed by Subrecipient to the date of termination.
Termination for Funding. If any funding for services under this Agreement is not available, withdrawn, reduced, or limited in any way, or if additional or modified conditions are placed on the funding after the Agreement becomes effective, the County may: (A) accept a decreased price offered by the Contractor that has been approved by the WUTC; or (B) terminate the Contract. If the County terminates the Agreement pursuant to this Section, the Contractor shall be entitled to payment of fees then owing for services provided under this Agreement up to and including the date of termination.

All obligations of the OAG are subject to the availability of legislative appropriations and, for federally funded procurements, to the availability of federal funds applicable to this procurement. The parties acknowledge that funds are not specifically appropriated for this Contract and the OAG’s continual ability to make payments under this Contract is contingent upon the funding levels appropriated to the OAG for each particular appropriation period. The OAG will use all reasonable efforts to ensure that such funds are available. The parties agree that if future levels of funding are not sufficient to continue operations without any operational reductions, the OAG, in its discretion, may terminate this Contract, either in whole or in part. In the event of such termination, the OAG will not be considered to be in default or breach under this Contract, nor shall it be liable for any further payments ordinarily due under this Contract, nor shall it be liable for any damages or any other amounts which are caused by or associated with such termination. The OAG shall make best efforts to provide reasonable written advance notice to Contractor of any such termination. In the event of such a termination, Contractor shall, unless otherwise mutually agreed upon in writing, cease all work immediately upon the effective date of termination. OAG shall be liable for payments limited only to the portion of work the OAG authorized in writing and which the Contractor has completed, delivered to the OAG, and which has been accepted by the OAG. All such work shall have been completed, per the Contract requirements, prior to the effective date of termination.
