Common use of Termination of Mediation Clause in Contracts

Termination of Mediation. The mediation shall be terminated: 1) By the execution of a Settlement Agreement by the Parties; 2) By a written declaration of the mediator to the effect that further efforts at mediation are no longer worthwhile; or 3) By a written declaration of a Party or Parties to the effect that the mediation proceedings are terminated.

The mediation shall be terminated: 1terminated by: (i) By the execution of a Settlement Agreement settlement agreement; (ii) a declaration by the Parties; 2mediator that mediation is terminated; or (iii) By a written declaration by both parties (and not by one of the mediator to the effect that further efforts at mediation are no longer worthwhile; or 3parties unilaterally) By a written declaration of a Party or Parties to the effect that the mediation proceedings are terminatedis terminated at the conclusion of at least one full day's session.
