Common use of Use of Donated Days Clause in Contracts

Use of Donated Days. In the event of catastrophic or prolonged, or chronic illness of a bargaining unit member, spouse, domestic partner, child, parent or birth of a child or member of his/her immediate family, a bargaining unit member who has exhausted his/her sick leave may request, through the Association, transfer of unused sick leave days from the sick leave bank to the affected bargaining unit member to be used as sick leave. The request will be reviewed by a committee comprised of the Association President, Association Vice President and the Superintendent with a decision reached by majority vote of that Committee. A letter of notification of the granting or rejecting of the request and, if appropriate, the number of days granted, will be delivered to the applicant. The decision made by the committee is final and cannot be the subject of a grievance. The bargaining unit member does not have to use the ten days of sick leave advanced discussed in Article V, Section (A) sick leave before requesting use of the sick leave. Guidelines for administering this provision will be as follows: a. A doctor’s statement will be required and included with the request for sick leave in order for it to be considered. b. Sick leave days will be paid at 100% of the requesting bargaining unit member‘s daily rate of pay. c. The receiving bargaining unit member will not earn sick leave or personal leave while using donated leave days. d. The receiving bargaining unit member cannot use donated days to extend the date on which his/her disability retirement takes effect, if applicable. e. The receiving bargaining unit member cannot use a total of more than sixty (60) donated leave days during his/her employment with the Bexley Schools.
