Verification; Validity of Documentation. During a review cycle, GBCI will conduct an examination of documentation and performance testing results to confirm compliance with the WELL Building Standard feature requirements. Reviews are conducted across Your Defined Portfolio. Each feature verification method, including submission of documentation and performance testing results, is valid for three years from the date of approval as indicated in the WELL report. For a document to remain valid, the Portfolio or Project administrator, as applicable, must affirm the submission remains accurate as applied to the denoted set of Projects, or the Defined Portfolio or the Project administrator may, alternatively, update any documents or performance testing results of the Projects to which they apply. Such feature reverification may also support WELL recertification for individual Projects within Your Defined Portfolio. WELL Certification is valid for three (3) years under the WELL Building Standard. Please note that certain features of the WELL Building Standard may require annual documentation submission during the three (3) year time period for certification sought under the WELL Building Standard. At the three-year anniversary of a Project’s certification, the Project will have its certification status automatically continued so long as its features are based on active (non-expired) documents and current performance testing results. If a Project’s three-year anniversary occurs during a review cycle (as defined in the Portfolio Guidebook), the Project will maintain its certification status until that review cycle is resolved. If WELL Building Standard features a Project has pursued are based on documents and performance testing results that are expired, then the Project’s certification will lapse but non-expired documentation and performance testing results may help contribute to a WELL Portfolio Score for the Defined Portfolio.   • Precedence of Documentation In the event of any inconsistency between the provisions of the Terms and Conditions and the Schedules, or between any of the Schedules, the conflict shall be resolved according to the following descending order of priority:

  • Priority of Documents The documents forming the Contract are to be taken as mutually explanatory of one another. For the purposes of interpretation, the priority of the documents shall be in accordance with the following sequence:

  • Reuse of Documents All project documents including, but not limited to, plans and specifications furnished by COMPANY under this project are intended for use on this project only. Any reuse, without specific written verification or adoption by COMPANY, shall be at the CLIENT's sole risk, and CLIENT shall defend, indemnify and hold harmless COMPANY from all claims, damages and expenses including attorneys’ fees arising out of or resulting therefrom. Under no circumstances shall delivery of electronic files for use by the CLIENT be deemed a sale by the COMPANY, and the COMPANY makes no warranties, either express or implied, of merchantability and fitness for any particular purpose. In no event shall the COMPANY be liable for indirect or consequential damages as a result of the CLIENT’s use or reuse of the electronic files.

  • Contract Monitoring The criminal background checks required by this rule shall be national in scope, and must be conducted at least once every three (3) years. Contractor shall make the criminal background checks required by Paragraph IV.G.1 available for inspection and copying by DRS personnel upon request of DRS.

  • DOCUMENTATION; RECORDS OF PROCESSING Each party is responsible for its compliance with its documentation requirements, in particular maintaining records of processing where required under Data Protection Law. Each party shall reasonably assist the other party in its documentation requirements, including providing the information the other party needs from it in a manner reasonably requested by the other party (such as using an electronic system), in order to enable the other party to comply with any obligations relating to maintaining records of processing.
