Common use of Unexpected School Closings Clause in Contracts

Unexpected School Closings. 1. In the event that a single school building of the Xxxxxx District, but not the entire District, is closed due to mechanical failure, an act of God, etc., drivers losing driving time because of the closing will be paid the lost time, unless the canceled classes are rescheduled to be made up at a later date during the school year. 2. On days when the entire District is closed due to an Act of God, drivers losing time will be paid for up to three (3) days per year of lost time. (It is understood the first three (3) Act of God days of the school year are to be paid, not the first three (3) snow days of an employee’s tenure.) For Act of God days greater than three (3), drivers can elect to use a personal leave day or a sick day to receive regularly scheduled route pay for that day. Driver must notify the District on that week’s time card, or via e-mail no later than 5 business days, after the Act of God day of the intent to utilize an accumulated leave day. 3. In the event of a “two-hour delay”, mid-day runs will not be paid if not driven. Drivers will be able to use ½ sick day or ½ personal day to recoup any unpaid mid-day run hours, up to the normally scheduled hours for that day. If a driver has reported prior to the delay being announced, actual time worked, including pre-trip time, is to be paid effective from the regularly scheduled start time. 4. Xxxxxx drivers who drive to out of district schools as part of his/her regular routes will be paid normal bid time when out of district school is unexpectedly canceled or delayed, unless the canceled classes are rescheduled to be made up at a later date during the school year. This Agreement pertains to the daily routes, mid-day runs taking students to and from school and does not include any extra trips (athletics, or field trips).
