The Secretary’s Agreement. In exchange for US Steel’s agreements and promises, as stated in Paragraph A above, within seven (7) calendar days after the Secretary’s representative receives this Agreement signed by all Parties to this Agreement, the Secretary agrees voluntarily to withdraw with prejudice the Complaint under Federal Rule of Civil Procedure 41(a). In addition, the complaint filed by Xxxxxxx Xxxxxxx with OSHA under Section 11(c) of the Act (Complaint No.: 5-8120-14-026) will be immediately dismissed by OSHA on the Effective Date of this Agreement.
