OVERTIME AND CALL BACK a. Overtime shall be paid or comp time accrued at a rate of time and one-half of the employee’s regular rate for all time worked in excess of an employee’s shift or work period as follows: (i) Eight (8) hour shift or eighty (80) hours in a fourteen (14) day period. (ii) Ten (10) hour shift or eighty (80) hours in a fourteen (14) day period. (iii) Twelve (12) hour shift or eighty (80) hours in a fourteen (14) day period. b. Overtime shall not be compounded or paid on overtime. For all employees, time spent on vacation, sick leave, or any other paid leave shall count as hours worked for computing overtime pay. Section 2. In all calculations of regular overtime, whether paid or compensatory time, time worked prior to or immediately following an employee's regular shift (except pre-shift briefing time used with eight (8) hour shifts) shall be rounded up to the nearest quarter hour where more than seven and one-half (7 ½) minutes and rounded down to the nearest quarter hour where less than seven and one-half (7 ½) minutes. The excess of any overtime worked which is less than seven and one-half (7 ½) minutes shall be dropped and the excess of any overtime worked which is more than seven and one-half (7½) minutes shall be rounded up to the nearest quarter hour. Section 3. Upon request by an employee's supervisor or other representatives of departmental management, employees shall be required to work overtime assignments; however, upon presentation of an excuse acceptable to management, such employee may be relieved from working the overtime assignment. Section 4. An employee who is called back to duty during normal off-duty hours, which is not contiguous to his regular work shift, shall be compensated for a minimum call back of two (2) hours, regardless of whether advance notice was given. Should more than two (2) hours be required, he shall be compensated for the hours actually worked as provided for in Sections l and 5 of this Article. With supervisor approval, an employee who is called on the telephone, while off-duty, to respond to official departmental related matters shall be compensated for such time in no less than (15) fifteen minute increments. Detectives and their Supervisors, who are placed on call shall receive two hours of overtime, either in pay or compensatory time, for each week they are placed on call. Section 5. Overtime shall be compensated at time and one-half the employee’s hourly rate of pay and will be paid for all work time scheduled by the District in excess of eight (8) hours in one day or forty (40) hours in one week. The overtime rate shall also apply to work performed on Saturdays and Sundays unless such days fall within an employee’s regular workweek assignment. 2. There shall be four (4) scheduled days off in every two (2) week period. Patrol Division: For purposes of computation of overtime compensation, overtime shall mean actual hours worked in excess of eighty (80) hours in a fourteen (14) day work period. Sick leave shall be computed as hours worked provided that sick leave is not used three (3) calendar days before, or after, additional hours are worked. Other Divisions: For purposes of computation of overtime compensation, overtime shall mean actual hours worked in excess of forty (40) hours in a seven (7) day work period. Vacation, compensatory time used and holiday pay shall be computed as hours worked. Sick leave shall be computed as hours worked provided that sick leave is not used three (3) calendar days before, or after, additional hours are worked. Overtime shall be paid at one and one-half (1 1/2) times the Employee’s regular rate of pay, as defined by the Department of Labor Regulations, Fair Labor Standards Act. Section 2. A member of the bargaining unit shall receive a minimum of two (2) hours pay when working special events or other scheduled additional duty, or when testifying in court. Premium pay, with three (3) hours being minimum, at one and one-half (1 1/2) times the Employee's regular rate of pay shall be paid for all hours worked when the Employee is called back to work due to an emergency. If more than one call back is worked during the same three hour period, the Employee is only entitled to one three (3) hour’s call back pay, In the event an employee is required to work in excess of the minimum hours listed above in this section, the additional time will be paid at a rate consistent with Section 1 of this article. For the purposes of compensation, call back time begins when the initial call is made to the Employee, and the call back period ends when the employee leaves his/her work site. In the instance travel time to the work site exceeds thirty (30) minutes, a maximum of thirty (30) minutes travel time will count as paid time.

(b) Casual, regular and temporary part-time nurses shall be paid overtime at the rate of one and one half (11/2) times their basic hourly rate for all hours worked in excess of the posted and confirmed schedule or seven and one half (7 1/2) hours whichever is greater. (a) Nurses required by the Employer to work on their scheduled day(s) off, shall be entitled to pay at the overtime rate of time and one-half (1 1/2) for all hours so worked. In the case of regular and temporary full-time nurses such hours shall not be included in the averaging period. (b) An other than regular or temporary full-time nurse who is called in to work on an unscheduled work day will be paid their regular straight time hourly rate for all hours worked. 22.03 A nurse who is called back from on-call or is requested to return to work after the completion of their shift shall be paid a premium at the rate of time and one-half (1 1/2) their straight time hourly rate for all hours worked during such period or for four (4) hours at time and one-half (1 1/2), whichever is greater. In the case of regular and temporary full-time nurses hours worked on call-back shall not be included in the averaging period. 22.04 In the case of regular or temporary full-time nurses, time off in lieu of pay for overtime worked or call back in accordance with Article 22.03 (calculated at the appropriate overtime or call back rate) may be granted by the Employer upon the request of the nurse. The nurse's request to bank such hours must be conveyed to the Department Manager or designate within five (5) working days following the two (2) week averaging period in which the overtime or call back was performed. If such time off cannot be scheduled at a mutually agreeable time within the fiscal year ending March 31st in which it was accumulated the nurse shall receive pay at the appropriate overtime rate for all such overtime hours. 22.05 Double (2X) the equivalent hourly rate will be paid to a nurse for all additional hours worked following the completion of seven and one-half (7 1/2) hours on a paid holiday or on a nurse's scheduled day(s) off.

After the two (2) hours, overtime shall be paid in increments as defined in section 6.3 by the employer. 6.5 An employee shall be entitled to overtime pay when off shift and required to attend a meeting or training.
