Tie Break Process‌. In the event of tie in scoring among competing Proposals, the highest weighted criteria will be used to compare scores. Subject to the other rights and remedies which may be available to Ontario Shores, in the event that Ontario Shores would like to break a tie in order to enter into the Agreement, among the Proponents with the tied scores, the Proponent with the highest score in the highest weighted criteria will be declared the Successful Proponent. If a tie remains, Ontario Shores may choose to use the second highest weighted criteria to compare scores among the tied Proponents who also have a tied score in the highest weighted criteria, in determining the Successful Proponent.

  • Formal Process A. Step 1: If a grievant is not satisfied with the resolution proposed at the informal level, s/he may within fourteen (14) days after the supervisor's response was due file a formal written grievance with his/her manager on a form provided by the County Personnel Office containing a statement describing the grievance, the section of this Agreement allegedly violated, and remedy requested.   • Change Management Process If Customer or Oracle requests a change in any of the specifications, requirements, Deliverables, or scope (including drawings and designs) of the Professional Services described in any Statement of Work, the party seeking the change shall propose the applicable changes by written notice. Any delay caused by Tenant’s unreasonable withholding of its consent or delay in giving its written approval as to such working drawings shall constitute a Tenant Delay Day (defined below). If the working drawings are not fully approved (or deemed approved) by both Landlord and Tenant by the 15th business day after the delivery of the initial draft thereof to Tenant, then each day after such time period that such working drawings are not fully approved (or deemed approved) by both Landlord and Tenant shall constitute a Tenant Delay Day.
