Alternative to Litigation 13.2.1 The Parties desire to resolve disputes arising out of this Agreement without litigation. Relationship to Parent Award This Agreement incorporates all the terms and conditions of the Award (AW825280CAV) as at 10 April 2006 with the exception of clauses 13, 16.2.1, 22.3.4, 22.3.5, 37.6 and 40.3. Where there is inconsistency between the Award and this Agreement, the latter will prevail but only to the extent of the inconsistency.
