Title to Water. Indemnification. Title to all water supplied to Talty shall be in the City up to a Point of Delivery, at which point title shall pass to Talty, except that the NTMWD reserves the right of reuse of treated effluent resulting from the use of water by the NTMWD, its customers or Talty, to the extent authorized by the State of Texas. The NTMWD, the City, and Talty shall save and hold each other harmless from all claims, demands, and causes of action, which may be asserted by anyone on account of the transportation and delivery of said water, while title remains in such party. Notwithstanding anything contained herein to the contrary, the parties hereto do not waive and hereby expressly retain any and all immunities and defenses, sovereign, legislative, official, and otherwise, that each may now or hereafter possess. Nothing contained in this Contract shall be interpreted as conferring any rights to any person not a party to this Contract
