TRANSPORTATION - GENERAL PROVISIONS. (a) The EMPLOYER shall submit to AGMA and to the AGMA delegates the proposed itinerary of any tour and shall submit in writing to AGMA a statement concerning the proposed method of transportation to be used during the tour. Both such reports shall be submitted at least thirty (30) days preceding the first (1st) day of any tour. Two (2) copies of the tour itinerary will be made available to each ARTIST not later than two (2) weeks prior to the commencement of the tour. Any additions or changes in the itinerary must be announced to the ARTISTS at least one (1) week in advance of such change, or as soon as such information is available. (b) No ARTIST shall leave the City of Origination for work outside said city unless the EMPLOYER, prior to the ARTIST’s departure ▇▇▇▇▇▇▇▇▇, has provided and paid for their transportation and their baggage in accordance with the foregoing provisions, including return transportation back to the City of Origination, and can provide proof thereof to AGMA. AGMA reserves the right to set up other terms and conditions for granting permission to the EMPLOYER to take any ARTISTS for an engagement, series of engagements or tours outside of the United States of America, as AGMA deems necessary to insure the safe transportation and return of the ARTISTS and as provided for in the standard Overseas Rider attached hereto. (c) The EMPLOYER agrees to compile a listing of doctors and physical therapists (suitable for treating the types of strain/injury usually sustained by dancers) in each city and town in which the Colorado Ballet is scheduled to perform. The list shall be posted on the tour schedule together with all other necessary information (i.e. banks). The EMPLOYER and AGMA assume no responsibility or liability for the information provided to the ARTISTS. It is the sole responsibility of the ARTIST to ascertain the proper credentials of any person so stated on this information sheet. (d) Whenever any ARTIST shall work for the EMPLOYER outside the City of Origination, the EMPLOYER shall provide and pay for the transportation of such ARTIST from the City of Origination to such point or points outside and the ARTIST’s return transportation to the City of Origination. However, any ARTIST who chooses to travel and find accommodations separate from those provided for the main group by the EMPLOYER will be responsible for their own transfers and additional/other travel to and from rehearsal and performance venues and transportation depots (airports, train stations, bus stations, etc.). (e) The EMPLOYER also agrees to pay, upon presentation of receipts, all transportation charges which may be required of the ARTIST by the EMPLOYER during the course of a trip, such as taxi fares between terminals, and also transportation expenses incurred for doctor or emergency due to illness or injury on tour.

The EMPLOYER agrees to compile a listing of doctors and physical therapists (suitable for treating the types of strain/-injury usually sustained by dancers) in each city and town in which the Colorado Ballet company is scheduled to perform. The list of the doctors' names shall be posted listed on the tour schedule together with plus all other necessary information (i.e. banks). The EMPLOYER and AGMA assume no responsibility or liability for the information provided to the ARTISTS. It is the sole responsibility of the ARTIST to ascertain the proper credentials of any person so stated on this information sheet.
(d) d. Whenever any ARTIST shall work for the EMPLOYER outside the City of Origination, the EMPLOYER shall provide and pay for provide, at the EMPLOYER’S expense, transportation of such ARTIST from the City of Origination to such point or points outside and the ARTIST’s ’S return transportation to the City of Origination. b. Thereafter, The EMPLOYER ATLANTA BALLET shall submit to AGMA and to the AGMA delegates the Representatives a proposed itinerary of any tour and shall submit in writing to AGMA a statement concerning statementconcerning the proposed method of transportation to be used during the tour. Both the itinerary and the transportation arrangements shall be subject to change. Both such reports shall be submitted at least thirty (30) days preceding the first (1st) day of any tour.
c. The AGMA Representatives will each receive a copy of the most up to date itinerary notlater than two (2) weeks prior to the departure date. Two (2) copies of the tour itinerary will be willbe made available to each ARTIST not later than two (2) weeks prior to the commencement of the tour. Any additions or changes in the itinerary must be announced to the ARTISTS at least one (1) week in advance of such change, or as soon as such information is available.
(b) No ARTIST shall leave the City of Origination for work outside said city unless the EMPLOYER, prior to the ARTIST’s departure ▇▇▇▇▇▇▇▇▇, has provided and paid for their transportation and their baggage in accordance with commencementof the foregoing provisions, including return transportation back tour. Mail will be forwarded from the company office to the City of Origination, and can provide proof thereof to AGMA. AGMA reserves the right to set up other terms and conditions for granting permission to the EMPLOYER to take any ARTISTS for an engagement, series of engagements or tours outside of the United States of America, as AGMA deems necessary to insure the safe transportation and return of the ARTISTS and as provided for in the standard Overseas Rider attached heretoon tour every two (2) weeks.
(c) The EMPLOYER agrees to compile a listing of doctors and physical therapists (suitable for treating the types of strain/injury usually sustained by dancers) in each city and town in which the Colorado Ballet is scheduled to perform. The list shall be posted on the tour schedule together with all other necessary information (i.e. banks). The EMPLOYER and AGMA assume no responsibility or liability for the information provided to the ARTISTS. It is the sole responsibility of the ARTIST to ascertain the proper credentials of any person so stated on this information sheet.
