Waiver of Visual Artists Rights. Airline shall not install or allow the installation of any object in the Premises that constitutes a work of visual art under the Visual Artists Rights Act of 1990 (VARA) unless and until Airline has (a) obtained the prior written approval of the President/CEO, and (b) provided Authority with a written waiver from the author or artist of such work of visual art, in form and substance reasonably satisfactory to Authority, which waiver shall identify specifically the work of visual art and the uses of that work to which the waiver applies in accordance with 17 U.S.C. §106A(e)(1). Airline shall also provide Authority with a similar written waiver that is effective to bar any claim by an artist with respect to a work of fine art under the California Art Preservation Act, Cal. Civil Code §§ 987-989.

Nevertheless, Executive hereby waives, as to the Claims, any claims, demands, and causes of action that might arise as a result of such different or additional claims, demands, causes of action or facts.

  • No Waiver of Sovereign Immunity Nothing in the Contract will be construed as a waiver of the System Agency’s or the State’s sovereign immunity. The Contractor shall only use such drawings, Specifications and other documents for this Project. Neither the Contractor nor any Subcontractor or material or equipment supplier may use such drawings, Specifications, and other documents on other projects without the specific written consent of the Owner. All models are the property of the Owner.
