Waiver/Estoppel. Any party hereto may waive the benefit of any term, condition or covenant in this Agreement or any right or remedy at law or in equity to which any party may be entitled, but only by an instrument in writing signed by the parties to be charged. No estoppel may be raised against any party except to the extent the other parties rely on an instrument in writing, signed by the party to be charged, specifically reciting that the other parties may rely thereon. The parties' rights and remedies under and pursuant to this Agreement or at law or in equity shall be cumulative and the exercise of any rights or remedies under one provision hereof or rights or remedies at law or in equity shall not be deemed an election of remedies; and any waiver or forbearance of any breach of this Agreement or remedy granted hereunder or at law or in equity shall not be deemed a waiver of any preceding or succeeding breach of the same or any other provision hereof or of the opportunity to exercise such right or remedy or any other right or remedy, whether or not similar, at any preceding or subsequent time.
Waiver/Estoppel. Nothing in this Agreement is considered to be waived by any party, unless the party claiming the waiver receives the waiver in writing. No breach of the Agreement is considered to be waived unless the non-breaching party waives it in writing. A waiver of one provision does not constitute a waiver of any other. A failure of either party to enforce at any time any of the provisions of this Agreement, or to exercise any option which is provided in this Agreement, will in no way be construed to be a waiver of such provision of this Agreement.
Waiver/Estoppel. No waiver by either party of any breach of any provision of this Agreement shall be deemed a waiver of any preceding or succeeding breach of such provision or of a other provision herein contained.
Waiver/Estoppel. Neither approval by City nor failure to disapprove the insurance furnished by Contractor shall relieve Contractor of Contractor’s full responsibility to provide insurance as required under this Contract.
Waiver/Estoppel. Neither approval by the City nor failure to disapprove the insurance furnished by the Tenant shall relieve Tenant of Tenant’s full responsibility to provide insurance as required under this Lease.
Waiver/Estoppel. Neither approval by the City nor failure to disapprove the insurance furnished by the Grantee (or the applicable Developer Subsidiary) shall relieve the Grantee (or the applicable Developer Subsidiary) of the Grantee’s (or the applicable Developer Subsidiary) full responsibility to provide insurance as required under this Agreement.
Waiver/Estoppel. The failure of Grantor or Grantee to insist upon strict performance of any provision of this Conveyance shall not constitute a waiver of or estoppel against asserting the right to require such performance in the future, nor shall a waiver or estoppel in any one instance constitute a waiver or estoppel with respect to a later breach of a similar nature or otherwise.
Waiver/Estoppel. Neither approval by the Cultural Council or City nor failure to disapprove the insurance furnished by Artist shall relieve Artist of Artist’s full responsibility to provide insurance as required under this Contract.
Waiver/Estoppel. No term or condition of this Agreement shall be deemed to have been waived nor shall there be any estoppel to enforce any provision of this Agreement except by written instrument of the party charged with such waive or estoppel.
Waiver/Estoppel. The failure of Lessor to insist upon strict performance of any portion of this Lease shall not act as a waiver or relinquishment of any portion of the Lease but rather the Lease will remain in full force and effect.
