Common use of Transfer of Employees Out of the Justice Institute Bargaining Unit Clause in Contracts

Transfer of Employees Out of the Justice Institute Bargaining Unit. When the parties are made aware that employees will be transferred out of the Justice Institute bargaining unit to a corporation, board, agency or commission, a joint employer/union committee shall immediately be established. The Committee shall be established to facilitate the orderly transfer of employees. This clause does not cover secondment of employees. Where such transfers occur, those transferred employees will be recognized as in-service applicants when applying for regular positions in The Justice Institute bargaining unit for a period of one year from the effective date of the transfer. This clause does not cover secondment of employees.
