Common use of Testing of Metering Equipment Clause in Contracts

Testing of Metering Equipment. Connecting Transmission Owner shall inspect and test all of its Metering Equipment upon installation and at least once every two (2) years thereafter. If requested to do so by NYISO or Developer, Connecting Transmission Owner shall, at Developer’s expense, inspect or test Metering Equipment more frequently than every two (2) years. Connecting Transmission Owner shall give reasonable notice of the time when any inspection or test shall take place, and Developer and NYISO may have representatives present at the test or inspection. If at any time Metering Equipment is found to be inaccurate or defective, it shall be adjusted, repaired or replaced at Developer’s expense, in order to provide accurate metering, unless the inaccuracy or defect is due to Connecting Transmission Owner’s failure to maintain, then Connecting Transmission Owner shall pay. If Metering Equipment fails to register, or if the measurement made by Metering Equipment during a test varies by more than two percent from the measurement made by the standard meter used in the test, Connecting Transmission Owner shall adjust the measurements by correcting all measurements for the period during which Metering Equipment was in error by using Developer’s check meters, if installed. If no such check meters are installed or if the period cannot be reasonably ascertained, the adjustment shall be for the period immediately preceding the test of the Metering Equipment equal to one-half the time from the date of the last previous test of the Metering Equipment. The NYISO shall reserve the right to review all associated metering equipment installation on the Developer’s or Connecting Transmission Owner’s property at any time.

Testing of Metering Equipment. Connecting Transmission Owner The Interconnected Entity that, pursuant to Section 8.1 of this Appendix 2, owns the Metering Equipment shall operate, maintain, inspect and test all of its Metering Equipment upon installation and at least once every two (2) years thereafter. If requested to do so Upon reasonable request by NYISO or Developerthe other Interconnected Entity, Connecting Transmission Owner shall, at Developer’s expense, the owner of the Metering Equipment shall inspect or test the Metering Equipment more frequently than every two (2) years, but in no event more frequently than three times in any 24- month period. Connecting Transmission Owner The owner of the Metering Equipment shall give reasonable notice to the Interconnection Parties of the time when any inspection or test of the owner’s Metering Equipment shall take place, and Developer and NYISO the other parties may have representatives present at the test or inspection. If at any time Metering Equipment is found to be inaccurate or defective, it shall be adjusted, repaired or replaced at Developer’s expense, in order to provide accurate metering. Where the Interconnected Transmission Owner owns the Metering Equipment, unless the expense of such adjustment, repair or replacement shall be borne by the Interconnection Customer, except that the Interconnection Customer shall not be responsible for such expenses where the inaccuracy or defect is due to Connecting caused by the Interconnected Transmission Owner’s failure to maintain, then Connecting Transmission Owner shall pay. If Metering Equipment fails to register, or if the measurement made by Metering Equipment during a test varies by more than two one percent from the measurement made by the standard meter used in the test, Connecting the owner of the Metering Equipment shall inform Transmission Owner Provider, and the Transmission Provider shall adjust inform the measurements by correcting other Interconnected Entity, of the need to correct all measurements made by the inaccurate meter for the period during which Metering Equipment was in error by using Developer’s check metersthe inaccurate measurements were made, if installed. If no such check meters are installed or if the period can be determined. If the period of inaccurate measurement cannot be reasonably ascertaineddetermined, the adjustment correction shall be for the period immediately preceding the test of the Metering Equipment that is equal to one-one- half of the time from the date of the last previous test of the Metering Equipment. The NYISO , provided that the period subject to correction shall reserve the right to review all associated metering equipment installation on the Developer’s or Connecting Transmission Owner’s property at any timenot exceed nine (9) months.

Connecting Transmission Owner Provider shall give reasonable notice of the time when any inspection or test shall take place, and Developer and NYISO Interconnection Customer may have representatives present at the test or inspection. If at any time Metering Equipment is found to be inaccurate or defective, it shall be adjusted, repaired or replaced at Developer’s Interconnection Customer's expense, in order to provide accurate metering, unless the inaccuracy or defect is due to Connecting Transmission Owner’s Provider's failure to maintain, then Connecting Transmission Owner Provider shall pay. If Metering Equipment fails to register, or if the measurement made by Metering Equipment during a test varies by more than two percent from the measurement made by the standard meter used in the test, Connecting Transmission Owner Provider shall adjust the measurements by correcting all measurements for the period during which Metering Equipment was in error by using Developer’s Interconnection Customer's check meters, if installed. If no such check meters are installed or if the period cannot be reasonably ascertained, the adjustment shall be for the period immediately preceding the test of the Metering Equipment equal to one-half the time from the date of the last previous test of the Metering Equipment. If Metering Equipment fails to register, or if the measurement made by Metering Equipment during a test varies by more than two percent from the measurement made by the standard meter used in the test, Connecting Transmission Owner National Grid shall adjust the measurements by correcting all measurements for the period during which Metering Equipment was in error by using Developer’s check meters, if installed. If no such check meters are installed or if the period cannot be reasonably ascertained, the adjustment shall be for the period immediately preceding the test of the Metering Equipment equal to one-half the time from the date of the last previous test of the Metering Equipment. If requested SERVICE AGREEMENT NO. 1757 to do so by NYISO or Developer, Connecting Transmission Owner National Grid shall, at Developer’s expense, inspect or test Metering Equipment more frequently than every two (2) years. Connecting Transmission Owner National Grid shall give reasonable notice of the time when any inspection or test shall take place, and Developer and NYISO may have representatives present at the test or inspection. If at any time Metering Equipment is found to be inaccurate or defective, it shall be adjusted, repaired or replaced at Developer’s expense, in order to provide accurate metering, unless the inaccuracy or defect is due to Connecting Transmission OwnerNational Grid’s failure to maintain, then Connecting Transmission Owner National Grid shall pay. If Metering Equipment fails to register, or if the measurement made by Metering Equipment during a test varies by more than two percent from the measurement made by the standard meter used in the test, Connecting Transmission Owner National Grid shall adjust the measurements by correcting all measurements for the period during which Metering Equipment was in error by using Developer’s check meters, if installed. If no such check meters are installed or if the period cannot be reasonably ascertained, the adjustment shall be for the period immediately preceding the test of the Metering Equipment equal to one-half the time from the date of the last previous test of the Metering Equipment. If at any time Metering Equipment is found to be inaccurate or defective, it shall be adjusted, repaired or replaced at Developer’s expense, in order to provide accurate metering, unless the inaccuracy or defect is due to Connecting Transmission Owner’s failure to maintain, then Connecting Transmission Owner shall pay. If Metering Equipment fails to register, or if the measurement made by Metering Equipment during a test varies by more than two percent from the measurement made by the standard meter used in the test, Connecting Transmission Owner shall adjust the measurements by correcting all measurements for the period during which Metering Equipment was in error by using Developer’s check meters, if installed. If no such check meters are installed or if the period cannot be reasonably ascertained, the adjustment shall be for the period immediately preceding the test of the Metering Equipment equal to one-half the time from the date of the last previous test of the Metering Equipment. The NYISO shall reserve the right to review all associated metering equipment installation on the Developer’s or Connecting Transmission Owner’s property at any time.time.‌

