Subprojects. 1. Without limitation upon the provisions of parts B and C of this Section, the Borrower, through MARENASS, shall monitor the activities of the Subprojects in accordance with the provisions of this paragraph and those of the Operational Manual that include, inter alia:
(a) the administrative rules and procedures for the planning, preparing, proposing, selecting, contracting, financing, implementing, supervising, monitoring and evaluating Subprojects;
(b) an indigenous peoples’ framework setting forth the strategies, procedures, activities, and monitoring indicators addressing, in a culturally appropriate manner, indigenous peoples’ concerns in the implementation of the Project, as well as for planning, preparation and proposals of Subprojects;
(c) the environmental criteria for screening and selecting Subprojects, and mandatory safeguards and mitigation actions for any such Subprojects, which could possibly have a negative environmental impact; and
(d) the procedures related to the manufacturing, packaging, labeling, handling, storing, and disposal of any pesticides used in the carrying out of Subprojects.
2. The Borrower, through MARENASS, shall furnish to the Bank, along with each Loan withdrawal application, a list of the respective Subprojects for which it is seeking reimbursement.
3. The Subprojects shall be carried out pursuant to an agreement (the Subproject Agreement), to be concluded between the Borrower, through MARENASS and the Subproject beneficiary (ies) under terms and conditions described in the Operational Manual, which shall include, inter alia, the following:
(a) a copy of the approved activity with its budget, pre-investment study, disbursement and performance indicators;
(b) the obligation of the Subproject beneficiary(ies) to: (i) carry out the activities with due diligence and efficiency and in accordance with sound administrative, financial, agricultural, social, natural and environmental standards and in accordance with the provisions of the Operational Manual; (ii) maintain adequate records to reflect, in accordance with simple and sound accounting practices defined in the Operational Manual, the operations, resources and expenditures in respect of the Subproject; (iii) maintain adequate reporting in accordance with the standards specified in the Operational Manual; and (iv) make a contribution in kind or/and in cash as defined in the Operation Manual;
(c) the requirement that: (i) the goods, works and services to be financed from ...
Subprojects. 1. The Borrower shall make Grants to Beneficiaries for Subprojects in accordance with eligibility criteria and procedures acceptable to the Bank as further detailed in the Project Operational Manual, including approval procedures to be followed by the Microcatchment Development Committee.
2. The Borrower shall, through SEAPPA, enter into Grant Agreements appropriate for the carrying out of Components 1 and 2 of the Project, such agreements to be made in accordance with terms of the respective draft set forth in model forms approved by the Bank and included in the Project Operational Manual, in which the Borrower shall obtain rights adequate to protect its interests and those of the Bank, including the right to: (1) suspend or terminate the right of Beneficiaries to use the proceeds of the Grant, or obtain a refund of all or any part of the amount of the Grant then withdrawn, upon the Beneficiaries’ failure to perform any of its obligations under the Grant Agreement; and (2) require each Beneficiary to: (a) carry out its Subproject with due diligence and efficiency and in accordance with sound technical, agricultural, economic, financial, managerial, environmental and social standards and practices satisfactory to the Bank, including in accordance with the provisions of the Anti-Corruption Guidelines applicable to recipients of Loan proceeds other than the Borrower, the Project Operational Manual, the Environmental Management Framework and the Involuntary Resettlement Framework; (b) provide, promptly as needed, the resources required for the purpose; (c) procure the goods, works and services to be financed out of the Grant in accordance with the provisions of this Agreement; (d) maintain procedures adequate to enable it to monitor and evaluate in accordance with indicators acceptable to the Bank, the progress of the Subproject and the achievement of its objectives; (e)
(i) maintain a simplified financial management system and records in accordance with consistently applied accounting standards acceptable to the Bank for community driven initiatives, both in a manner adequate to reflect the operations, resources and expenditures related to the Subproject; and (ii) at the Bank’s or the Borrower’s request, have such financial statements audited by independent auditors acceptable to the Bank, in accordance with consistently applied auditing standards acceptable to the Bank, and promptly furnish the statements as so audited to the Borrower and the Bank; (f) enab...
Subprojects. Notwithstanding the provisions of the aforementioned paragraphs, services to assist Beneficiaries in carrying out Subprojects estimated to cost the equivalent of up to $1,000,000 under Part C.2 and C.3 of the Project, may be procured in accordance with commercial practices acceptable to the Association, as set forth in the POM. Subprojects. Notwithstanding the provisions of the aforementioned paragraphs:
(a) Works and goods for Subprojects estimated to cost up to $1,000,000 equivalent, procured by a Beneficiary selected using competitive procedures under the Guidelines, may be procured in accordance with commercial practices acceptable to the Association, as set forth in the POM. 3.13 of the Guidelines. Part D: Review by the Association of Procurement Decisions
Subprojects. 1. The Borrower shall ensure that all Subprojects are appraised, approved, implemented, and monitored and evaluated, and the Subproject Grants are administered in accordance with the eligibility criteria and the administration arrangements and procedures set forth or referred to in this Part D and in more detail in the Operational Manual.
