Voluntary Placement Agreements. In the unusual case of any Child that is placed with the Contractor for xxxxxx care services pursuant to a voluntary placement agreement (“VPA”) entered into under IC § 31-34-1-16(b) among the Contractor, a Placing Agency, and the Child’s parent(s), guardian, or custodian, the provisions of this Contract and the ICPR shall apply to all services provided in accordance with the VPA for which DCS makes any payment, to the extent the provisions of this Contract and the ICPR are not in conflict or inconsistent with the terms and provisions of the VPA.

Voluntary Placement Agreements. Prescribed Forms‌ Voluntary Placement Agreements Section 14 of The Child and Family Services Act provides for a parent, guardian or other person who has actual care and control of a child, to enter into a voluntary placement agreement (VPA) with an agency for the placing of a child without transfer of guardianship. An agreement may be entered into:  when a person is unable to make adequate provision for the care of a child because of illness, misfortune, or other circumstances likely to be of a temporary duration, or  because the child: ▫ is a child with a mental disability as defined in The Vulnerable Persons Living with a Mental Disability Act, ▫ is suffering from a chronic medical disability requiring treatment which cannot be provided if the child remains at home, or ▫ is 14 years of age or older and beyond the control of the person entering into the agreement. Subsections 14(2) and (3) set limits on the duration of agreements and renewals. Subsections 14(4) and (5) provide for the termination of agreements or renewals by an agency or the person who entered into the agreement. Subsection 15(1) states an agreement by a minor is valid. Subsection 15(2) requires a person who enters into such an agreement with an agency to provide financial information prescribed by regulation (see Section 1.2.6, Service Agreements for details). Prescribed Forms Schedule A of the Child and Family Services Regulation contains prescribed forms as follows: Form CFS-7 – Voluntary Placement Agreement Form CFS-8 – Renewal of Voluntary Placement Agreement Form CFS-9 – Termination of Voluntary Placement Agreement Form CFS-10 – Declaration of Family Income These forms cannot be changed other than by an amendment to the regulation.   • NEGOTIATION OF A SUBSEQUENT AGREEMENT The parties agree to commence negotiations for a new collective agreement to succeed this Agreement at least 3 months before the nominal expiry date. The parties intend to conclude these negotiations prior to the nominal expiry date. These negotiations shall be conducted on a collective basis between the parties with the negotiated outcome being subject to approval of a vote of the employees collectively.

  • AGREEMENT AMENDMENTS This Agreement may be amended at any time by written instrument duly approved by the President or President's designee and accepted by Faculty Member; provided, however, no such written instrument shall be required for any increase in Faculty Member's salary or any improvement to the fringe benefits of Faculty Member's employment, or for promotion in rank, any of which may be accomplished at any time by official action of the Board of Regents of the University of Nebraska (Board) without the necessity for written modification or amendment of this Agreement. This Agreement and Appendix “A” attached hereto constitute the entire agreement between the parties. This Agreement supersedes all previous agreements between or among the parties. There are no agreements, representations or warranties between or among the parties other than those set forth in this Agreement or the documents and agreements referred to in this Agreement.

  • Full Agreement The Contract Documents supersede all prior negotiations, discussion, statements, and agreements between Owner and Contractor and constitute the full, complete, and entire agreement between Owner and Contractor. There can be no changes to this Contract by oral means, nor by course of conduct of the parties, nor by custom of the trade. No changes to this Contract will be binding on either party hereto unless such change is properly authorized, in writing, in accordance with Section 3, Part 2 of the General Conditions.

  • TIPS Sales and Supplemental Agreements If awarded, when making a sale under this awarded contract, the terms of the specific TIPS order, including but not limited to: shipping, freight, insurance, delivery, fees, bonding, cost, delivery expectations and location, returns, refunds, terms, conditions, cancellations, defects, order assistance, etc., shall be controlled by the purchase agreement (Purchase Order, Contract, AIA Contract, Invoice, etc.) (“Supplemental Agreement” as used herein) entered into between the TIPS Member Customer and Vendor only. TIPS is not a party to any Supplemental Agreement. All Supplemental Agreements shall include Vendor’s Name, as known to TIPS, and TIPS Contract Name and Number. Vendor accepts and understands that TIPS is not a legal party to TIPS Sales and Vendor is solely responsible for identifying fraud, mistakes, unacceptable terms, or misrepresentations for the specific order prior to accepting. Vendor agrees that any order issued from a customer to Vendor, even when processed through TIPS, constitutes a legal contract between the customer and Vendor only. When Vendor accepts or fulfills an order, even when processed through TIPS, Vendor is representing that Vendor has carefully reviewed the order for legality, authenticity, and accuracy and TIPS shall not be liable or responsible for the same. In the event of a conflict between the terms of this TIPS Vendor Agreement and those contained in any Supplemental Agreement, the provisions set forth herein shall control unless otherwise agreed to and authorized by the Parties in writing within the Supplemental Agreement. The Supplemental Agreement shall dictate the scope of services, the project delivery expectations, the scheduling of projects and milestones, the support requirements, and all other terms applicable to the specific sale(s) between the Vendor and the TIPS Member.

  • Existing Agreements The Executive represents to the Company that he is not subject or a party to any employment or consulting agreement, non-competition covenant or other agreement, covenant or understanding which might prohibit him from executing this Agreement or limit his ability to fulfill his responsibilities hereunder.
