Train Services. (a) Without limiting any other provision of this Agreement, the Operator must not commence any Train Services (including any new or varied Train Services) unless and until the Operator has done each of the following in respect to those Train Services(or, as applicable, those new or varied Train Services):
(i) provided to Aurizon Network a certificate of compliance for all of the Operator’s Rollingstock and Rollingstock Configurations in accordance with Clause 6.9 and Aurizon Network has authorised such Rollingstock and Rollingstock Configurations;
(ii) demonstrated to Aurizon Network that the Operator has entered into agreements in respect of the Private Facilities as required by Clause 6.11 (if applicable);
(iii) provided to Aurizon Network a copy of the Operator’s Emergency Response Plan which must be compatible with the Aurizon Network Emergency Procedures;
(iv) provided to Aurizon Network an acceptable Environmental Investigation and Risk Management Report in accordance with Clause 9.1;
(v) implemented those elements of the Environmental Investigation and Risk Management Report, if applicable, which are to be implemented prior to the commencement of Train Services;
(vi) complied with the community liaison requirements referred to in Clause 9.6(a);
(vii) provided to Aurizon Network evidence of its Accreditation as required by Clause 10(a);
(viii) conducted an Interface Risk Assessment in accordance with Clause 12(a);
(ix) devised in collaboration with Aurizon Network an Interface Risk Management Plan and implemented the elements of such plan required to be implemented prior to the commencement of Train Services;
(x) developed the Operator’s Safety Management System and incorporated into that system the elements and process referred to in Clause 12(a)(iii); and
(xi) taken out the insurances required under Clause 14 and provided to Aurizon Network evidence of that insurance as required by Clause 14.3, provided that, in addition to the above matters, the conditions in Clauses 6.9(d)(viii), 9.1(k), 9.7(g), 12(a)(ii) and 12(h) have been satisfied, to the extent those provisions apply in relation to or in connection with the relevant Train Service.
(b) Aurizon Network will use all reasonable endeavours to cooperate with the Operator to facilitate the Operator’s completion or compliance with Clause 4.1(a).
(c) If the Operator has not done each of the acts, matters or things specified in Clause 4.1(a) for its initial Train Services by:

Train Services. Actual costs incurred by CRC to provide special services (other than services otherwise provided for in this Agreement) at the request of an Operator with respect to trains, locomotives and Railcars for the account of such Operator, shall be paid by such Operator to CRC, provided that the costs and terms of similar special services rendered to each Operator shall be without discrimination between Operators as to cost and terms, giving due allowance to any differences in the costs of providing such services.

Train Services. (iii) provided to QR Network a copy of the Operator’s Emergency Response Plan which must be compatible with the QR Network Emergency Procedures;
Train Services. Train Services will operate as per the Scheduling Principles set out in Schedule 10. As a Through-Running Train, the Train Services are to be scheduled by QR Network in coordination with the Railway Manager for the Adjoining Network so as to endeavour to ensure that when QR Network converts the Train Service Levels into timetables using the process referred to in Clause 2.2 of Part 1 of Schedule 10 and converts the timetables into a Daily Train Plan using the process referred to in Clause 2.4 of Part 1 of Schedule 10, it must also consult with the Railway Manager for the Adjoining Network to endeavour to ensure that an uninterrupted train path is scheduled for the Train Service across the Network Interface Point.
Train Services. 1.1 The Train Operator shall be entitled to operate up to the minimum number of Train Services listed in paragraph 1 of Appendix 1 and notified to the Facility Owner in a Specification up to seven days in advance.
1.2 The Train Operator shall be entitled to request to operate up to the maximum number of Train Services listed in paragraph 1 of Appendix 1, and notified to the Facility Owner in a Specification up to seven days in advance
1.3 The Train Operator will issue a Specification 28 days in advance of each 7 day period showing the Train Services required to operate/
1.4 The Train Operator may vary each Specification up to 7 days in advance.
1.5 The Facility Owner will immediately acknowledge receipt of each Specification and variation.
1.6 The Facility Owner will consider each Specification in accordance with clause 6 of this contract and within 7 days of its receipt notify the Train Operator if it is unable to agree to the Specification, together with the reason for such decision
1.7 The Facility Owner will consider each variation made in accordance with clause 6 of this contract and as soon as reasonably practical notify the Train Operator if it is unable to agree the variation, together with the reason for such decision
Train Services. The Train Services shall be listed and described by Rail for London in a Specification in the form appended to this Schedule 3. The initial Specification calls for a maximum of 12 Train Service arrivals and 12 Train Service departures daily, between the hours of 20:00 and 08:00 during which period the Train Services shall have priority for regulation over relevant parts of the DBCi Network. The default arrival and departure route shall be to and from Wembley C Sidings Depot via the London end connection and the Up & Down High Level Goods Lines, and via the DBCi Network. An alternative route for use in the event of disruption is available via the Yard Line and Wembley Central (reverse).