(d) d. Whenever any ARTIST shall work for the EMPLOYER The ATLANTA BALLET outside the City of Cityof Origination, the EMPLOYER The ATLANTA BALLET shall provide and pay for the suitable and appropriate transportation and accommodations. The ATLANTA BALLET will pay for transportation of such ARTIST from the City of Origination to such point or points outside and outsideand the ARTIST’s ’S return transportation to the City of Origination. However, The ATLANTA BALLET shall not require any ARTIST to use his/her own vehicle for travel outside the City of Origination. At ATLANTA BALLET’S discretion, an ARTIST may be asked to drive a rental car or use his/her own vehicle. If ARTIST agrees to use his/her own vehicle for that purpose, The ATLANTA BALLET shall reimburse the ARTIST at the allowable IRS rates. The ATLANTA BALLET will continue its past practice of engaging quality transport and where available recognizable national hotel chains.
e. If an ARTIST under any type of employment contract who chooses is required to travel or be outside the City of Origination at any time during the week which is neither a Rehearsal Week nor a Performance Week, they shall be paid not less than the applicable meal money as set forth in Paragraph 20 (c) (iv) for each day (beginning at midnight and find ending the following midnight) or part thereof, and The ATLANTA BALLET will provide and pay for hotel accommodations separate from those provided for the main group by the EMPLOYER will be responsible for their own transfers and additional/other travel to and from rehearsal and performance venues and transportation depots (airports, train stations, bus stations, etc.)travel.
(e) f. The EMPLOYER ATLANTA BALLET also agrees to pay, upon presentation of receipts, all transportation for alltransportation charges which may be required of the ARTIST by the EMPLOYER The ATLANTA BALLET during the course of a trip.
g. The ATLANTA BALLET agrees, that in the event the ARTIST while on tour shallbe required to perform or rehearse in any town at a place further than one-half (1/2) mile from a central point near where the majority of the ARTISTS shall be quartered, then transportation to and from such place be provided for all ARTISTS by The ATLANTA BALLET at its own expense. If the ARTIST is scheduled for rehearsal outside the theater ofperformance, The ATLANTA BALLET will grant the ARTIST sufficient time to allow the ARTIST travel time to reach the theater of performance.
h. No travel shall commence between midnight and 7:00 A.M. Travel commencing prior to midnight but ending after midnight shall be followed by twelve (12) hours rest before the next service unless delays have been caused by events over which The ATLANTA BALLET has no control. When on tour outside the City of Origination, no travel shall commence until two and one half (2 ½) hours after a performance, except whenreturning to the City Of Origination.
i. The ATLANTA BALLET will pay overtime beyond ten (10) hours in a day, if The ATLANTA BALLET or its travel agent(s) schedules travel in excess of ten hours, in one-quarter (1/4) hour segments. ARTISTS required to render services or perform after theeighth (8th) hour of required service on a travel day shall be compensated at the Overtime Rate. Travel will be counted from baggage call to arrival location, such as taxi fares between terminals, time to include lunch stops and also transportation expenses incurred rest stops. Baggage call may be prior to 7:00 A.M. without penalty. The ATLANTA BALLET will not be responsible for doctor or emergency payment of the overtime travel penalty contained in this Paragraph if the excess travel time was due to illness inclement weather, mechanical failure, traffic accidents, or injury unforeseen delays caused by emergency security measures beyond the control of The ATLANTA BALLET. Overseas travel will be discussed and negotiated on toura case-by-case basis on an Overseas Rider.
j. The ATLANTA BALLET will not schedule or request that the ARTIST be at service less than three

However, any The EMPLOYER will use its best efforts to accommodate the requests of ARTISTS for changes to the company itinerary. The ARTIST who chooses to travel and find accommodations separate from those provided shall reimburse the EMPLOYER for the main group all additional expenses incurred by the EMPLOYER will by reason of such change(s) and shall be responsible for their own transfers and additional/other travel to and from rehearsal and performance venues and transportation depots (airports, train stations, bus stations, etc.)individual itinerary.
(ec) The EMPLOYER also agrees to pay, pay upon presentation of receipts, receipts for all transportation charges which may be required of the ARTIST by the EMPLOYER during the course of a trip, such as taxi fares between terminals, etc. and also transportation expenses incurred for doctor or emergency due to illness or injury on tour.
(d) EMPLOYER shall insure that all pieces being taken on tour shall be given at least one (1) full run-through prior to leaving for tour, in addition to the Dress Rehearsal at the performance location prior to the first (1st) performance of a program.
(e) EMPLOYER will cast tour assignments in such a way so as to ensure that every ARTIST performing on tour has realistic Cover that can actually perform that role without it interfering with any other roles for which such ARTIST is responsible. All ARTISTS assigned to Cover a role that will be performed during such tour shall participate in the entire length of such tour as long as the role is required. Best efforts shall be made to provide each Cover with no less than two (2) studio run-through rehearsals so as to be able to perform their Cover role should it become necessary to perform for any reason. In the event that both the Cast ARTIST and the Cover are not able to perform, this would be considered an emergency situation and the above conditions do not apply.
