Vacation Leave Buy Back. 18 7.16.9.1 Employee, at his/her option, may sell back to the 19 District up to a maximum of 60 hours of vacation 20 leave per fiscal year. 21 7.16.9.2 An employee may sell back a minimum of eight (8) 22 hours. An employee will be limited to selling his/her 23 vacation only once per fiscal year. 24 7.16.9.3 An employee is allowed to accrue a maximum of 25 twice his/her annual vacation leave allotment. An 26 employee who has a vacation balance as of June 30, 27 2003 that exceeds this cap will be “grandfathered” and will have up to five years to bring his/her excess vacation back to the cap limits. An employee who has exceeded the cap as of June 30, 2003 will have 30 those hours “frozen” (for historical purposes) as 31 his/her maximum limit. An employee will not be 32 allowed to accrue vacation leave beyond that “frozen” 33 amount as he/she works to bring their accruals within 34 the cap limits. Employees who have not exceeded 35 the policy cap will not be able to exceed the cap in the 36 future. 37 7.16.9.4 Employees’ accrued vacation hours will be tabulated 38 as of June 30 of each year. An employee with more 39 than the maximum allowable amount as of June 30 of 40 each year will have his/her future vacation accrual 41 reduced proportionately. 42 7.16.9.5 An employee must make a written request to his/her 43 immediate manager to sell vacation leave. The 44 immediate manager will forward the employee’s 45 request along with his/her recommendation 1 to the appropriate vice-president for final approval. 2 The District retains the right to approve or 3 disapprove requests on an individual basis. Requests 4 will not be unreasonably denied. (An example for a 5 denial could be that the employee has not taken 6 actual vacation leave within the previous twelve 7 months.)
