The Secretary of the Army. The Secretary of the Army is responsible for the administration of Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899. Permits issued under these authorities generally require compensatory mitigation to replace aquatic resource functions and values that are unavoidably lost as a result of those permits. This agreement is set forth in compliance with 33 CFR Parts 325 and 332 published on April 10, 2008 (Federal Mitigation Rule). In addition, compensatory mitigation objectives and guidance are provided in the 1990 Memorandum of Agreement between the Environmental Protection Agency and The Department of the Army concerning the Determination of Mitigation Under the Clean Water Act Section 404(b)(1) Guidelines, where not superseded by 33 CFR Part 332.
