Common use of Waiver of Performance Clause in Contracts

Waiver of Performance. The Employee and IMI may, in writing, extend the time for performance or waive non-compliance or non-performance by the other of the other's obligations, covenants and agreements under this Agreement. No act or failure to act of the Employee or IMI shall be deemed to be an extension or waiver of timely or strict performance by the other of his/its obligations, covenants and agreements under this Agreement.
