Variation of Train Operations Deeds and Operator nominations. If Aurizon Network gives the Access Holder a Notice of Intention to Increase Nominal Payload in respect of a Train Service Type, then, unless the Notice of Intention to Increase Nominal Payload is withdrawn under clause 12.5, with effect on the Effective Date the Access Holder will be deemed to have given a notice to Aurizon Network in accordance with clause 4.5(a) varying the Access Rights which the Access Holder has allocated to each Operator under a Train Operations Deed in respect of that Train Service Type:
