Variation Price Request. The Commonwealth's Representative may, at any time, issue a document titled "Variation Price Request" to the Consultant which will set out details of a proposed Variation which the Commonwealth is considering with respect to the Services. The Consultant must immediately take all action required under any relevant subcontract in relation to each subconsultant that would be involved in carrying out the proposed Variation. Within 14 days of the receipt of a "Variation Price Request", the Consultant must provide the Commonwealth's Representative with a written notice in which the Consultant sets out: the adjustment (if any) to the Fee to carry out the proposed Variation; and the effect (if any) which the proposed Variation will have on the then approved program. Whether or not the Commonwealth's Representative has issued a "Variation Price Request" under clause 9.1, the Commonwealth's Representative may at any time instruct the Consultant to carry out a Variation by a written document titled "Variation Order", in which the Commonwealth's Representative will state one of the following: the proposed adjustment to the Fee as set out in the Consultant's notice under clause 9.1 (if any) is agreed and the Fee will be adjusted accordingly; or any adjustment to the Fee will be determined under clauses 9.3(b) and 9.3(c). No Variation will invalidate the Contract irrespective of the nature, extent or value of the services the subject of the Variation.

At any time prior to the Date of Completion (but without limiting clauses 5.3 and 9.6), the Contract Administrator may issue a document titled "Variation Price Request" to the Contractor which will set out details of a proposed Variation which the Commonwealth is considering. The Contractor must immediately take all action required under any relevant subcontract in relation to each subcontractor that would be involved in carrying out the proposed Variation. Within 14 days of the receipt of a Variation Price Request (or such longer period as may be agreed by the Contract Administrator) the Contractor must provide the Contract Administrator with a written notice in which the Contractor sets out the: adjustment (if any) to the Contract Price to carry out the proposed Variation; and effect (if any) which the proposed Variation will have on the then current program, including each Date for Completion.

Within 14 days of receipt of a Variation Price Request (or such longer period as may be agreed by the Contractor's Representative), the Subcontractor must provide the Contractor's Representative with a written notice in which the Subcontractor sets out the: adjustment (if any) to the Subcontract Price to carry out the proposed Variation; and effect (if any) which the proposed Variation will have on the Subcontractor’s program under clause 9.2, including each Date for Completion.

Within 14 days of the receipt of a Variation Price Request (or such longer period as may be agreed by the Contractor’s Representative) the Subcontractor must provide the Contractor’s Representative with a written notice in which the Subcontractor sets out the: adjustment (if any) to the Subcontract Price to carry out the proposed Variation; and effect (if any) which the proposed Variation will have on the then current program, including each Date for Completion.

Within 14 days of the receipt of a Variation Price Request (or such longer period as may be agreed by the Contract Administrator) the Contractor must provide the Contract Administrator with a written notice in which the Contractor sets out the: adjustment (if any) to: in the case of a Planning Phase Material Variation, the Planning Phase Price to carry out the proposed Variation; and in any other case, the Delivery Phase Price to carry out the proposed Variation; and effect (if any) which the proposed Variation will have on the then current Planning Phase Program or Delivery Phase Program (as applicable), including each Date for Completion.