Connecting Transmission Owner Provider shall give reasonable notice of the time when any inspection or test shall take place, and Developer and NYISO Interconnection Customer may have representatives present at the test or inspection. If at any time Metering Equipment is found to be inaccurate or defective, it shall be adjusted, repaired or replaced at Developer’s Interconnection Customer's expense, in order to provide accurate metering, unless the inaccuracy or defect is due solely to Connecting Transmission Owner’s Provider's failure to maintain, then Connecting Transmission Owner Provider shall pay. If Metering Equipment fails to register, or if the measurement made by Metering Equipment during a test varies by more than two percent from the measurement made by the standard meter used in the test, Connecting Transmission Owner Provider shall adjust the measurements by correcting all measurements for the period during which Metering Equipment was in error by using Developer’s Interconnection Customer's check meters, if installed. If no such check meters are installed or if the period cannot be reasonably ascertained, the adjustment shall be for the period immediately preceding the test of the Metering Equipment equal to one-half the time from the date of the last previous test of the Metering Equipment. The NYISO shall reserve the right to review all associated metering equipment installation on the Developer’s or Connecting Transmission Owner’s property at any time.

Connecting Transmission Owner All such testing and inspections shall be at the expense of Interconnection Customer pursuant to Section 7.1 of this Agreement. IPA shall give reasonable notice of the time when any inspection or test shall take place, and Developer and NYISO Interconnection Customer may have representatives present at the test or inspection. If at any time Metering Equipment is found to be inaccurate or defective, it shall be adjusted, repaired or replaced at DeveloperInterconnection Customer’s expense, in order to provide accurate metering, unless the inaccuracy or defect is due to Connecting Transmission Owner’s failure to maintain, then Connecting Transmission Owner shall pay. If Metering Equipment fails to register, or if the measurement made by Metering Equipment during a test varies by more than two percent (2%) from the measurement made by the standard meter used in the test, Connecting Transmission Owner IPA shall adjust the measurements by correcting all measurements for the period during which Metering Equipment was in error by using DeveloperInterconnection Customer’s check meters, if installedinstalled and if calibrated and tested in accordance with applicable ANSI Standards. If no such check meters are installed or if the period cannot be reasonably ascertained, the adjustment shall be for the period immediately preceding the test of the Metering Equipment equal to one-half the time from the date of the last previous test of the Metering Equipment. The NYISO shall reserve the right to review all associated metering equipment installation on the Developer’s or Connecting Transmission Owner’s property at any time.

If requested to do so by NYISO or DeveloperInterconnection Customer, Connecting Transmission Owner Operating Agent shall, at Developer’s Interconnection Customer's expense, inspect or test Metering Equipment more frequently than every two (2) years. Connecting Transmission Owner Operating Agent shall give reasonable notice of the time when any inspection or test shall take place, and Developer and NYISO Interconnection Customer may have representatives present at the test or inspection. If at any time Metering Equipment is found to be inaccurate or defective, it shall be adjusted, repaired repaired, or replaced at Developer’s Interconnection Customer's expense, in order to provide accurate metering, unless the inaccuracy or defect is due to Connecting Transmission OwnerOperating Agent’s failure to maintain, then Connecting Transmission Owner Operating Agent shall pay. Transmission Developer and NYISO shall address the loss of meter data or meter data anomalies in accordance with ISO Procedures. The NYISO shall reserve the right to review all associated metering equipment installation on the Transmission Developer’s or Connecting Transmission Owner’s property at any time.

If Metering Equipment fails to register, or if the measurement made by Metering Equipment during a test varies by more than two percent from the measurement made by the standard meter used in the test, Connecting Transmission Owner shall adjust the measurements by correcting all measurements for the period during which Metering Equipment was in error by using Developer’s check meters, if installed.
