Common use of Time Limitation on Waiver Clause in Contracts

Time Limitation on Waiver. 1. A grievance shall not be valid unless the grievance is submitted in writing to the Director of Business Services setting forth the facts of the grievance, the specific provisions of the Agreement allegedly violated, and the relief requested within 15 days from the date of the alleged grievance occurred. Failure to file within the 15-day period shall constitute a waiver of the grievance. 2. Failure to appeal a grievance from one level to another within the time periods provided shall constitute a waiver of the grievance. 3. The time periods indicated at each step of the grievance procedure shall be considered a maximum and every effort shall be made to expedite the grievance process. 4. The time periods indicated at each step of the grievance procedure may be extended by mutual written consent. 5. Failure of the School District to respond within the time periods indicated at each step of the grievance shall constitute a denial of the grievance and may be appealed to the next step.