2. Subproject proposals may be submitted for approval to the District AIDS Coordinator by Beneficiaries, by the Technical Sub-Committee on its own initiative or by the Programs Committee following consultation with the Bank, as the case may be, in every case in accordance with the rules and procedures set forth in the Operational Manual, which Manual sets forth details, inter alia, of: (a) eligibility criteria for Beneficiaries and for activities to be financed by Subproject Grants; (b) arrangements and procedures for the preparation, appraisal, approval, implementation and supervision of activities to be financed by Subproject Grants; (c) procurement, financial management and disbursement arrangements; (d) performance indicators; (e) standard formats for Subproject Grant Agreements; and (f) such other legal, administrative, financial and organizational arrangements as shall be required for providing Subproject Grants.
Subprojects. For the purposes of carrying out Parts 2 (a), (b) and (c) of the Project, the Borrower, through CONAGUA, shall:
(1) after having selected a Technical Assistance Subproject, an Efficiency Subproject, or an Output-based Subproject, as the case may be, in accordance with the guidelines and procedures set forth in the Operational Manual (for Technical Assistance and Efficiency Subprojects) and in the OBD Operational Manual (for Output-based Subprojects), enter into an agreement with an Eligible PWU (the Technical Assistance Subproject Agreement, the Efficiency Subproject Agreement, and the Output-based Subproject Agreement, respectively), under terms and conditions acceptable to the Bank, for the provision of Financing for the implementation of a Technical Assistance Subproject, an Efficiency Subproject or an Output-based Subproject, as the case may be; and
(2) exercise its rights under each Technical Assistance Subproject Agreement, Efficiency Subproject Agreement or Output-based Subproject Agreement, as the case may be, in such manner as to protect the interests of the Borrower and the Bank and to accomplish the purposes of the Loan. Except as the Bank shall otherwise agree, the Borrower shall not assign, amend, abrogate, waive or fail to enforce any Technical Assistance Agreement, Efficiency Subproject Agreement, or Output-based Subproject Agreement or any provision thereof.
Subprojects. The Effectiveness Deadline is the date ninety (90) days after the date of this Agreement.
Subprojects. The Project Implementing Entity shall ensure that Subprojects are carried out in accordance with the provisions of Section I.E of Schedule 2 to the Financing Agreement.
Subprojects. The Project Implementing Entity shall ensure that each PFI: (a) selects MSEs and Subprojects in accordance with the criteria and procedures set forth in the Operational Manual; and (b) enters into a Subloan Agreement with each MSE for the purpose of making a Subloan to such MSE, in accordance with the terms and conditions set forth in the Operational Manual.
Subprojects. (a) The Borrower shall ensure that Subprojects under Part C of the Project are identified, appraised, approved, implemented and monitored in accordance with the procedures set forth in the Operational Manual.
(b) Beneficiaries for any Subgrant provided for under Part C of the Project must meet the eligibility criteria agreed with the Association, and set forth in the Operational Manual.
(c) The Borrower shall enter into a Subproject Agreement, satisfactory to the Association, with the proposed Beneficiary with terms and conditions which shall include the following:
(i) the Beneficiary shall carry out the Subproject with due diligence and efficiency, in accordance with sound technical, financial, environmental, resettlement and managerial standards; the Beneficiary shall maintain adequate records reflecting the operations, resources and expenditures incurred under the Subproject in accordance with sound accounting practices; the goods, works or services financed from the proceeds of the Grant shall be procured in accordance with the procedures set forth in Schedule 3 to this Agreement, and used exclusively for the implementation of the Subproject; the right of the Borrower, to inspect by itself, or jointly with the Association, if the Association shall so request, the goods, works, and operations thereof, and any relevant records or documents; the right to obtain all information the Borrower or the Association shall reasonably request regarding the administration, operation and financial condition of the Beneficiary; the right to receive from the Beneficiary semi-annual progress reports and a final report on the completion of the Subproject; and the right to suspend or terminate the right of the Beneficiary to the use of the proceeds of the Subgrant for the Subproject, upon failure by the Beneficiary to perform any of its obligations under the Subproject Agreement.
