Common use of Testing for Alcohol and Drug Abuse Clause in Contracts

Testing for Alcohol and Drug Abuse. During the term of this Agreement, the Employer will not engage in the testing of bargaining unit members through the taking of blood, urine, or breath samples in order to determine if they are working under the influence of alcohol or drugs. In particular, the Employer agrees not to perform or require random testing, testing prior to promotion or the award of tenure, periodic testing, or testing as a part of any physical or psychological examinations otherwise required. The failure or refusal of a bargaining unit member to submit to such testing will not be grounds for discipline.
