Transportation to places of Performance or Rehearsal. The EMPLOYER agrees that if the ARTIST while on tour only is required to perform or rehearse at a place further than one-half (1/2) mile from a central point near which the majority of the ARTISTS shall be quartered (to be mutually agreed upon by the ARTISTS and the EMPLOYER), then bus or similar transportation to and from such place be provided for all ARTISTS by the EMPLOYER at its own expense. If the ARTIST is scheduled for rehearsal outside the theater of performance, the EMPLOYER will grant the ARTIST sufficient time to allow the ARTIST travel time to reach the theater of performance in addition to the time requirements of Paragraph 60. In the event of inclement weather, or if the route between the hotel and the theater is mutually deemed by the AGMA delegate and the EMPLOYER to be unsafe, a bus shall be available to ARTISTS one- half (1/2) hour after Curtain Time to provide transportation to the hotel. Similarly, if there are no eating facilities available, the EMPLOYER shall make arrange to transport ARTISTS to and from a restaurant or deliver food to the ARTISTS.

If the ARTIST is scheduled for rehearsal outside the theater of performance, the EMPLOYER will grant the ARTIST sufficient time to allow the ARTIST travel time to reach the theater of performance in addition to the time requirements of subparagraphs 77(b) and 78(g). In the event of inclement weather, or if the route between the hotel and the theater is mutually deemed by the AGMA delegate and the EMPLOYER to be unsafe, a bus or similar transportation shall be available to ARTISTS one-half (½) hour after Curtain Time to provide transportation to the hotel. Similarly, if there are no eating accommodations available, the EMPLOYER shall make provision to transport ARTISTS to and from a restaurant or provide service of food. The EMPLOYER shall not infringe upon the allotted free time after a travel call. Prior to the first scheduled rehearsal, ARTIST'S use of free time for class or personal warm-up may not be infringed upon (i.e. for costume fittings).

In the event of inclement weather, or if the route between the hotel and the theater is mutually deemed by the AGMA Delegate and the EMPLOYER to be unsafe, a bus shall be available to ARTISTS one-half (1/2) hour after curtain time to provide transportation to the hotel. Similarly, if there are no eating accommodations available, the EMPLOYER shall make provisions to transport ARTISTS to and from a restaurant or provide service of food.
Transportation to places of Performance or Rehearsal. On tour, the Employer shall provide and pay for transportation for Artists to and from places of performance and rehearsal. Transportation shall be by bus or similar transportation, e.g. taxi, private car, or public transportation (only when deemed safe by both the AGMA Delegate(s) and the Employer.) If the Artist is scheduled for rehearsal outside the theater of performance, the Employer will grant the Artist sufficient time to allow the Artist travel time to reach the theater of performance in addition to the time requirements of Sections 9.D.2 and 9.E.6. (i) In the event of inclement weather the Employer shall provide, or (ii) if the AGMA delegate asserts to the Employer that the route between the hotel and the theater is unsafe, the Employer shall not unreasonably withhold its consent to provide, a bus to Artists to the theater and one-half (1/2) hour after Curtain Time to provide transportation to the hotel. Similarly, if there are no eating accommodations available, the Employer shall make provision to transport Artists to and from a restaurant or provide service of food. Travel time (based on Google Maps estimates) between the hotel and the place of performance or rehearsal beyond thirty (30) minutes shall be considered hours worked.

  • Standards of Performance Provider must perform all Services required of it under this Agreement with that degree of skill, care, and diligence normally shown by a Provider performing services of a scope, purpose, and magnitude comparable with the nature of the Services to be provided under this Agreement. Provider acknowledges that, if in the course of providing Services hereunder, it is entrusted with or has access to valuable and confidential information and records of the Board, Provider agrees to be held to the standard of care of a fiduciary with respect to that information. Any review, approval, acceptance of Services or deliverables, or payment by the Board for any Services does not relieve Provider of its responsibility for the professional skill and care and technical accuracy of its Services and deliverables. This provision in no way limits the Board’s rights against Provider under this Agreement, at law or in equity. When and where applicable, all members of Provider’s staff must hold and maintain throughout the Term and any Renewal Term, valid certificates and/or licenses from the State of Illinois or such other relevant jurisdiction that authorize those individuals to perform the Services. Provider agrees to promptly furnish a copy of the license(s) of any and all direct service providers to the Board on request. Throughout the Term and any Renewal Term, Provider must maintain and use sufficient staff to assure the effective and efficient operation of its programs. Provider must cause its staff to devote such time, attention, skill, knowledge, and professional ability as necessary to effectively and efficiently fulfill Provider’s obligations under this Agreement.

  • Standard of Performance Consultant represents and warrants that it has the qualifications, experience and facilities necessary to properly perform the services required under this Agreement in a thorough, competent and professional manner. Consultant shall at all times faithfully, competently and to the best of its ability, experience and talent, perform all services described herein. In meeting its obligations under this Agreement, Consultant shall employ, at a minimum, generally accepted standards and practices utilized by persons engaged in providing services similar to those required of Consultant under this Agreement.

  • Place of Performance All obligations of SBBC under the terms of this Agreement are reasonably susceptible of being performed in Broward County, Florida and shall be payable and performable in Broward County, Florida.
