Common use of Voluntary Mediation Clause in Contracts

Voluntary Mediation. The parties agree to submit, when all parties to the grievance 5 agree, any unresolved issues following Level II to voluntary mediation pursuant to the 6 American Arbitration Association's (AAA) Grievance Mediation Procedures prior to 7 initiating Level III of the grievance process as set forth below. When the parties submit a 8 grievance to mediation the timelines are waived so long as the agreement to submit the 9 grievance to mediation occurs prior to the timelines spelled out in Level III below. No 11 reduced to writing and signed by both parties. In the event that mediation is notsuccessful 12 in resolving the dispute, the matter may proceed to Xxxxx XXX.
