UNPAID OBLIGATIONS. Borrower certifies that upon final endorsement of the Note by HUD, Borrower shall have no unpaid obligations in connection with the purchase of the Mortgaged Property, the construction of the Mortgaged Property, or with respect to the Borrower’s Security Instrument except such unpaid obligations as have the written approval of HUD as to terms, form and amount.
UNPAID OBLIGATIONS. The Non-Defaulting Party shall be under no obligation to prioritize the order with respect to which it exercises any one or more rights and remedies available under this Agreement. Notwithstanding anything to the contrary herein, the Defaulting Party shall in all events remain liable to the Non-Defaulting Party for any amount payable by the Defaulting Party in respect of any of its obligations remaining outstanding after any such exercise of rights or remedies.

Notwithstanding anything to the contrary herein, the defaulting party shall in all events remain liable to the non-defaulting party for any amount payable by the defaulting party in respect of any of its obligations remaining outstanding after any such exercise of rights or remedies.
UNPAID OBLIGATIONS. Except as set forth on Schedule 4.16(j), ------------------ ---------------- there are not material unpaid charges, debts, liabilities, claims or obligations arising from the construction, occupancy, ownership, use, or operation of the Real Property. No such Real Property is subject to any condition or obligation to any material Governmental Entity or other person requiring the owner or any transferee thereof to donate land, money or other property or to make off-site public improvements.
UNPAID OBLIGATIONS. Grantor shall pay before delinquency all obligations secured by the Property and shall also pay before delinquency or file timely appeal of all taxes, assessments, fees, and charges of whatever description levied on or assessed against the Property by competent governmental authority (collectively “Taxes”). If Grantor fails to pay any taxes when due, Grantee is authorized, but in no event obligated, to make or advance such payment of taxes upon three days prior written notice to Grantor, in accordance with any bill, statement, or estimate procured from the appropriate authority, without inquiry into the validity of the taxes or the accuracy of the bill, statement, or estimate, and the obligation created by such payment shall bear interest until paid by Grantor at the annual rate of 12 percent.

C. Standard forms. 1. Only the following forms will be authorized for obtaining xxxxx- cial information from grantees for grant pro- grams:
UNPAID OBLIGATIONS. There is no payment obligation of any kind (whether fixed, contingent, conditional or otherwise) in respect of its Assigned Rights that such Seller is or shall be required to pay or otherwise perform that such Seller has not paid or otherwise performed in full; and

Notwithstanding anything to the contrary herein, the Defaulting Party shall in all events remain liable to the Non-Defaulting Party for any amount payable by the Defaulting Party in respect of any of its obligations remaining outstanding after any such exercise of rights or remedies; provided, that nothing in this PPA shall be construed as obligating the Host Customer to make payments from funds other than Pledged Revenues.
UNPAID OBLIGATIONS. Notwithstanding any provisions of this Agreement to the contrary, if, after giving effect to any sale, transfer, assignment or other disposition of any or all of the Intellectual Property Collateral pursuant hereto and after the application of the proceeds hereunder to Obligations, any Obligations remain unpaid or unsatisfied, Grantor shall remain liable for the unpaid and unsatisfied amount of such Obligations.
