TIMEISESSENCE. Time is of essence for the Promoter as well as the Allottee. The Promoter shall abide by the time schedule forcompletingtheprojectandhandingoverthe[Apartment/Plot]totheAllotteeandthecommonareastotheassociationof the allottees after receiving the occupancy certificate* or the completion certificate or both, as the case may be.Similarly,theAllotteeshallmaketimelypaymentsoftheinstallmentandotherduespayablebyhim/herandmeetingthe other obligations under the Agreement subject to the simultaneous completion of construction by the Promoteras provided in Schedule C ("Payment Plan").

The Promoter shall abide by the time schedule for completing theProject as disclosed at the time of registration including extension,if any, of the Project with the Authority and towards handing overthe Said Apartment And Properties Appurtenant Thereto to theAllotteeandtheCommonAreastotheAssociation,afterreceivingtheOccupan cyCertificateorCompletionCertificateorsuchothercertificatebywhatevername calledissuedby the competent authority under the Act for the Project subject toformationoftheAssociationandunlesspreventedbycircumstances beyond its control and/or by any ForceMajeureevent(s). Similarly, the Allottee shall make timely payments of theinstallment and other dues payable by him/her and meeting theotherobligationsundertheAgreementsubjecttothesimultaneouscompletio nofconstructionbythePromoterasprovidedinScheduleC(“PaymentPlan”).
TIMEISESSENCE. ThePromotershallabidebythe timescheduleforcompletingthe projectasdisclosed at the time of registration of the project with the Authority and towards handing over the Apartment to the Allottee and the common areas to the association of allottees or the competent authority, as the case may be, subject to force majoras describe in 7.1. Similarly the Allottee shall pay all accounts payable as per payment Plan (Schedule-C) as and whendue &demanded.

The Vendors/Developer shall abide by the time schedule for completing the project and handing over the Apartment to the Allottee(s) and the common areas to the association of the Allottee(s) after receiving the occupancy certificate or the completion certificate or both, as the case may be. Similarly, the Allottee(s) shall make timely payments of the instalment and other dues payable by him/ her/them and meeting the other obligations under the Agreement subject to the simultaneous completion of construction by theVendors/Developer as provided in Schedule ‘C’ ("Payment Plan").
TIMEISESSENCE. The Promoter shall abide by the time schedule for completing the Project as disclosed at the time of registration of the Project with the Authority and towards handing over the Apartment/ Plot to the Allottee and the common areas to the Maintenance Society or the competent authority, as the case may be.
TIMEISESSENCE. ThePromotershallabidebythetimescheduleforcompletingthe project as disclosed at the time of registration of the project with theAuthority and towards handing over the Apartment along with the rightto car park (A) for four xxxxxxx AND the right to two xxxxxxx park (B)fortwowheelertotheAllotteeandthecommonareastotheassociationofal lottees orthecompetentauthority,asthecasemaybe. 6 CONSTRUCTIONOFTHEPROJECT/APARTMENT: The Allottee has seen the proposed lay out plan, specifications, amenitiesand facilities of the Apartment and accepted the floor plan, payment planand the specifications, amenities and facilities[annexed along with thisAgreement]whichhasbeenapprovedbythecompetentauthority,asreprese nted by the Promoter. The Promoter shall develop the Project inaccordancewiththesaidlayoutplans,floorplansandspecifications,amenities andfacilities.SubjecttothetermsinthisAgreement,thePromoterundertakestost rictlyabidebysuchplansapprovedbythecompetent Authorities and shall also strictly abide by the bye-laws, FARanddensitynormsandprovisionsprescribedbytheChinsurahMunicipali tyandshallnothaveanoptiontomakeanyvariation/alteration/modification in such plans, other than in the mannerprovided under the Act, and breach of this term by the Promoter shallconstituteamaterialbreachoftheAgreement.
