Timing for Completion and Placement into Service of Initial Gathering System. As of the Effective Date, Gatherer has completed the initial design and preliminary engineering of the Gathering System. In addition to the Connection Notice as provided in Section 3.3(b) above, Producer shall provide Gatherer with 365 days prior written notice of the requirement for Gatherer to construct and startup and operate the initial Gathering System at Gatherer’s sole cost and expense. Notwithstanding anything contained herein to the contrary, Gatherer shall have no obligation to provide the Services to Producer and Shipper hereunder unless and until Producer provides notice to Gatherer pursuant to this Section 3.4 for Gatherer to construct and startup the initial Gathering System.

Timing for Completion and Placement into Service of Initial Gathering System. As of the Effective Date, Gatherer shall have completed, and shall have caused Gatherer’s Designee to complete, the initial design and preliminary engineering of the initial portion of the Gathering System. In addition to the Connection Notice as provided in Section 3.3(b) above, Producer shall provide Gatherer with 345 days prior written notice of the requirement for Gatherer to construct, startup and operate (or cause to be constructed, started up and operated) the initial Gathering System at Gatherer’s and Gatherer’s Designee’s, as applicable, sole cost and expense. Notwithstanding anything contained herein to the contrary, Gatherer shall have no obligation to provide the Services to Producer and Shipper hereunder unless and until Producer provides notice to Gatherer pursuant to this Section 3.8 for Gatherer to construct and startup the initial Gathering System.

  • PROCEDURES SPECIFIC TO CUSTOM BASKETS The Fund has developed custom creation, redemption and other non-typical baskets (the “Custom Baskets”). Custom Baskets are intended to allow the Participant to transact in a Fund and other non-standard baskets using the Custom Basket process. The Custom Basket process allows for cash-in-lieu for certain securities as well as non-typical baskets and continues to settle through the standard CNS process at NSCC. It is the responsibility of the Participant to apply to the NSCC by contacting DTCC Participant Services at 000-000-0000 and the Transfer Agent at 000-000-0000 to allow them to receive Custom Baskets as well as the regular daily standard baskets (the “Standard Baskets”). To ensure proper tracking of a Fund to its benchmark index the following guidelines must be followed when transacting Custom Baskets:
