Waiver of Lessor’s Lien. (a) Lessor waives any lien rights it may have concerning the Lessee Facilities, which are deemed Lessee’s personal property and not fixtures, and Lessee has the right to remove the same at any time without Lessor’s consent.
(b) Lessor acknowledges that Lessee has entered into or may enter into a financing arrangement including promissory notes and financial and security agreements for the financing of the Lessee Facilities (the “Collateral”) with a third party financing entity (and may in the future enter into additional financing arrangements with other financing entities). In connection therewith, Lessor (i) consents to the installation of the Collateral; (ii) disclaims any interest in the Collateral, as fixtures or otherwise; and (iii) agrees that the Collateral shall be exempt from execution, foreclosure, sale, levy, attachment, or distress for any Rent due or to become due and that such Collateral may be removed at any time without recourse to legal proceedings.
Waiver of Lessor’s Lien. Lessor hereby waives any and all lien rights it may have, statutory or otherwise, in and to the Improvements or any portion thereof, regardless of whether or not the same is deemed real or personal property under applicable laws.
Waiver of Lessor’s Lien. Lessor hereby waives any contractual, statutory or other Lessor's lien on Lessee's furniture, fixtures, supplies, equipment, and inventory.
Waiver of Lessor’s Lien. 7.1 Lessor hereby waives any and all liens rights it may have, by statute or otherwise, in and to Lessee's installations or any portion thereof placed upon the Premises, regardless of whether or not the same is deemed real or personal property under applicable laws. Provided that, if Lessee is deemed in default, as that term is defined in Section 10(a) of this Lease, then Lessor may enforce any and all lien rights it may have, by statute or otherwise, in and to Lessee's installations.
Waiver of Lessor’s Lien. Lessee, at its sole cost and expense, may supply and install anywhere in or on the Premises any furnishings, fixtures, equipment and/or other personal property (collectively, “Personal Property”), which it deems necessary for its use of the Premises. All of Lessee’s Personal Property, except that which is permanently attached, and inventory shall be and remain the personal property of Lessee and shall be removable by Lessee any time prior to the expiration or earlier termination of this Lease. Notwithstanding anything contained herein to the contrary, Lessor expressly waives its statutory or common law landlord’s liens as same may be enacted or may exist from time to time, and any and all rights granted under any present or future laws to levy or distrain for rent, whether in arrears or in advance, against the Personal Property, and further agrees to execute any reasonable instruments evidencing such waiver, at any time or times hereafter upon Lessee’s request.
Waiver of Lessor’s Lien. Lessor waives any lien rights it may have concerning the System, which is conclusively deemed Lessee’s personal property and not a fixture.
Waiver of Lessor’s Lien. LESSOR does hereby waive any and all ----------------------- lien or claim of lien against LESSEE, the Premises, the Improvements and all other trade fixtures and equipment of LESSEE located on the Premises, arising from this Lease or the relationship of LESSOR and LESSEE (including, without limitation, any lien created pursuant to O.C.G.A. Section 44-14-341) (or to the extent any such waiver is ineffective, LESSOR subordinates any such lien or claim of lien to the liens created under any and all Leasehold Mortgages, whether now or hereafter existing).
Waiver of Lessor’s Lien. Lessor hereby waives any and all rights it may now or hereafter have under applicable Law to impose a lien or any other charges against any property of Lessee, including, without limitation, Lessee’s leasehold interest in the Leased Premises, for unpaid amounts due Lessor. Lessor shall execute any and all further documentation that may be requested by Xxxxxx to confirm the foregoing.
Waiver of Lessor’s Lien. Lessor waives any statutory liens and rights of distress with respect to the personal property (trade fixtures, equipment and merchandise) of Lessee from time to time located on the Premises ("Lessee's Property"). This Lease does not grant a contractual lien or security interest to Lessor with respect to Lessee's Property. As to any lender of Lessee having a security interest in Lessee's Property ("Lessee's Lender") Lessor agrees:
15.1 To provide Lessee's Lender, upon written request of Lessee, a copy of any default notice given to Lessee under this Lease;
15.2 To allow Lessee's Lender prior to any termination of the Lease or repossession of the Premises by Lessor the same period of time after receipt of such notice of default to cure the default as is allowed Lessee under this Lease) and
15.3 To permit Lessee's Lender to enter upon the Leased Premises for the purpose of removing Lessee's Property any time within twenty (20) days after the PAGE 26 - LEASE 27 effective date of any termination of this Lease or repossession of the Premises by Lessor. Lessor further agrees to execute and deliver such documents reasonably requested by Lessee's Lender, from time to time, to evidence or effect such waiver and agreements. Notwithstanding the foregoing, Lessor may condition its review and/or execution of any instrument required by Lessee or Lessee's Lender's upon Lessee's reimbursing Lessor for the actual, reasonable out-of-pocket costs in reviewing any such waiver, estoppel or other instrument. Lessor will not be required to recognize from time to time more than two Lessee's Lenders at any single time (for purposes of notice and cure rights or execution of documents).
Waiver of Lessor’s Lien. Lessor hereby expressly acknowledges and agrees that Lessor waives any and all statutory and common law lien rights in and to any of Lessee’s property located at the Leased Premises.
