Time is of the Essence, Equipment Delivery Date Sample Clauses

Time is of the Essence, Equipment Delivery Date. In the performance of the duties established in this Agreement, time is of the essence, as a delay in placing the new school bus into active service would result in the continued use of the higher-polluting older bus. Such use would result in the unnecessary exposure of school children to air toxics (diesel particulate matter) and in the additional discharge of greenhouse gases. Such emissions would have an adverse effect on air quality within the affected air district and may cause or contribute to a violation of an ambient air quality standard. Delivery of the new bus to the Grantee must occur on or before May 1, 2023 (“Final Delivery Date”). Delivery of the new school bus after the “Final Delivery Date” would be considered a Grantee Default of this Agreement and subject to the terms of Section 6.2 of this Agreement.
